Wholesaling may not be a scam....but the way Vlad operates most definitely is. Before the plaintiff's 30 days were up, he told him he had another buyer and cancelled the transaction. If you pause the video and read the letter he sent, it said plaintiff would get his deposit back AFTER the new owner's close on the property. BUT, there was no new owner or sale of property and he kept plaintiff's $5000.

Not necessarily a scammer. The defendant likely signed something with the owner giving the defendant the right to buy the house, or to sell that right to someone else. The owner could not sell to anyone else during that period. The house was never on the market as such. The problem might have been that the plaintiff did not have the intelligence/clarity of thought to understand they were buying the right to buy the house as opposed to buying the house. (Part of the problem anyway.) It is similar to a stock option. Buying the right to buy something at a fixed price within a certain time frame.

@@KittyJacque_ you can buy the rights to buy a house that was not for sale/not on the market. Being on the market has little to do with it. Being on the market just means the owner has public ally stated they want to sell the house and are taking steps to find a buyer. You could walk up to any house that is not on the market, make the owner an offer, and if they accept the offer the house is sold. (Or in the process of being sold, anyway.)

Judge was so smart that she suspected it was a scam at the begining of part I, and when the defendant said that the house was never listed actually, it was all over. Judge called it out and I wonder who many people he did that to.

Yeah but that happens a LOT & not as a scam. Have you ever seen the "We buy ugly houses!" signs? The scam HERE, in essence, the guy that held the contract probably got a higher offer for the contract and tried to screw the plaintiff with a BS reason of 'your financing is taking too long.' "Mr. Vincent" probably had a house in rough shape, someone found out he was considering selling the house, so before it could go on the market he got an offer. People will do that... see a rough house, find out information about it via public record, and make an offer on it. Usually they'll be backed and can close the deal upon sale to the new buyer I believe. What's weird about Vlad however is how he's handling the down-payments and what's troubling is reneging on agreed upon contracts. Fun fact though - there are properties that get sold without hitting the market. Happens a lot, especially with rough properties. From a selfish perspective if you can find out about it early, that prevents other contractors from competing to bid/own the property. But wholesalers like this... just getting the contract... that happens quite a bit. "Oh, we're so sorry for your loss..." if a parent died... "We can help with the sale of the asset..." Sketchy, creepy... yes. But it is what it is.

The scam here is not to give him the 5000 but to wait for new owners when there is no actual plan to get new owners. The problem here is not that he didn't get to buy the house but that they cancelled and wanted to keep his 5000.

This defendant said he was selling a house he had the rights to from the owner and the plaintiff said "The housing market is HOT, I want to buy the rights to sell this house and i'll give you $5,000 for it and my partner will give you another $5,000". The defendant said OK, but the house was never on the market and after 20 days, the defendant said "It's taking you too long to give me the whole $10,000, so i'm giving the rights to somebody else and i'll give you your money back" but in the contract it said he wouldn't get his $5,000 back until the house was officially sold...well the house was never on the market, so it was never going to sell lol

Not necessarily. If plaintiff thought he could put $100k renovation into it and sell for $250k, he’s paying $85k ($75k purchase plus $10k finders fee) to potentially make $65k after his expenses. And seller is quickly getting out of a house he doesn’t want.

Bingo. The fight is for the right to sell the property because the guy may not be in the business of flipping the house. Because if a fixer upper is 'on the market' guess what? More eyeballs see it and more contractors may bid on it so your margin with the flip shrinks and it's not a worthwhile investment. 10k for the rights, you have to take care of the financing of the 75k, and secure the loan to fix up the property which you would HOPE to flip for a decent enough profit. If it sold on the market for say 125k, your net is significantly lower.

Many wholesale deals (or contract assignments) never hit the market. Defendant had signage around town saying we buy houses, he gets the rights to purchase after interested party reaches out and agrees. He in turn sells his right to the home and implies a 30 day payment stipulation.

This is called wholesaling. You get a house under contract then re-assign the contract to a buyer for a fee. It is a legit business, even though there are shady people out there. It is usually don't with houses that are in need of major repairs, wouldn't qualify for a mortgage, and are sold to investors for cash.

This home wholesaler was not legit, or honest. He was just making a shady deal with someone completely unfamiliar with the process. He charged him large fee, then cheated him out of a deserved refund when "the house just would not sell", because the owner was in business with the defendant Mr. Fedarov. The owner never put the house on the market, judge Judy got it right.

It’s very simple and actually quite common. He finds undervalued houses for sale, negotiates a price with the owner and then offers someone a chance to purchase it plus a $5,000 ‘finders fee.’ If that person backs out or cannot secure the financing to buy the house. He reserves the right to keep the fee and offer it to someone else. His mistake is his legal paperwork/contracts aren’t in order and he should be finding higher quality preferably cash buyers.

