A mother-of-three has been jailed for more than two years for inducing an abortion after the legal limit.
44-year-old Carla Foster received the medication following a remote consultation where she was not honest about how far along her pregnancy was.
Julia Hartley-Brewer is shocked by campaigner Janey Starling who calls for late abortions to be decriminalised.
Janey: “Abortion is healthcare.”
Julia: “Are you saying you don’t think it should be a criminal act when I was 8 months pregnant to abort my child?”

Why? Women still don't necessarily know they're pregnant until a certain point. It can also take time to identify things like fatal foetal abnormalities. In some cases, where, for example, the child has a fatal condition that would be painful, women choose to abort out of compassion, so that their child experiences as little pain as possible.

@River Girl In fairness to the original comment, that person was simply referring to abortion laws, not incidents involving violent men. I do not know of any cases where a man who has kicked an unborn baby to death had received a slap on the wrist, but if it happens it is both shameful and disgusting.

bcoxal Yes because it is the woman's body and it is she who has to go through 40 weeks of misery (if she doesn't want the pregnancy) followed by possibly hours of pain and, depending on the birth and her age and health, possible long-term effects. better to get rid of "trash" you don't care for than knock out a sprog and ill-treat it. Ill-treatment is not necessarily depriving it of food and material items it can come in the form of denying it love and attention, telling it that it wasn't wanted, and making it feel that it is a worthless inconvenience and thoroughly disappointing.

The thing about a late abortion is that the woman has to deliver the baby anyway so better to deliver the child. She killed this child because it represented an inconvenience. There is an agreed limit. Everyone knows the limit. At some point the child rights have to kick in. It wasn't a desperate situation, the judge was right.

Obviously not in your pink fluffy bunny world but that is why so many adopted people seek out their birth mothers in adulthood and why so many are left feeling even more rejected when mummy dearest tells them to piss off because she has moved on with life. Should there ever be collective agreement over what happens to someone else's body? What about bodily sovereignty? For example, should the man that impregnates the woman be forced to donate a kidney if the child later needs a kidney transplant to survive? What about organ donation after death - should that be mandated (so the existing opt out abolished)? Should life saving blood donation, kidney donation etc be mandated to save lives (including the lives of new born babies). Should people be forced to have vaccinations or other medical procedures that are deemed to be for 'the greater good' (to save others)? Why are we singling out pregnant women and taking away their bodily autonomy? Why does the state or society get to decide what 'the limit' is in this situation, but not over life saving organ donation, vaccines etc? The point I am trying to make is that the arguments aren't logical and consistent. If it's about saving the lives of babies then there are lots of other things that can be mandated to save thousands of innocent babies, but we don't do it because we supposedly believe in bodily autonomy. No if's and not buts the individual decides what happens to their body.

@@paulroberts7544 . Usually, I refuse to debate female-centred issues with a male but you raise an excellent point. I do not believe that anyone should have any say over another person's body or their freedom of choice in personal medical procedures of any sort where that person is able to make their own rational decision. The trouble is you have these bigots who have nothing better to do than try interfering in other people's lives without any knowledge of that person. If you dictated that after knocking out sprog number 2 both parents had to be sterilised to help reduce the human population, can you imagine the uproar? These "little dictators" would be the first to cry foul. Many live under the illusion that the minute little unwanted sprog appears, all women will immediately melt and fall in love with it - not true! Their solution is to put it up for adoption as if that is the panacea of all ills which of course it is not. Rejection can create many issues for the child in adulthood and foisted off onto someone who will have is indeed a rejection!

At 8 months pregnant, a child can be born prematurely and survive. She should have been convicted of murder and given 25 years. Yet again, the law is different for women compared to men, why do we hold women at a lower level of responsibility than men? You can bet your life that if a man kicked a 8 month pregnant woman in the stomach and she lost the baby, he would not see daylight again.

Men can’t have abortions so I don’t see how you can compare men to women in this instance. There’s been loads of men who have beaten pregnant women and have received minute sentences for causing the woman to miscarry, if it’s acknowledged at all in sentencing. You just sound like you hate women.

No Abortion here in California is the same as the UK: abortion is allowed up until point of viability (24 weeks). Unfortunately tho similar to the UK, we have a lot of pro-choicers trying to get it raised to up until birth.

If you don't realise you don't want to be pregnant for 24 weeks then you missed your chance. Frankly 6 months of being happy with the situation. I was born at about 33 weeks, that's only 9 weeks after this and over a month BEFORE the age of her unborn child. It was a fully formed human being and she killed it. This woman has clearly never given birth and held her own baby in her arms. Nobody who has loved a child (or anyone who isn't a sociopath) could say that it is OK to kill a child 5 minutes before it would be born.

My son too. She had many, many choices prior to this final one. She wasn't a child, far from it. She should face repercussions for her actions. I don't buy the whole 'A mother shouldn't be sent to prison for the sake of the other children' - that's literally a get out jail card for any woman who has a child to do what she wants and it's wrong. Not all mothers are good ones.

They actually need input from a male so it isn't just the mothers who should receive ALL the blame for terrible situations like this. And there are men who are happy for these unwanted pregnancies to be terminated while the women seem to take all the blame. There is also a hell of a lot more to being a parent than just sending a cheque in the mail. I understand what you are saying though and I guess in this particular case we don't know how the father felt or if he even knew that the mother intended to kill his unborn baby. All I'm saying is, it's not ok for men to simply spray and walk away. Women need to take responsibility for their eggs and men responsibility for their sperm because whether you like it or not the woman you are impregnating might not want to continue with the pregnancy and as you pointed out, rightly or wrongly she has the legal right to terminate without your input.

