@@ericm6818 Doesn't matter you don't say a WORD. They are going to do everything they can to avoid paying a settlement. Settlements like this will take years and I'm sure his lawyers told him not to discuss his case. If they didn't he needs to find a new lawyer. As he heals he might find he has limitations he didn't realize, a higher level of disability, or the doctors might discover something else wrong that was overlooked initially. You don't say a WORD. Especially on a radio talk show discussing a settlement you won't receive for years.

Workers comp is the worst thing I’ve ever had to deal with. I had a legit work injury and they denied my claim. SAIF is absolutely horrible and I feel sorry for anyone that has to deal with them

Corporations pay billions a year for insurance on stuff like this. He should get a massive payout. I’ve seen family members who were not the same after much minor accidents.

This was one of the weirdest Dave Ramsey conversations. They were like talking to him so weird. They were like you didn't win the lottery, like the poor injured guy was being greedy or something and then they were like your never going back to Percocet are you, like the caller's a drug addict or something.

It is all a bit weird. But most people start their addictions after being introduced during a hospital stay.

@@ianeagle40nilThe guy has to go back for more surgery. He’s going to be on something after that. It’s not appropriate to make him say “never again” when he knows he’ll be having more surgery. And most pill popping addictions actually started from people who were already addicts, then they get injured or whatever, then they’re assisted to pills. People are perfectly capable of managing pain meds without addiction. Being honest about the pain is the first start. I had knee surgery and was given Percocet. I went through my first bottle faster than they wanted, even though I followed their instructions to the letter. But I was still in agony, especially after my first PT appt. So they gave me one more rx and said no more after that. I took one, maybe two more doses, and was fine with ibuprofen after. Every one is different, but we are still capable.

They are just trying to take his situation seriously. This is exactly how peoples lives get ruined. This is a textbook start to an opioid addict who ends up on drugs. Also, this man sees to be overly optimistic about getting back to good health. His income is 100% dependent on his health. His health has been taken from him and he does not know how that will affect him in the years to come. (Serious damage to rotator cuffs, biceps, bones, and brain) He needs to understand that his ability to generate income has been compromised and he might need medical assistance later as well.

Yeah, the Percocet bit really bothered me. I can’t imagine telling him to just take the pain if something else went wrong and he needed more. He just has to work with his doctor.

With brain damage this guy needs to make sure he gets proper mental care. I've been there. Get diagnosed if you have anything, because it can affect your behavior immensely without the patient even noticing. Frontal lobe syndrome is a pain to deal with, for example. A traumatic brain injury can have many consequences. And they can be treated.

@@anyamuenchgrieser8686 yes decades, I broke all the bones in my foot but to. That was in 1988. They put my foot in a cast. Dr. told me i would have problems with it the rest of my life. 36 years later I do have problems. Went to a knee DR. today. Get all you can get. You will have problems. If you can prove it was neglect, get all you can. I did not, Do not think they will take care of you along the way. In 20 years nobody will even know you got hurt. Take to a lawyer. Sue everyone you can. Get it now. I was just a few years older then you. You are go to hurt years down the road.

@@bettysmith4527 I'm glad you used the term believe. I use facts not my beliefs. Opioids are overused but doesn't mean there isn't benefit from them. Narcotic abuse, dependency and addiction are a sign of other problems in the life of the user, not the cause. They can be a weapon or a tool, just like a hammer or firearm

I really wish him the best I was a Union Carpenter myself; after my injury (minor) they greeted Mr back a told "safety" to kick me off the site; they did. Afterwards I was essentially blackballed. I lost everything. Went thru a bout of depression, worked at a cheese house afterwards. I regret none of it. There was a rainbow that the end of it all. :)

Well they actually lock the casket with a special key (usually after the display at the funeral). So you would never be able to get yourself out.

