Summary judgement win in the future
@RoleAce5 ай бұрын
*UPDATE IF YOU'RE WONDERING* As of 6/25/24. -On 5/1/24, Caseify responded to the lawsuit (denied everything) and provided counterclaims -On 5/22/24, Dbrand responded to the counterclaims (denied what Caseify claimed) -On 5/23/24, Caseify tried to have the case dismissed (motion to dismiss) for failing to make a claim On 5/28/24, the judge responded to the motion to dismiss, basically saying you can't claim they didn't make a claim if you literally made a counterclaim to their claim. On 5/30/24, after their motion to dismiss failed, Caseify filed a motion for summary judgment (basically one of the final attempts to get a case dismissed). On 6/20/24, the judge rejected the motion for summary judgment. In essence, this does not mean that Dbrand is right or wrong, nor does this mean that Caseify did or did not do anything illegal. This DOES mean that the court system believes that the case does have legal basis and that this will now have to go to trial (as requested by Dbrand). Figured I would provide this info, which is publically available, but since not everyone either knows how to access it or understands it, figured I'd help. Only in dystopian hellscapes where people have to pay for them, themselves. A functioning social safety net and a medical system will take care of that cost for you. I hear my "american" readers all chime in: "But i don't want to pay for someone elses health care"... Imagine what purchasing health insurance does.. @@eidodk Yeah. Health insurance is done incorrectly here, you're completely correct. But I also don't want to pay for anyone else's healthcare. The problem is healthcare was cheaper, it was more affordable. But once the government got involved HOSPITALS started charging A SHITTONNE to make double the profit. Before Obamacare, the only thing that was tough to get was surgery. But at least you weren't taking out what student loans are for that.
@eidodk Жыл бұрын
@@StephenFasciani You're part of the problem though. The notion of "not wanting to pay for someone elses healthcare" is exactly what's wrong with the US. That's the quintessential idea of what taxes are for - SERVICES RENDERED TO THE PEOPLE PAID FOR BY THE PEOPLE. The US is such a fearful place, you spend the taxes on the millitary instead. The best evidence for it being a fearful place, is that homeowners thinks they need guns to protect themselves - That is ONLY an issue in places where the country is at war with itself. The problem was NEVER the hospitals, it was the insurance companies. The "free competition" between insurance companies is what has created the hellscape. It's now an insurance INDUSTRY, with billions and other billions of revenue for stock holders. A state controlled health industry would be a zero sum industry, in which the ONLY thing that is necessary, is to balance the budgets. If $10 goes out, $10 has to go in. Until your country starts thinking more like a group, than a country of individuals, it will only get worse.

F*ck robs a guy that look like he is about to snap your neck while giving a calm quote like "Bone is bone and bones break"

Love your attitude towards this situation. I know I am late with comments but dude. Love the idea of the giving away wheel chairs. You are a true legend.

Ive been with you since 2014, when i got my first job in a repair shop. You taught me what i needed to learn and grow. Now 9 years later im in the same field still and can support my family thanks to your videos teaching me years ago! You always help out people and good causes and these people are idiots for trying to steal from you. Justice will be given.

It's insane how many small businesses i discovered via social media have reported the same thing happening to them. I feel for you!

I saw DBrand's tweet thread about, this isn't just theft its embarrassing. I hope you win and Casetify reap what they've sewed.

Sowed would be the right spelling in that context, and I 100% agree with you

OK but like... how much reaping are we talking here? How much money are they trying to get?

@@johnmay9598 to get a ballpark answer you would have to ask a lawyer who specializes in copyright law. It depends on how many labor hours have been determined to have been stolen and how many sales Casetify stole from dbrand by releasing this product.
