I’m in the middle of a EEO now and my case has been selected for early mediation. Now I don’t think I’m going to get $30M let alone $3M. My company legal department has placed me on a “legal hold” and asked to meet with me. Would I be considered “difficult” if I declined.

Yes and no. You know your case better than anyone so it depends. The early mediation may be the company's attempt to find a resolution that will benefit all parties involved in regards to the details within your case, or they may be trying to settle the case depending on if you or your attorney (if you've hired one) has submitted a demand letter or filed a lawsuit.

Even if you are, screw them. They have the upper advantage with at-will employment and they exploit it, so why shouldn't you exploit a situation over them when you can?

Vince, I got my RTS, and my attorney said he's writing up a proposal for the 4 partners, and they have to take a vote. I'm nervous. Should I be looking for another lawyer? It's been 30 days, and I've heard nothing yet.

@MyOtherChannel-zy3tf yes, they've already been representing me and I signed a Retainer Agreement, but in the fine print, the firm reserves the right to decide to represent the case in court. Now I'm worried that they may drop my case.

​@Ooohmy , have you paid them thusfar? Filing and funding a case can get expensive, say $30,000 -$50,000. They may ask you to fund some of this expense upfront. In all actuality you pay all expenses if you win anyways. They may want you to have a risk as well as them.

But so far, they've went to my EEOC meeting and wrote a rebuttal for me and a few calls back/forth. Otherwise, I'm waiting to hear from them and whether the 4 partners agree to taking my case any further is where I am. Makes me nervous.. because I have less than 90 days at this point

Vince you can argue "the formulae" is not based on Federal anti discrimination law. Yes there is a cap of $300,000 under the 1964 Civil Rights Act. But no "formulae" is written by Congress. And there are no caps under section 1981 of the 1866 Civil Rights act. So if a Jury awards 30 million in damages to a complaining party under these statutes then they should get their money!

Plaintiff (employee) gets a legal jury award of 30 million. The plaintiff won. Why is the defendant not required to file an appeal at this point? Why is the burden shifted to the plaintiff when the plaintiff prevailed?

Looks like the judge lowered the award because it was excessive and not actual loss. If this amount was a punitive award, say for retaliation, the judge may not have touched it because the jury has spoken.
