There can be positive or negative repercussions following someone’s speech, but there are always consequences. It’s usually those who have not taken the time to actually read the constitution and it’s amendments in it’s entirety, but recite parts that they have heard from others and use it as a form of rhetoric to get away with whatever nonsense they have done. Defense is technically right. Our judges cannot teeter with the constitution and determine with a fine scope what is and isn't free speech protected by the 1st Amend. A state circuit court should have no say on what is and isn't free speech. We have politicians trying to wiggle around the edges and jump through loopholes in our constitution on a daily basis.

I remember being in Lynnwood about two years ago near the H-mart and this woman was lying down next to a peice of cardboard, homeless.I felt bad for her and took her inside Red Robin to eat with me and when we sat down she started screaming the N word toward a nearby family. Of course they got upset and I took the heat for her . I am GLAD that this part of The United States history is coming out and being held accountable. It just goes to show me how blind I was growing up out here as a child with all of the compartmentalization that gets indirectly injected into others. It may... Or it may not. There is significant evidence that racial, sexual and persistent harassment is in fact quantifiably damaging. This may lead to a serious change in free speech defense moving forward. The number of studies done by both therapists and sociologists has left a pretty concrete trail for this sort of amendment as one can already not use speech that endangers others. So the precedent is ready there.

The first amendment does protect this type of speech. There are no such exceptions for "fighting words" or "racist rants" or obscenity. These are exactly the types of speech protected by the first amendment. There is no such thing as hate speech in our country. If RI has such a law it is unconstitutional.
