Getting lawyers to fight an international copyright case is going to cost an arm and a leg. They should definitely copyright strike them though, it’ll get the game off Steam for 14 days.

Winning an international copyright lawsuit is incredibly difficult and very expensive. Not something a game studio, selling a free video game, can afford. And I doubt any lawyer would take this case on contingency.

The problem is that legal fees suck up any monetary advantage you can gain and the process can take years especially since these guys are in another country. This is always the problem with this type of thing. It should almost be treated as theft and be criminal rather than a civil complaint. But it's not, unless the entities are really big. My advice. Let it slide, forget about it, ignore it. Better for the nerves.

Just sue them. They already outright admitted in their emails that the assets were stolen through their BS arguments that will not stand up in any court. This will be a clear-cut case with the best they can hope for is that they will be forced to pay you guys for the assets and or worse, forced to stop selling their game and reimburse you at the same time. Also, stumbled onto you guys through this video. Decided to give OHD a try on steam as well. As a gamer who enjoys the pure experience and I love what you guys are doing with it and what it stands for.

You obviously didn't go to law school, that won't happen in a million years....Utter waste of time, money not to mention the emotional distress of it all while failing at the end. The lesson here is preventative, you can't cure this mess or be compensated in a court of law, but you can avoid it in future - which in of itself, will cost a lot of money. He hasn't protected his game or his IP properly, and someone has taken advantage of it - this is what a court will say after he's spent $50 - $100k

I am pretty sure Steam has a 0 tolerance policy for this. From what I understand, as soon as you file a lawsuit their game will be out of steam market until it is resolved. Look at what happened with Dark and Darker, almost killed their studio even if it was all a lie from their competitor.

i am italian, and being a game developer myself and having worked with other italian devs over the past i can assure you that this is the type of mentality most people have in regards to making a videogame. they think that making a game means "making it big" economically, the money side of things is the main driving motive. no passion whatsoever, or very little anyway. people here REALLY think that "making a game" equals to making a shit ton of money really quick and a rare thing that you can brag about. if you say you "make games" for a living or in your spare time, people are amazed and look at you with crazed eyes. it is very uncommon, therefore people don't comprehend it. and when they find out about the business side of things, they suddenly want to make one. i'm pretty certain the thought process the devs for the venatur game had was like "hey there's a free game on steam, probably means we CAN steal what's inside of it since it's free i guess. nobody's gonna know right? it is free so who gives a shit anyways. there is a load of other crappy/indie fps games on steam, who cares."

Man this resonates even though I'm younger. We recently found out that the IT guy for our webserver and business, the guy was a fraud... dragging everything, making up and even creating hurdles just for wanting money left and right for various different reasons that we were not aware of (can't blame dad, 50 y'o man who grew up without tech and is more a crafty/handy man). I talked to an old friend of mine, describing the situation and I found out it is a very common thing especially in tech and it's getting worse and worse. -_- We said screw this, I'm learning everything from the scratch, on my own, dropping everything just to learn and get better just to have our own agency and control. You can't trust people these days especially with tech and once business is in involved it get's even more absurd. What hurts me the most is I was so passionate, looking up to the guy and wanting to learn and improve, I was not aware how stupid I was for thinking like this because I always value people knowing more than me, but seriously f that... "The older I got, the smaller my circle of friends got." this for real, only need few few people who have proven themselves to be there and those are enough you don't need more, a year or two ago I used to have my addlist and notifications full of "friends", they're all gone now and rightfully so, other than wasting your time they're no good for anything. But appreciating the good ones and keeping them close is the right way. I enjoy getting older honestly, the more I learn the better I feel not to repeat the same mistakes. Wall of text and I wrote a lot but I felt your comment more than anything these days.✌🏽

These kind of disputes are typically between companies. The winner in court usually gets "all" profits made using stolen property/design and requires a hefty damages fine. The way these developers act is like a HR manager caught lying. Full of apology and friendship. Yet avoiding solving the problem. They entirely deserve to be sued and put out of business. Not only for the theft itself. But also for how consistently they try to take zero ownership of this having occured. None of their behavior speaks of any professionalism to the trade. You deserve every cent of their stolen money, legally.

this happened with jerry rig everything when he made his phone cases, casetify stole their assets and charged more for their crappy iterations. jerry put in easter eggs inside their teardown skins (they used high end cameras and 10k hours of optimization etc) and the resolution of castify was crap lol. They were using the same insides from droids for iphones too lol he officially filed lawsuit too! Casetify is a 1 billion dollar company too

As a Game Developer it has happend to my team once as well. We hired an artist to make cards covers paintings. After some time we realised they are all repainted screens from movies and netflix series. We immidiately started deleting and changing these cards covers and filed a law suit against this artist. In the contract he signed that all the work that he have done for us is his made from scratch so guy got ultimately ducked for trying to play with us... I don't wish this happen to anyone, it's really nasty and bad stuff to indie dev studios but ye these things happen often...

My studio had the exact same experience. The artist tried to argue with me that the work he produced was all original even though he turned around 120 assets in 2 days. They were clearly digitized photos with filters applied and he was adamant that I didn’t need to worry about licensing of any images. I found the original images for 6 of the assets and when presented, he still denied it and actually still tried to invoice me. I paid him $100 and had my lawyers send him a notice stating that we refuse any and all work he submitted and he alone is responsible for any legal action the original rights owners might take against him. I never heard from him again. We had other problems with freelance artists but nothing that blatant again.

Trust me, its a PITA to do so but it saves you the trouble of having to do mental gymnastics with these people who paradoxically spend MORE ENERGY trying to justify their shit than actually, you know, make an original product.

