An owner of land has rights in the air space above his land only to such a height as is necessary for the ordinary use and enjoyment of his land and the structures upon it. Bernstein had no right to privacy in airspace and accordingly there had been no infringement of Bernstein’s rights in the airspace above his property. " This is the legal framework used by the CAA who control the airspace in the UK.

Why can people not understand the differences between the phrases on their land and over their land and own the airspace and control the airspace. Buildings on industrial estates are rarely owned by the occupier anyway, they're generally rented or on up to 99 year leases so the airspace would be none of their business. It would be the building owner's responsibility. I think Chepstow may be in a bubble where auditing videos haven't reached yet. Do they think drone cameras have huge telephoto lenses that can clearly resolve 8pt. text from 40m above? It's nothing to do with privacy, number plates, private cars, staff safety, client confidentiality, intellectual rights, H&S, fork lift operators and lorry drivers being distracted, etc. The reason they don't want drones or cameras looking at them is either because they need to be in control and feel powerful or to hide things they shouldn't be doing or are ashamed of like filthy areas and dirty fingernails at food processing plants, huge piles of confidential waste at so called secure disposal sites, chemicals running into watercourses or rainwater drains, raw plastic pellets spilt everywhere around plastic forming sites, diesel spillages running onto the public highway, and stolen public rights of way, all of which I've seen on UK auditor videos made within the last 3 months.

It is, I've already written to NASA and the Russians to explain the law as defined in The Little Fat Girl book of big laws pointing out to them that they are obliged to move the ISS's orbit 300 metres to the left in order to avoid Aalco's air space and that under no circumstances are any of the Astronauts to take any photographs, video or make any drawing, sketch of facsimile of Aalco's premises whatsoever as they pass through or near that privately owned airspace. The Russians have already replied with very nice letter saying "Yebat off" - Im just looking it up on Google Translator as we speak and thus far NASA have indicated that I can expect a phone call from A MR Joe Biden with their response anyday now. I await the call with interest.