I think it is the sign of a great interviewer and journalist that Julia Hartley-Brewer, herself pro-choice, pressed that hard regarding the morality of a late-term abortion. I believe that any point after fertilization and the emergence of unique DNA is an arbitrary point at which to start defending an unborn life but late-term abortions are particularly cruel given the baby's undeniable capacity to feel pain.

The "pro choice" group is under a VERY large umbrella (a lot larger than the "pro life" group, that is, factually, more ideologically driven, and thus more focused and "monolithic") So is completely reasonable that an intelligent person who holds SOME, moderate, "pro choice" ideas goes against another that, even if techincally under the same umbrella, has more radical and unsustainable ideas on the matter, than him. I am not surprised at all...I would do the exact same thing actually...

My eldest daughter was premature and delivered at 35 weeks. She was 5.5 lbs and 20" long. She had RDS and spent some time in an incubator. Apart from that she was perfect. She will be 42 at the end of the month and is the mother of a 10-year old herself. The idea that someone thinks it's ok to murder - because that's what it is; she deliberately deceived a nurse to get the meds to destroy her daughter - a fully formed child and not pay any consequences for it is shocking! There's not enough accountability these days but far too much sense of entitlement. Too many people have the "Oh well" attitude; she deceived both the men she was involved with she's failed her children and she's destroyed a baby's life because she's thoroughly dishonest with herself as well as everyone around her. She's left a trail of destruction in her wake - and all because she couldn't make up her mind! She's not just a disgrace to herself and family but she's done a disservice to every woman if childbearing age now and in the future because her selfishness just gives another string to the bow of people who want to see abortion rescinded because if women aren't going to follow the law then the law will have to change to protect the unborn and that will have dire consequences for everyone!

My first baby was born at eight months. Apparently it is more dangerous than seven moths. He was sooo tiny and sooo precious to us especially when he had four respiratory infections in his first seven months of life. He turn’s forty seven this year and is still precious. I will never understand anyone aborting a gift from God!

Of course there will be circumstances where a developing baby inside a woman will not feel good to them. You seem to be detached from human understanding or empathy. You think a woman who falls pregnant after rape will feel good about feeling a rapist’s baby growing inside them? Or a victim of incest? Or a woman who is in a marriage where her husband is beating her every morning noon and night? Many women feel terrified of that sensation. All of this is not an excuse to flout the law and do as she did. The judge was right to punish her.

I have never liked tiny babies, I hated being pregnant (it was an accident) I was a fitness addict and my body was ripped but the birth had complications and compromised my lower back with which I still suffer. When a limb appeared it made me feel physically ill knowing that this thing was growing inside me and leeching off me. The pregnancy, the birth, and then being lumbered with a mewling little rat was the worst time of my life.

Can anyone explain to me why the location of a baby (whether inside or outside the womb) is the detemining factor as to whether he/she has a right to life? Even Julia Hartley-Brewer, with whom I normally agree, said she doesn't feel the woman should be in prison. But if the baby had been killed on the outside of the womb she would most certainly have a different view. If anyone can help me see the logic here please enlighten me, because I am at a complete loss right now.

Two of my nieces were born within their seventh month gestation another in the early eighth. They were fully formed babies. Small and quite frail, but babies. They are now stunning young women. This girl seems very cosseted.

This was premeditated murder and I would have locked that woman up for much longer. She had to give birth to that baby anyway so why did she feel that murder was the answer ? This I think is the main fundamantal issue with the pro-choice movement: as the movement props up women's rights, it has came at the cost of empathy towards babies. Where an unborn baby at least 6 months into a pregnacy is traditionally seen as a living and breathing human being, the pro-choice movement is trying to (willingly or unwillingly) change that and make us see a baby at the cusp of being born as just a cluster of cells (only it has a face). Where a baby kicking inside a mother's womb is traditionally seen as a beautiful sign of a new life about to be born, the pro-choice movement is trying (intentionally or unintentionally) to make it a mere nuciance and burden to women.

I very much agree with you. I think we can debate, as a society, for exactly how long it makes sense to permit abortions. And if there should be exceptions, with whatever deadline we've set. But there has to be a limit! It certainly can't be allowed in the 8th or 9th month! This woman sounds like she's just reciting mantras, without having taken in the consequence of what she is saying. I see myself as a feminist, too. Which is part of why I think abortion rights are important. But.. not to the point where we are talking about a viable, almost fully grown baby! The extremists on BOTH side of this issue get it wrong! It is not: "it's either a baby IMMEDIATELY, or it's an insignificant fetus RIGHT up until the moment it leaves the womb." It is a lump of cells, that becomes a fetus, that gradually, over time, becomes a baby! And there is no ONE set moment where that happens! Which is exactly what makes this issue so tricky! But.. leave it to both religious conservatives AND utter lunatics without a conscience, such as this woman, not to get that! Aborting a fully viable baby in the 8th month..? Is indeed MURDER! Strictly limited abortion should be permissible on defined health grounds, of the unborn infant and the mother in a the short time permitted now.
