Shelf life can always be increased, given that all respective owners are fully compliant with their requirements after they are realized, summed up as to their shelf life, maintenance, transformation and add on proof features that protects the investment. Realization of everything and no losses always as they are also protected by consumer protection, taxes that always makes the "owners" the rulers and makers. Everything are anticipated these days.

Depending on the Master Deed of Restrictions, a condominium corporation can actually be dissolved by the affirmative vote of owners in accordance with the applicable requirements of the law. I think what made you think that unit owners don't have control because of the failure of condo corps which can be attributed to having more investors than unit owners who are residing in a condominium building. Yung mga investors po na bumili ng condo unit pang flipping, pang property leasing o pang park ng cash ay hindi nakaka-attend ng meetings lalo na yung mga investors based abroad. Yung ibang owners, wala talagang paki po. Kaya hindi for the greater good yung nangyayari. May mga condo buildings naman po akong na-encounter na dahil proactive ang unit owners, okay po yung maintenance ng building nila pati mga rules. Nagkaka-isa pa sila na magdecorate ng lobby pag Christmas. Owners lose control if the real estate developer where they bought the condo unit is entrenched in the condominium corporation so scrupulous deeds can perpetuate. "Under maintenance issues ang totoong may voice is yung board of directors sa corp. and yung property manager na naka-assign. I heard that you cannot or almost impossible to be a board member if you are a unit owner. (correct me if I am wrong) " Ngayon ko lang po narinig na impossible maging board member kapag unit owner po. Kasi yung seller (may-ari) na nakilala ko director po siya nung condo nila. The Board of Directors is composed of unit owners who are in good standing in the cond corp (meaning one who complies faithfully with all the duties and obligations) and is elected. Walang election na magaganap po kung hindi nagkaka-election at botohan kasi hindi naman active mga unit owners po. "(This will be obsolete and more likely to be condemned since the building itself won't be up to date with the civil, fire and safety codes.) Ang city engineering and city hall magdedecide sa faith ng building and not 50% of the owners." Ang naalala ko pong sinabi ko ay after inspection and okay pa ang building saka lang mag-dedecide ang owners po. I certainly respect your perception that a condominium building is just a 50-year lease 😊 I just want to reiterate for everyone else who'll read this comment that with advanced construction techniques and good maintenance, a condo will last more than 50 years. Someone from abroad actually commented that he's wondering why buildings that are 100 years old and above are still standing abroad. Well, I think with the new condominium projects especially the high-end ones, it will definitely last more than 50 years since it's built to last until the next generation.

I recently bought a 20 year old condo in Pasay City. After the purchased, I found out that our association dues are being controlled by the developers. I have been requesting them to use the funds for maintenance and repair but I’m being ignored. I think the developers are intentionally keeping the building in poor condition and neglecting to keep the building safe so they can request the building to be demolished after 50 years and get their land back for new construction and new owners. Went to HLURB with proofs but they weren’t helpful. 😡😡

This is saddening to hear. Supposedly, it's the condominium corporation already who sets the association dues. Perhaps, you can round up your neighbors and you can submit to DHSUD as a group so DHSUD will give more attention to it?

@@marcelbernard158 If that failed, the other option is to consult a lawyer who specializes in property laws so that you are aware of your legal options. It can be costly so it's best your neighbors cooperate as well. There is strength in numbers after all.

@@marcelbernard158 It is true that it may take forever but don’t lose hope. I heard from a fellow real estate service practitioner that a condo corporation has won against a real estate developer. They were able to lower their association dues and change rules that restrict their freedom. However, the real estate developer just settled outside of court and signed a non-disclosure agreement so we won’t be able to find published articles about it. By the way, I would like to correct myself. It’s the Securities and Exchange Commission who has jurisdiction over Condo Corp then DHSUD has jurisdiction over homeowner’s association. However, based on the experiences of those who filed a complaint with SEC, they were asked to file a complaint in court. Regarding your question, I honestly don’t know a real estate lawyer since my clients thankfully still don’t need their services yet 🥺 I will try to ask other practitioners if they know someone who has experience regarding this.

My mom owns a condo unit manila, she's been very linient with the dues, pinapaupahan nya ung condo as a source of income and whenever there's a new tenant, she makes sure na bayad lahat and hindi rin pinapayagan ni Condo management na hndi clear ang balance before a new move-in. she also has a broker to look out on the unit. But then suddenly nalaman nalang nya ngayon na she has unsettled dues for 7 years and it went up to more than 100k due to penalty, and did not received any notice about it. any advise pls?

Hi, yes, ang alam ko rin hindi pinapayagan ng condo management na hindi pwedeng mag-move-in kapag hindi nababayaran yung association dues. Minsan pa pnapaalis nila yung resident. May broker pa rin na nagoversee kaya nakakagulat na may unsettled dues siya. I suggest you go to the condo management to verify if it’s really under your account. Baka nagkamali lang yung condo admin at sa ibang unit iyon. You can also show proof of your payments. Usually may receipts naman tuwing nagbabayad or kung online ang payment, may emails 😊

Yes, condo development is a business and since a real estate developer's reputation is on the line, they will deliver a quality development. As for the renovations to enhance the common areas, it's the prerogative of the condominium corporation if they will approve such 😊

Hello po, kung ano ang real rights nung binili niyong property, iyon din po ang real rights niyo. So regardless kung 2nd or 3rd owner na po kayo pero perpetual ownership nung nabili niyo, perpetual ownership pa rin ang condo niyo po. Sa madaling salita po, ang nag-matter ay yung real rights nung panahon na binili niyo po yung condo 😊

Hello po, may question po ako, i hope you'll be able to answer it please. Are condo associations allowed to charge water fees that are way beyond the average fee. Halos Php 100 per cubic meter flat rate. And is there a criteria on how associations come up with condo fee rates? What if the corporation/ unit owners are just a facade, and that there is a company like APMC that actually controls the fees and maybe even profit greatly without properly listening to unit owners during annual meetings?

For your water rate, your location and your floor level plays a factor for the water rate. I still don't have an idea yet on how the associations come up with rates but once I know the answer, I'll get back to you 😊 What I can answer so far is that most condominium buildings hire a third-party management company. However, if the real estate developer has a management company like Ayala, they will hire their management company. And since it is a business, it is unavoidable that they will profit. But then again, even if a third-party management company is hired, they will expect to earn. So it's a matter of having a management company that doesn't charge too much. But it's difficult to tell not unless you have various condominium units from different real estate developers. In my condo now, I'm paying P 110/ sqm and then out of the blue we were required to pay an additional P18/ sqm. It is maddening since they are collecting for the whole year and they just informed us in the middle of the year. But I just paid it since I would rather pay more to a management company who does its job than continue to be charged even if the building and common areas are not properly maintained. There are condominium buildings that are worse.

If we'll be technical, it's supposedly not the same. Dahil po merong mga unit owners na hindi pa nila nababayaran ng buo yung unit, kapag ganyan hindi pa sila shareholder ng Condominium Corporation. So a unit-owner who has paid the full purchase price is the one who is recognized as a shareholder 🙂

Kac kaht na LIVABLE pa ung condo after 50 yrs ay 50 yrs lng ang exitance ng buildng, because of that 50 yrs Rules, WHAT condo in The Philippines EXIST more than 50 yrs???
