I have never heared of you or any other party that is part of this video. At the time of me wathing, this video has 157 views and 10 upvotes. For some reason this video just ended up being on my KZbin home page. Now... when do people finally get it that the internet never forgets and if you try to make it forget, the oppsite happens? Seriously, if that guy didnt try to get this video/mp3 deleted, I probably would have never come across it. Now I will contribute by liking and commenting. The internet never forgets.

Thank you. The Streisand effect and Joel Michael Singer. Joel is a guy who was taken to the ground after headbutting somebody. Joel spent a bunch of money trying to get the video taken off the internet until someone finally made a website joelmichaelsinger.com showing the video dead center. It might be his voice, but the challenge is for him to prove he owns the copyright of the podcast. Check if it's still accessible where you got it from, or if that site has/had any copyright info in regards to the podcasts.

It's not even a podcast. It was a telephone recording of him and Dan Barker in the early 2000s. It was then freely distributed everywhere. There is no where else to get this. It was never for sale because it was the early 2000s before stupid cell phones and ebegging. It'd be like copyrighting a geocities or angelfire website from the 90s/2000s. It's absurd.

Go to that video's settings in your account and dispute the claim. He will have to prove to YT that he owns the content.

I have heard that disputing the claim doesn't really do anything because KZbin pretty much always sides with the alleged copyright holder.

There are some pretty good atheist vs religious debates you can find on youtube. Christopher Hitchens. Dan Barker. Richard Dawkins etc. Well, this one is Dan Barker taking on a random Christian fundamentalist named Jason Gastrich. In mine (and other people's opinion), Dan absolutely destroyed Jason in this debate. It's actually a really entertaining listen for anybody questioning their faith, and I think it's an important piece of history in the context of enlightenment and rational thought seekers on the internet. My suspicion of why he wants it removed is probably because Jason is no longer a believer (his own words), but also because he was beat pretty badly in this audio. It was pretty rare and I wanted people to hear it so I put it on youtube.

It IS copyrighted. You don't need to file to have a copyright. And copyright lasts a lot longer than 21 years. And it doesn't matter how long you've had a copy in your possession. That doesn't transfer ownership of the work itself to you; that's crazy. But I would ask to whom the copyright actually belongs. Just because this Jason guy is in it, doesn't mean he owns it. You need to track down who recorded it and published it, and if it's somebody else, they likely can intervene and claim ownership and get Jason's strike taken down.

I suspect Gastrich regrets taking that beating from Barker. Soon after, he recorded a sort of "do over" where he attempts to answer 30 of Barker's questions in the debate, that he didn't really have much of an answer for at the time.

I will concede this Jason guy is likely a douche, but much of what you shouted out here in anger is irrelevant and just plain wrong in terms of how copyright works, and worse, you're calling out methods of IP theft as if their existence validates your stance, which is a horrible, fallacious argument for an atheist (presumably a rationalist) to take. This work IS copyrighted, since you don't need to file with the government to have copyright over a work. Somebody, somewhere, owns this. PERIOD. Copyright lasts a lot longer than 21 years. And it doesn't matter how long you've had a copy in your possession. That doesn't transfer ownership of the work itself to you; that's crazy. But I would ask to whom the copyright ACTUALLY belongs. Just because this Jason guy is in it, doesn't mean he owns it. You need to track down who recorded it and published it (you said you remember downloading it, but you don't know from where: FIND OUT FROM WHERE), and if it's somebody else who published it, they likely can intervene and claim ownership and get Jason's strike taken down. Until you do, KZbin's Terms of Service allow Jason to be a douche. And screaming about how people trade files on the internet regardless of copyright law, is not going to move KZbin one iota. The best you can hope for in the meantime, is to claim fair use, and you need to follow those guidelines to do so.

I think only the owner of the copyright can file under the DMCA. If Gastrich owns it, then he can file for it's removal. It doesn't matter if he's in it, he or his agent must have recorded it. You can then critique the audio and upload it in your own video and claim fair use as long as you follow the guidelines.

If jeremy here grows a pair and hops in my voice chat with me, and we both record it, and we both put it on our youtube channels, can we both copyright strike each other? Who owns it then? Come ON. That's pretty much what happened with the Gastrich/Barker interview. There were TWO people in it and it was recorded intentionally to disseminate freely on the internet - not to make a profit and certainly not to try to remove its existence 21 years later. If that's the case, youtube might as well not exist since we can just copyright everything we ever uploaded. Get REAL. It's insanity to think that way.