I've been there man. I used to be a developer for a minecraft mod called The Aether, and a couple years back a studio ripped off the mod and put it on the bedrock store, even taking the name. We had many examples of the assets that they pulled straight from our project (which are crafted by hand) and it was a long an tedious project to get it sorted out. They even offered us a share of the revenue, but we did not take that deal as it was more reactive than a proactive agreement. Pretty sure it'd also restrict our ability to create our own project one day. Good luck on getting this resolved.

Dude I’m so sorry you’re going thru this. Someone close to me is currently under fire for something similar. They create content and someone else has not only stolen content from the person I know, they sued them for allegedly stealing from them. It’s insane how people live in an alternate reality to try to get money out of it. I hope it all plays out okay for you and your team. 16:18 really speaks to me. I’m going to share this video with the person I’m referring to because it’s good to not feel alone in these types of situations. You'll most likely need to retain a lawyer in Italy and send out a cease and desist letter, it will cost money but you'll either scare them off and they will remove the assets or they will continue and you'll have a case on your hand that you'll need to follow up. Either way it's gonna cost you some money, and most likely will end with them just running off unless you pursue them for everything which means fighting them in court internationally. DMCA and cease and desist is your best bet.

Hopefully this situation has been handled since the vid went up, but honestly you don't have anything really to worry about here. Hold your line and be prepared though, if this gets legal ofcourse things will be a bit tricky but you are in the right here. The other dev team coming after you is just them doubling down on a bad decision and it'll eventually turn in your favor. Honestly kinda nice you didn't have to go after him with the layers, they came to you with theirs! Fortunately either way works out for you. I'm gonna go check out your game now, great vid!

I hope things smoothen out, operation harsh doorstop and it's idea of being a free game is wonderful and I'm sure by the time it's finished it'll be better than any CoD. It's like this with STLs and 3D printing. If you make your designs public in any capacity, you will have to police Etsy, EBay, and other sites for people trying to illegally sell your printed designs. This is kind of what sucks about tech. Lots of people who probably don't normally steal, will steal your IP.

I am a video game artist and I am also currently working on a game as a solo dev. I do sometimes use some assets that aren't mine as placeholders because they take time to build and if you are planning a level it looks better with borrowed assets than just simple primitives. But i never keep those borrowed assets in a finished product. That could happen accidentally though. This situation is insane and i am tired of people, AI stealing artists long and hard work, changing few things and calling it theirs and then not even take the guilt and do the right thing. Not to mention it has already being monetised. Meaning Italian studio already have money to pursue the lawsuit. I agree with bluedrake, he has served as an inspiration to me to pursue my game development dreams when people around me doubted. So BD deserves my respect as well as his great team of developers that put a lot of hard work into creating a very impressive game. These times are rough and its psychotic that someone is doing that just to hurt others.

Don't listen to these others. I have been doing this since 99. Everyone uses place holder art. You can't really copywrite generic objects, red barrels for everyone. You need to put you name in the meta data of your models.

The past few months i've had a person tell me i should be liquidated because im disabled, 2 people tell me i'm a waste of air to my face because of it and have had two teenagers kick my walking stick out from under me. Western society isn't immune. And in all of these cases not a single "good" person intervened. Western society isn't special. People are shit everywhere. I'd say its worse here because people think we are somehow above shitty behaviors.

What you said about humanity is doomed is exactly what has happened to me too. I stopped going out and having drinks with my (former) friends, cause everyone around us and eventually they themselves started becoming so toxic and egocentrical, that I would almost vomit in my own mouth and started having panic attacks being near them. They would create drama, steal eachothers girl- and boyfriends or at least attempt, then making lame excuses and accusations and lie about everything, and eventually when I was going out, some guys were harassing a woman in the bus, so I told them to sit their ass down and leave people alone that clearly are uncomfortable by their approach. What happened was that the woman looked weirdly at me, like I was going to do the same right after or something. Not even a thanks. Probably because she is used to this behaviour, which is sickening to me. Also shortly after, these dudes came back up to my seat and pushed me into the corner and threatened me with a knife. I finally had enough after that and said fuck it, I'm gonna stay home and let the world burn outside my windows. Ain't no way of fixing that shit.

Hey man, sorry to hear about that. I a hundred percent understand where you're coming from. Its the most frustrating kinda anger, when people steal your work and profift from it. Something that you put the time money, talent and effort into. On a similar story, A year ago I ended up making two comedy videos that blew up on tiktok. I took the time to write my script, self taught my self to sound german(to the point that real Germans swore I was from Germany) , researched/ hired a editor, and practiced to create something great. Suprise, when I woke up to see the video somehow getting millions of views and likes. Just not towards my account. Within the first couple of days had a bunch of different creators claim credit for my work. To the insane point where they would make endless copies of my videos, just to steal from each other or literally just steal the sound from the video. That part actually gave me a good laugh. Then, when you try to ask for credit from those same creators profiting off you. They'll just straight up block you, and keep making profit off your work. Even when you do call them out , and "just like you said". People will twist and turn their words to justify stealing your work. Just so they can get a profit or enjoy the rewards. It sucks man but keep fighting and dont get discouraged. As long as you're doing right, the credit will eventually get back to you. Hope it works out for you man.

First off I want to say. I appreciate the work you and your team do. It's Dev studios like this that people still have faith in gaming. Here recently from what I've seen and heard. Other devs are stealing from smaller dev studios because here recently nothing is getting done. Some are getting away with it, or the process is drug out so long it don't matter because the people stealing the assets already have made some money. Hopefully you fight this and it gets done quick.
