I’m not saying it’s implausible that Cash wasn’t driving like a moron, but I’m saying Jim’s explanation of “Well maybe the guy recognized him, he’s a famous pro wrestler,” is highly unlikely. And if Cash did pass him on the right like that, why would he slow down to drive next to him and flash a gun? Whole lot of questions and not many answers. All that said, I agree with Brian that he will walk. Even if he did flash a gun, it’s all he said, he said. No proof and a few holes in the story.

Yep. I was passing a bus and saw a guy speeding up behind me like a mad man, so I tried to get out of his way. He was actually going to take the upcoming exit, and he tried to cut into the inside lane and overtake me as I was also pulling into the inside lane to let him pass. Yes, civilly, that's correct. However, each state is a little different with their criminal laws of the two. Simple assault usually means you struck someone once. Aggravated assault is you kept kicking them (but varies wildly). And not all states have aggravated assault w a firearm or deadly weapon. Many states leap to aggravated battery. The difference with battery is usually, in practice, the degree of injuries. Then you have battery, an aggravated battery and in some states, what should be considered simple battery. A gun crime is usually aggravated battery with a firearm, e.g. if you threaten to shoot someone, point a gun at them and pistol whip them. Some states do assault with a deadly weapon and the law on knives varies wildly. Some up it to aggravated but omit the with a deadly weapon part. It's very strange, in reality.

Here's what happened: Cash was driving like an asshole, guy sees it, moves over to the right so Cash can pass on the left (which is the law), but Cash goes right and then passes on the right into the breakdown lane. Then he either gives the guy the finger or flashes a gun. Unfortunately, we won't get any information other than what his lawyer says (which is very smart). Either way, Cash was wrong in this situation, and I can only hope that the guy mistook the finger for a gun.
