Sarah's probation period at work was extended. She believes the extension was unfair and has submitted a grievance for racial discrimination but her employer has not taken her claim seriously and she is worried she's going to be forced out. Daniel offers some reassurance.

Yep. Where I worked they had a semi-secret method of trying to remove people who put in complaints, for 5+ years they tried to fit up the union rep as he was a thorn in their side, the company removed a popular, very good manager at the head and replaced them with a yes-man. So its not unrealistic because she put in a grieveance that they're trying to push her out.

I got the impression she thought the re-naming of the common HR procedures might be obfuscation, on the part of the employer) and things were therefore not being dealt with properly... but a bit difficult to tell in such a short conversation.

I did the same and was labelled a stirrer...after 22 members of staff had left I was told the manager was "just being businesslike" .

I don't understand people who call up a lawyer to ask for advice then try to obscure or explain away important information that doesn't benefit their case. Do you want legal advice or emotional validation? Because if it's the former, Daniel can only advise you based on what you tell him and if that's a disorted picture of the truth then you can't expect the advice based on it to be accurate.

her job is protected?? - that really depends upon the level of embedded bullying - HR often will fabricate cases etc

Daniel isnt a expert on all subjects ...sensitivities are a big case and theirs two sides to stories...its a difficult situation for daniel to pre guess the outcome...

Doesn't sound like she's just making stuff up if her union supports her, as there's a good chance they might have to legally defend her if she takes it further and they won't want to sink money into a case they think they'll lose. It was like pulling teeth getting the relevant information out of her, though.

@@allip4226 agreed although she probably didn’t want to get too specific so she couldn’t be identified by any details. Also I kind of agree with her - an equality and diversity charter isn’t specifically about race and is much more general as it’ll cover sex, sexuality, gender, and disability too, for an employee trying to understand where they stand I can see it feeling like a much broader stroke. Doesn’t surprize me at all that OP is automatically suspicious, it’s that kind of attitude that means many people never report their experiences of racism for this exact reason and it sounds like it’s an attitude her employer shares. I hope she gets justice.

@@makslargu5799 hey Maks Largu, in the UK people are innocent until found guilty. I don't want to brand anyone a racist or sexist or whatever, as that type of mob cancel culture, has lessend society. In some country's they stone women to death for being assaulted and cut the hands of kids that steal. This woman sounds mega sketch as the people who have the problem "already left" - sounds like someone looking to tarmac your drive but needs the money upfront to buy the materials.

I think many people especially in public service jobs are employed due to equality rules then the job is too big for them and it's their capability that's the issue. Then the bosses realise this person is paid the same for doing less than another person who is more capable but the bosses struggle to remove the person due to colour or religion. This is why public service employers struggle with this issue and public service workers find a holiday home.
