I think both ways when you enter a relationship you should take responsibility of honesty upfront.if you love someone n yes u r positive in any disease one has to let them know n allow them to decide whether they stay or not.if its not eaSy to b stRaight at least ask question indirectly n see where the other person stands with situation like that then if s need be walk away instead of infecting them intentionally

Unfortunately people nowadays are selfish and very deceitful. The city ends up being on the one party to really find out and not rely on just being told. It's sad but there are those people out there. Couples should go together to the clinic every few months and get tested together anyone coming up with excuses what what what red flag!

It is Shannon. The law recognizes that as a crime. However, its not always easy to prove. Its the word of the HIV- person against the HIV+. The person that was aware that they're HIV positive can, at times, lie and claim that they told their their partner that they were HIV positive and they still didn't mind when they had sex. The court cannot just convict someone when there's no concrete evidence. I know it's bizarre.

In your case, you have a strong case because you discussed taking the HIV test. You can prove you took the test. You specifically asked him to take one. Even if he did not tell you he was +ve, his omitting this information is the same as lying. He was deceptive about something you had specifically discussed. You need a good lawyer to help you with this case. Even if you have let everything go, he is still out there infecting other people.

Technically, based on the third point, you consented to having unprotected sex with the assumption that he had tested and was negative (an assumption made through the conversations you had), in the event that he had explicitly stated his status you would've revoked the consent. Consent has terms and he didn't follow the terms, meaning the consent was invalid. I don't have enough English to back this up, but I once read an article that stated that if someone acts as if they are something they are not, in order to get a sexual encounter with a person, it is deception and it is a crime and that encounter can be noted as rape. I don't know if I'm making sense, I hope I am.

Iam a 24 year old woman and I just found u today and I relate souch coz first time I had sex I was 15 and I was infected with HIV I always tell my partners early...... But i must say it has been very hard growing up as a teenager and a young woman having to tell pply status as I have gotten older I have gotten used to everything and iam so proud of my self my family still doesn't know but my friends and partner know and previously what I had seen is men wanna use condoms to protect themselves from HIV but soon as I tell them my status they wanna stop using condoms my current partner we been together for 3 years and for the past 2 years we haven't been using condoms but he tests negative.....but he knows just like all my previous partners.

Mexico november your partner is discordant (infected but not affected)he doesn't have receptors that hiv binds to,if he sleeps with another negative person without a condom can infect them and the person can seroconvert to hiv positive.

About the requirement for consent, I would presume the law would say that, if you are aware of the status but you proceed with the sexual act, that’s when you waive your right, but not when you are not aware and and you proceed with unprotected sexual contact. Further in your case, even if there was consent, it was consent obtained by deception. I believe in some circumstances, consent can be invalidated, especially this circumstance. To determine consent, one must not only look at the act but the risks. And for one to analyze the risks, all facts must be on the table i.e I am consenting to having unprotected sex, which may lead to pregnancy, I am consenting to having unprotected sex which may lead to OTHER STIs, and I am consenting to having unprotected sex which may not lead to HIV infection-based on the knowledge at hand. Your consent is not only for the sexual act, but the consequences. If you are keen on it, I think you may find a way.

In as much as it is every person's responsibility to protect themselves and not assume a negative status, the + person should disclose because the other may be responsible enough to insist on condom usage however condoms break, the question then becomes would the - person have had sex with the confirmed + person even with a condom had they been made aware of the + status of the other? The answer is not likely, but no one will ever know because that option was never presented. The negative person may not even be aware that the condom broke...and there they are assuming safety because they used a condom right ukanti if they knew that condom would be inspected for even the slightest erosion whether there was suspicion of breakage or not.
