International law professor explains ICC warrants for Netanyahu, Hamas leaders

Australian National University International Law Professor Donald Rothwell has explained the International Criminal Court seeking warrants for three leaders of Hamas and Israel’s Prime Minister and Defence Minister.
“I think this was, to a degree, anticipated,” Mr Rothwell told Sky News Australia.
“We know that the International Criminal Court prosecutor Karim Khan had been actively investigating the situation both in Israel, arising from the October 7 Hamas attacks, but also the Israeli response in Gaza.”

Why does the UN have any authority over the leaders of countries? IF a leader does do horrible things then that country should have authority and responsibility to deal with the issue! If another country or institution has an issue with a leader versus a country, then the two parties need to address it as a peace or top. The fact that it is called a court, does not give them responsibility and authority or legitimacy to punish or prosecute anybody. If it was a world war involving multiple countries and institutions/organizations, then it would be up to the world court to oversee the proceedings to verify no violence erupts and to verify facts as a third party. Although another uninvolved third party needs to be also there for each side of the discussions. Unless a war crime has been charged or suspected, in which case, it behooves the country who wins to bring the losing side in for a fair trial by multiple countries and teams of fact finders and legal representation for each member being charged. The members of nations involved and uninvolved nations who have no bias should be selected to be “jury”! The “judge” should actually be a panel of judges one from each country involved and the same number plus one from other nations!

The UN has the authority that the nations of the world give it. The ICC was given authority via the Rome Statute. Israel is not a party to the statute, so like Putin it will merely restrict Netanyahu to countries that are also not parties. Palestine is a party, but the central government is in no position to act against Hamas. You have provided a description about how you want things to be, but not as things are currently.

When ICC issued arrest warrant for Putin you didn't ask those questions and the west was celebrating but now people start doubting the ICC

@@andilemtshe9063 I'll also add that the only "western" not signed on to the ICC is the US, which is also leading the opposition to the indictment of Netanyahu. It is also the case that the apparent support for Israel by the US is primarily due to the influence of the fundamentalist christians and their belief in the "rapture". Can the "west" please start to acknowledge the boat anchor that the US is towards any sort of social progress in the world.

Professor Rothwell said that the question of ICC having jurisdiction in Israeli - Palestine conflict has been reserved affirmatively. I assume that he refers to the decision of ICC Pre-Trial Chamber in 2021. However, Australia - for one, there were six other countries - formally did not recognise it, because Palestine is not a state. That decision stands to this day and is supported by USA among others. Thus, it is appropriate to require that Albanese government stands by our official position. It is not too much to ask.

Hoped for a deeper analysis. If Hamas did not commit terror, then human shields and stealing aid by Hamas would be on Netanyahu and Gallant? The case deserves a deeper comment.

Have a law degree. There is no such thing as “International Law” and there is no Palestine state. Stupid lawyers who take money for wasting time. Go get a real job

There is such a thing as international law, you can find it in any dictionary or encyclopedia. Every law degree will have lectures available on it, and there are multiple text books on the subject. Likewise the Palestine state is also defined and it includes that territory in West Bank and Gaza not claimed by any nation.

@@HaiteLibbies "Only ... if a jurisdiction signs up for it" - that is what International law is. Palestine does have a government. It has a president and a legislative body (Palestinian National Council). The territory that it claims jurisdiction over is not claimed by any other government. It is recognised as a state by 134 nations, and has seats on a number of international bodies, as well as being a signatory to a number of treaties. Is there any property of state that I have missed?

@@chriswatson7965 There is no Palestinian state. Wake up. And as I said there is No International Law. The EU has International Law for states that join. The USSR had International Law as well. There is no such thing as a body of law that governs the globe. Where did you study law?

@@HaiteLibbies I've you the reasons why I and the consensus believe that there is an entity that can be described as a Palestinian state. The least you can do is rebut that argument. You can't no claim that there is no International law when in the previous post you admitted that such a thing existed, you just weren't aware that it has that label. International law is the agreements reached between governing states. It's that simple. I studied law at UQ.
