Yes! I got emails from my supervisor and I sent emails to my supervisor. In the emails, I talked of retaliation and discrimination between myself and the rest of the unit. Those emails are being used for my litigation. The first email I sent to my supervisor about those two topics, she was upset and called out of work 🤷🏾‍♀️ it’s soo important to DOCUMENT and save everything!

If the company is talking settlement but request an nda could that be a time to ask for more money? Or do ndas hold little to none negotiation leverage?

Hi Vince. My question is would an employer more likely settle after seeking advice from outside counsel after a workplace discrimination claim is filed from an employee with the appropriate state agency or EEOC where the attorney sees how the employer responded to a demand letter from the employee's attorney and determined they completely bungled the response and advises to settle rather than give a position statement.
