I was about to say, 2nd test chunin exams, students signed a waiver, so Gaara had the right to use excessive force. That includes Lee's first injuries. Yashamaru was self-defense. The goons in the alleyway, self-defense. Dosu, self-defense. His fight with Naruto could also be classified under the rules of war, as it was an active battleground between 3 nations, and Gaara and his siblings were active participants. HOWEVER, property damage from Dosu, yes. And he did murder a drunk right in front of his Dad in a public place shortly before killing Yashamaru, homicide: manslaughter, as it wasn't premeditated. The hospital scene, attempted murder. And he assaulted 6-7 classmates (not sure what that would be, if just a warning, because he didn't intend to hurt them).

The entire theme of naruto is that everyone can be redeemed, and that in order to stop the cycle of hatred, you have to stop seeking revenge, and consequently justice in most cases. The story is about a broken world where everyone is equally traumatized and doing messed up stuff. Punishing would do no good in a shinobi world.

For Orochimaru you forget the 60 child he kidnapped and test with the dna of the first hokage on them. 59 of these child died also. And the desecreation of a head of state he does that 3 times, the fourth was stopped by the third, but you need to have the dna for attempting the technique. Plus the 3 murders of minor for use as vessel for the dna of the 3 dead hokage. So at least 30 years, 1 death, 60 000$ more in sentence.

If orochimaru didn’t do this then Sasuke would have helped against the war and helped madara which would have caused them to 100% lose the war. Without orochimaru the war would have been lost
