No, I don't buy it. I think the defendant is telling the truth, and whatever the state of his insurance was, he did not hit that bike. They are two separate issues that, if the defendant had held his tongue better, could have proven. He still would have had to pay because of the insurance lapse, but he really wasn't at fault other than that.

Those are indeed not scratches from a push from a plastic bumper, but clearly scratches from a slip and slide he made prior to all of this. I drove a motorcycle for a long time, and I had my share of slips and falls, and those deep upwards scratches - and their position - are very consistent with a short slide on concrete. Furthermore, in order to make that kinda deep scratches on a bike with a car bumper the bike would at least have tipped over and would have damaged the other side too, trust me. But no pictures of a tipped over bike at all (which everyone would make when something like happens to their motorcycle) nor claim of damage on that side. The plaintiff even had an eyewitness from next door that - when the plaintiff left the scene to work inside the house of his client - clearly saw the dude park his motorcycle against the bumper to take pictures of it, as if the plaintiff had hit it. These people scammed him to pay for damages that he didn't even make, taking advantage of his temper. If only he had shut his mouth maybe JF would have considered listening to his side of the story and have a look at his insurance papers (which seemed legal, otherwise he wouldn't be frantically waving them around). Oh and the wife, with her crocodile tears, claiming he constantly shows up to harass and bully them: I call it BS too, she's clearly playing the drama queen to get JF's sympathy. The man is a contractor, working across the street, so it's logical that they will see him and his van a lot. My instinct tells me that THEY are the ones constantly harassing HIM, not the other way around, trying to make him pay for damages he didn't do.

The defendant was out of line and his lapse of insurance caused him to lose this case. But I believed him. The damage looks like road rash and he had a valid rebuttal...but his mouth and temper got the best of him. It's unfortunate his loud mouth and minor language barrier made him so worked up that it came across as disrespectful. I don't think this trial was fair. The guy hardly speaks proper English and the couple used that to their advantage and played the role of the victims. The defendant was angry and his action and behavior is his frustration and the Judge too blind to see this. She had the time to call his insurance company but why didn't she call a motorcycle mechanic/expert to explain the marks on the bike? This case has prejudice written all over it ! and it may even be deeper!

The time faith spent fighting to talk over him to tell him to be quiet could've been spent with him explaining his side, but no, he had to try to run the show despite constant reminders that it doesn't work that way in court. That shows very little emotional maturity, made him look very controlling, aggressive, and straight up childish. The way he handled himself it's hard to believe he wouldn't do something as petty as hitting a bike with his van.

I’ve watched a number of Judge Faith’s sessions, and although she is the honorable judge and it is ‘her court’, the cases are also recorded for entertainment purposes. Contrary to similar judges, the way she takes exception to any disorder seem to create bias in her so that her rulings favor those who rile her up the least.