John should not shame someone who may have chronic pain from using prescribed opioids. The majority of patients prescribed opioids never abuse them or become addicted. Those who do often have other social issues such as loneliness or feeling a lack of purpose that contribute to addiction. John clearly has a narrow view of opioids (likely a moralistic one) and pretends to be a mental health provider when his degrees are in education.

@@hiteshadhikari Sadly, he is under the care of W/C doctors. They will determine when he has reached maximum medical improvement(MMI). If he tries to prolong his injury, he will be determined to be malingering, and benefits could stop and his treatment will cease.

Disagree with so much of this. He will be making the same amount of money, so no big deal? what about the long term affects? What about never feeling like a young man again? What about pain and suffering, and diminshed abilities that he hasn't even noticed yet? What about causing the employer enough pain ($$) that they never make the mistake that led to his injuries again? The point is *not* just to makd him whole, especially when they don't even know what "whole" entails since they're not doctors. They are definitely speaking like business owners.

It doesn't seem realistic that the guy would be able to go back to work 100% the same as before. He should see what other options he might have work wise or use the settlement for early retirement planning.

This is all about a good attorney and patience in my opinion. He’s probably going to have ongoing health issues for the rest of his life. Get a good settlement and invest it to get back 5-10 percent every year and work as long as you can and let that investment build.

That’s always a possibility but he’s only 24. That is something I never would consider. I’m a workaholic myself. He’s going to lose about 35-40 percent typically to an attorney so it would have to be a really large amount. Also he’s married so she’s going to want to spend money if she’s anything like my ex was!! lol

@@bbkyjohnson He will lose 50% plus attorneys fees. Most/ not all lawyers go to 50% when they file a motion to sue and set a court date which they must do in order to get the attention of the insurance company. Otherwise it is a bluff and NO insurance company will even answer your phone call.

Don't be absurd, Delony. He CAN'T predict "never". This is the problem with immature binary views of issues. Percocet is HIGHLY necessary for people in pain. The fact that idiots abuse the drug or that unfortunately some people become easily addicted SHOULD NOT mean people who ACTUALLY DO NEED it, be deprived of it.

Agree. His remark was so judgmental and arrogant. Why doesn’t he go thru surgery and do it without pain meds? The fact the man is already off the meds certainly does not indicate addiction. His remark really irritated me. Arrogant.

@@jimroscovius thanks I thought it was a 15. I have a 30 year fix but got it before I found Dave but it Financially didn’t make sense to go to a 15 and refinance so we have just been pounding down on the principal trying to pay it off sooner

Sorry to tell you, if he can walk and talk he is out of luck. The insurance company is filming him 24/7, and he called a national radio station and said he was doing well. They will request his cell phone records. Insurance will spend tens of thousands to get out of paying a claim.

Rotator cuff surgery changes you. You will suffer a lot of pain even after surgery that will impact your ability to push, pull and lift heavy objects. Be aware of that when thinking of future work plans

Any money should be kept for later in life, invested, etc.. The injuries this guy had might effect him later in life and he has no idea. I would also not settle that easy, and go for long term medical, or even life long medical, aside from monetary compensation. The money is basically for pain/suffering, the life long medical is for long term unforeseeable needs. The guy is wanting to settle it all too quickly. This situation needs a better strategy.

He's 24. He can recover, but develop arthritis and lots of other issues down the road. He might be talking about a 3rd party settlement with the owner of the building / or another contractor at the work site, as opposed to his employer's worker compensation insurance. They aren't the same, and they operate under different rules, depending on what state he lives in. I've seen 3rd party cases take up to 20 years to finalize. He could finalize the 3rd party suit, and still keep his worker's comp claim open. FYI, his worker's comp insurance company may be entitled to part of his 3rd party settlement. So, yes, he's better off waiting until the $ is in hand, then putting it into a Roth IRA for his future. Since you can have your kids inherit a Roth IRA, (if you don't use it all up), then that protects his daughter's future, too.

It sounds like he thinks he's going to get a settlement right away. It takes years for a settlement to be agreed upon. They're certainly not going to settle while he's still in treatment.
