I hope they end up open sourcing some of the software if not all of it. It should be available to owners to change things like map providers or 4G service providers if they wish to do so especially if the original services for the car stop working. If 4G service stops, i’m curious if you can use your phones hotspot and connect the ocean via WIFI to you phones hotspot and keep the ocean online. Not sure how useful that would even be if tomtom functionality/maps/navigation is removed.

I interviewed a representative of American Lease. He, like many others stated that just like every other car legal to be driven in the US, the software can’t be legally opened sourced. NHTSA would never let it on the road, insurance companies wouldn’t provide coverage, and states wouldn’t allow the vehicle to be registered. It’s not a phone.

Two sorts of programs, software and firmware. Tom Tom will be licenced software. Firmware will be Fisker.

My Nav hasn't been working for over 2 months already. It thinks I am located at home at all times and doesn't register when the car moves elsewhere... Seems to still calculate routes but obviously useless. Fisker hasn't responded to any inquiries about anything of course, so not sure if this is a glitch / software bug or if TomTom had shut down service due to the bankruptcy already!? So now I have a broken door handle (White light strip broke when Valet guy pressed his thumb on there while closing the door), broken brake pedal foot pad (Material just crumbled and fell to the floor one day), broken air vents (One of the recall issues but no parts or service available to fix it) and a big Display that is almost useless without the navigation... Open Recalls, incl the one for that water pump still pending plus Software still at 2.0, no sign of the promised update to 2.1... It's damn near close to a brick

Excuse this simple brit but, Does this mean they continue to pay a " yearly" licence fee to tom tom for every car built? If so how long is the term? I guess this would also apply to any proprietary software inany makes of car?

I think the final implications of this are still uncertain, but it will be up to the Fisker owners association to either make a contract with Tom Tom, or provide an alternate solution, as there is no more contract with Fisker as of September if the motion is passed.

Thanks for the excellent read on the motions submitted to the court, Adam! 🤔 I don’t know if any creditor has superseding rights or can somehow conjure that up. A creditor can ‘push’ the company into liquidation here. Very curious to see how the proceeding works, if they decide upon liquidation as opposed to some exit plan under chap. 11. There are strategies that can serve the continuation of the business, even under a liquidation. Fisker has to extinguish the shares and issue new, that much I know. Perhaps ‘Karma,’ who still build the Karma will enter the proceedings with a stalking horse bid in a liquidation. @@Aslash304 Ok. By liquidation that means the company as we know it goes ‘poof,’ and with it, the shares. Liquidation is another legal proceeding. I’m still in the camp that either administration means reorganization or liquidation means change of control. A change of control means extinguishment of the shares and implies that creditors are paid in full. A third party(a related party) will be obliged to pay what ever the creditors have a claim to, but they get access to the U.S. market PLUS the as-yet undeclared accumulated deficit.
