Nothing the Dunns said matters that much. The standard in this case is that (a) Waid interfered with an existing business relationship and (b) Zack suffered economic damage as a result. Waid interfered with the contract when he made the call into the publisher. The business relationship was terminated after the call so its difficult to say that it didn't have an effect. In his comments, Waid is crowing about "proving" that he did not take positive action to stop the book from being published in the sense of physically stopping it from being published. But the issue here is "interference" in the business relationship. And the evidence from the deposition of Waid himself overwhelmingly shows that he did interfere. Waid also doesn't understand what a contract is and seems to suggest that only formal written contracts are covered by tortous interference. He is wrong on that as well.

@@Ashkihyena Not in the way you think. The consequence of appearing to lie in a case like this is that the jury will eventually see it. In a civil case, credibility of witnesses is everything. If witnesses appear dishonest or evasive or (worse) appears to be lying, the jury will pick that up and draw the opposite conclusion to what the witness has said. If the jury concludes that someone is a liar, they will not listen to another word they say.

Waid's comments are simply foolish. He isn't an attorney and by his comments, he does not understand the legal issues involved in the case. In particular, he does not seem to understand what he has been accused of and he does not understand what a contract is. Its beyond foolish for anyone directly involved in a case to start making public comments about the legal issues of the case. Its foolish to make the comments because anything said can be used against you in the legal process. One of the reasons for hiring an attorney is that they can speak for the person rather than the person running the legal risks of speaking themselves. A good attorney would have told their client that at the start and a good attorney would have done everything possible to convince Mark Waid NOT to write public comments touching on his case and legal issues in his case.

The problem for Dunn isn't really perjury. The problem for him is that he will eventually have to explain on the witness stand in the case at trial how what he said in the deposition is consistent with that conversation. In a civil case, the credibility of witnesses is everything. If the jury thinks you are dishonest, they will either ignore everything you have to say or make a conclusion exactly opposite from what you said. The way a civil lawsuit works is that you take depositions to give people a chance to tell the truth. When you get to trial, what happens is that they get confronted with the differences between what they have said and the facts. The problem isn't that the Dunns have lied. The problem for Mark Waid is that the Dunns have so compromised themselves by conflicting statements that they will not be useful or credible witnesses for him in the case.

It's possible that Dunn simply understood the question to be more literal. It's not like Waid showed up in person and smashed the hard drive with the Jawbreakers print file on it with a baseball bat, stole all their paper, and burned down their printing press, thus physically preventing them from publishing the book. I'm being ridiculous in my example here for the sake of illustrating the point. The question Dunn was asked, as worded and in context, could reasonably be interpreted as having meant more than simply whether or not Waid had merely called them up and aggressively pressured them, especially if Waid's exact words in that phone call were only implicitly coercive. Dunn's one-word answer might have meant, "Well, no, he didn't 'prevent' us from publishing it, not exactly." There was no follow up question, and so we just don't know yet. But, of course, neither does Waid.

I just think he's supposed to be the twitter hype lawyer, drumming up zingers to Make Waid's cause look righteous, and it just isn't working. He's no Rekieta Law.

That's why the want the case to be tried in California. They're hoping that it would fly in those courts.

Update on this case: [Feb 12, 2020] Waid's lawyers extended the deadline for TCPA (In other words, stall for time for a motion that might dismiss the case if they can scramble together any evidence, but most likely used to buy time) [Feb 14, 2020] Waid's lawyers gave the answer to the amended complaint which basically reads like this: 1. Errr I dunno, so I don't think I did that 2. Well, yea, I did that 3. I don't think you have jurisdiction over me to judge me! 4. Um, I don't wanna do this in this court 5. The books speak for themseeeeelves so ooooobviously I had to do what I did 6 - 11. I dunno!!! etc. [Feb 18, 2020] Waid's lawyers extended the deadline to file TCPA again. It was granted, however it obviously didn't pan out for them because... [Apr 24, 2020] A non-consent to ADR was filed (Alternate Dispute Resolution = settlement out of court) which means Meyers said NOPE you're getting the full brunt of this lawsuit.