It is completely possible to buy a house that isn't on the market - that's how I bought mine, completely and totally legitimately. A friend of the family was thinking about selling and heard that I was looking to buy. She invited me over, I liked the house and she sold it to me, never putting it officially "on the market". I'm still living here, years later. It's actually a fairly common way to sell real estate in this neighborhood as both the buyer and seller can come out ahead by not paying real estate agent buyers and sellers fees. We opted to pay a real estate agent a fixed price to handle the paperwork and everybody was happy.

PS the defendant / scam artist didn't would not have spent a dime out of his own pocket. In real-estate you don't pay a cent until financing is in place, and the property closes. For instance I just bought a property, the offer was accepted, papers were signed, subjects were removed Dec 20th 2023. The current owners are moving out Feb 29, on that day I take possession and I pay the cash. The real estate agent takes $1,000.00 deposit after the offer is accepted, and papers are signed. That is it. My crews go in March 01 to do renovations.

I see what the defendant tried to do, but I think he went about it all wrong. In those deals all of his profit should come from escrow or at closing. It shouldn't be upfront payments in case the deal doesn't work out, like it didn't here.

You remind me of what my sister told me recently. The hot water pressure was extremely low in her house. She spoke to different plumbers and told them what the problem was. She was given quotes of $2000 plus. She had some work done on her house and asked the handyman if he knew anything about it the pressure issue. He did a Google search for the problem and found out how to fix it on KZbin. The only thing needed to fix the problem was a part that was about $20. Since he had other work he was doing for her, he charged her less than $200 to fix the pressure problem plus whatever else he was working on. And she has had no problems since. The plumbers gave her a quote saying that the pipes needed to be replaced which was not true. Some of these people try to rip off homeowners all the time

last one.😁 She is right it is a full on scam. However, the owner of the house may not even know. I received an offer to sell me a house, the people were on vacation supposedly, and decided to move to the vacation area permanently and retire. I was invited to go look at it. I did, little run down, the key was not where they said it would be. As we were going back and forth he said his lawyer would mail me a key, then started asking for money for a deposit, I played along. I checked the house a couple times in the next week. Then that weekend I found an man home probably about 65. I informed him someone was trying to sell his house, he of course was shocked. I forwarded him the emails to take to the police.

Two things: 1) If the defendant "didn't do anything wrong" as he said at the end then why doesn't he return the $5k deposit back to the plaintiff since he cancel the deal and/or the house didn't sell? 2) The plaintiff needs to be quite at the end because he knew nothing; otherwise he wouldn't have fell for the scam and needing to sue him. If he was truly trying to get into the house flipping business as well, he would've also have his own lawyer in the process. Any knowledgable real estate attorney would have put a clause in the contract to put all money in an escrow and not a personal check to a middle person, and another clause to return the funds back to the plaintiff immediately if the deal is cancelled. As another person have commented, the paper that the plaintiff submitted to JJ states that the plaintiff will only get his money back if there's a new owner which in this case there wasn't any since it never sold.

If the defendant really said to him there is another buyer and back off this deal with him, plaintiff have request the defendant to write an email or a written letter about it. Not just on the phone. That's bs.

Also disagree. You sell to a private investor for a variety of reasons. Examples: need quick sale to avoid damaging credit from missed payments, bad condition house that no primary owners want to buy, no fix up costs, no commission to pay, etc. not always a scam.

Have done 3 properties and each one increased the value of the surrounding properties - much to those home-owners delight. Push comes to shove, if you own the property you can always say - get this - NO.

Judge Judy correctly identified a very likely scam, but probably not in the way she is thinking. Wholesaling is actually legal, but the way in which the defendant set up the deal is very scammy. He split the sale between two buyers for 5k each. He wasn't in cahoots with the seller, but most probably with the second buyer who never intended to pay the 5k and flip the house. He was basically just a decoy so that after 20 days the defendant could claim that the funding takes too long and that they have already found a more suitable buyer. Instead, he told the seller that the buyers didn't pay and the deal was off. In the end he got the 5k from the plaintiff and the seller remained whole.

If that is the case, then why has the house owner still not sold or put his house back on the market to this day? Defendant said the owner(Vincent) wanted to sell the house, found the defendants advertisement and reached out to him to sell it. So you are saying Vincent isnt part of it even though this innocent owner not only didnt sell to the plantiff but also didnt sell to the 2nd buyer. Vincent is part of the scam

Ok this sounds very scammy, so lemme get this straight the defendant had a deal with the owner to buy the house. The defendant then sold this deal to the plaintiff for $10k. However the plaintiff was taking too long to buy the house and the owner got another offer. This would have canceled the defendant’s original deal so he let the plaintiff off in order to sell the deal to someone else? Why not just buy the house directly from the owner? Why not just pay commission to a trusted realtor to make a deal for you? Why buy a deal someone else made? Sounds like one massive scam, as it so often is with middlemen.
