I want to ask about Novelty. If someone published an online articule for example saying indoor wall mounted aircons should be made with a superellipse shape blow air at a 20,30,40 degree angles for them to nicely warm people in the room. And they go on to show researh data of superellipse shaped arcons warming up rooms at 20,30,40 degree angles. They dont patent anything its just an article. Then you happen to have a similar idea without reading that article and made a proto type but yot idea is a circular shape and you want to file a Utility Patent. Will that idea be concidered NOVEL?

It would be novel if no one has ever used a circular shaped wall mount aircon. However, the tougher question is whether an eliptical shape disclosure would make a circular shape obvious. My gut says yes, BUT if in the prior disclosure for example, if there is language about how "a circular shape will not work..." or teaches against a circular shape, then there may be some opportunity. we should evaluate the disclosure more carefully under confidentiality. Question: if you had an idea to change the material of a household item. The best comparison is how we started making poster board out of a plastic ribbed structure. Could they / did they patent that idea/invention.

Good Morning Mr. Governor: I have an idea concept and love your informational videos. I have been contacted by several inventor companies and signing NDA for info on my idea. I'm really protective of my idea Bec it's not expenses to make but will generate serious income. That being said, I guess I need someone to bring my idea 💡 to life. Should I hire I guess a Designer Engineer to create it. Then a Patent Designer to draw it to submit a fully Engineered & Design drawing of my invention for a pre patent? Hey Wardell. Great questions. You can hire both a designer and a patent attorney at the same time to help you work on your invention. However, my recommendation is to hire a patent attorney to help you research and file for protection on your invention first. Once you are patent pending, then you can (and should) work with a designer to help you get a final market-ready design prior to going to market. Yes, you should work with a business attorney to draft a custom nondisclosure agreement (NDA) to use with any and all third parties (including engineers and designers). That said, if your competitor has a design patent, then the look/aesthetics is more important as to infringement, but if they have a utility patent, then it's all about functionality. For most individuals and businesses that pursue patent protection, the goal is monetary. However, if your goals are more philanthropic, then you can still seek patent protection to assure that another doesn't get a patent on it and prevent access to it. Basically, you can control who may make, use, and sell the invention if you have a patent...even if you're not going to charge a royalty or enforce your rights on certain uses. The choice/power is yours.

I've got to put ideation drawings and instructions utility and information together in a easiest way someone can understand and examine. We need to organize some sort of protection and cover over this information and discretion some how before I can share these mechanical processes with any one but I really need to discuss this or these perpetual generating systems with person's I really need to talk with an individual like yourself in regards to these classification of world class inventions oh Im not in the stage of getting the idea patentented just yet nor can I afford one I guess I need people to invest in these ideas since I can't afford a patent
