The fact that Beata grew up in a communist country and came to the USA for a better life makes this so much more devastating. Bless this family lord Jesus, and hold those so called drs accountable for their cruel actions. What that hospital did is inexcusable.

This young man was impressive. Polite, absolutely compelling testimony with the dignity of someone far beyond his age. It made you realize that Maya Kowalski wasn't the only child victim in this case. Kyle was so young to have these things happening and to see that his parents (who are supposed to be your protectors) had no power no matter how hard they tried. This hospital took these children's innocence away. They desroyed their trust. I hope they get everything they're asking for and this system gets a clue. Frankly, I don't know why it isn't a criminal trial.

It happens to vulnerable adults too. I am going through something similar in Florida. It's unbelievable how hard it is to get help once DCF is involved. Government, healthcare and judicial systems grossly violated our rights and destroyed our lives. It has been 5 months since I saw my disabled mother after DCF unlawfully took custody and revoked my DPOA. They are denying her visitors and calls. That is abuse. Cruel and inhumane THIS NEEDS TO STOP! I hope they win BIG and policies change so this never happens to anyone. It is a nightmare.

This family deserves justice!!! Dr. Sally Smith led the removal of Maya from her loving family’s care and home along with DCF. The staff and all involved need to be held accountable!! Look at all the children like the Franke children who remained in the care of their abusive family even after countless reports from other family members and neighbors.. what a disgrace it was and still is that the Kowalski family are going through due to not only incompetence but what appeared to be utter cruelty. Those in charge had an agenda. Since Smith is off the hook unfairly, this is the family’s last chance for not only their family, but all the families whose lives were negatively affected, to say the least, after being wrongly jailed and losing custody of their own children. If you haven’t watched Take Care of Maya, watch it.

I just watched this on Netflix last night and I couldn’t believe the cruelty this family was treated with - from doctors, nurses, judges - I wanted to reach into the TV and throttle them, denying them a hug 😞 Johns Hopkins better PAY and pay through the nose. The mom raising them well is evident in those kids - their only crime is their daughter having a difficult health matter 😢

They wouldn't even let her Priest pray with her when he visited or her Aunt leave a religious symbol. I don't get that, especially when hospitals have pastors on staff. That's taking away religious freedom.

I can't believe how clueless and cruel the staff was. Testing Maya's mobility by ignoring her request for the bathroom to the point that she soiled herself - and touching her when touch stimuli is painful, I think that qualifies as battery. Every penny should be paid out by the hospital; too bad this is civil and not criminal, because her treatment does seem criminal. I believe that the doctor settled previously.

Never take your children or loved ones to that hospital. What in the world did they do!!!! So distraught after watching the Netflix show about this disaterous mess. I Do understand the hospital being concerned about the Ketamine doses as it is used on the streets apparently but why didn't they sit down in a room and discuss every detail with the parents as to WHY she was taking it. How was the Mom blamed for giving meds that Doctors prescribed?? Its so ridiculous. Maya improved dramatically for I think a year after her ketamine coma treatment! To blame the parents is so terrifying because they had control over them having custody of Maya. That worker that was assigned to Maya at the hospital was HORRID in the documentary on Netflix. I wouldn't let her look after a dog. The worker that started all this looks LIKE A COMPLETE WITCH. Like Im not joking. She had no feelings. How do these kinds of people have jobs like that. The txt messages between the doctors about Maya faking it and how COLD and CRUEL they were when Beata committed suicide was horrendous. They should lose their licenses. They have no compassion or accountability for What THEY DID. I hope this family gets lots of money and prevents this hell hole of a hospital from doing it to more people. There's more than just this family the hospital has destroyed. I will be watching to see how this ends!

As an RN of 26 yrs, and a CRPS sufferer, there is something wrong with this case. Yes, we have hypersensitivity to touch (even a light breeze can be torture), limited mobility due to "babying" the affected area, and severe pain in general. However, she didn't walk at all. CRPS tends to affect one side at the site of the injury. She then somehow lost control of her upper arms. Then, she suffered a backslide when she had emotional problems due to school. This leads me to believe that the doctors weren't wrong with their thinking that she may have been embellishing some of her symptoms for attention. The fact that she has now regained full use of her ability to walk and use her arms, furthers that line of thought. Ketamine was recommended to me as a treatment for my case, but it was determined to not be worth the cost. It only works for a few months. Then, you need more. The fact that the mother was asking for a specific amount of ketamine will always set off alarm bells. I have been on many pain meds (I still take several) for years. I know what works and what doesn't, and I have a pain specialist. If I switch to another one because the one I have retires, and I tell them what I need to take, I guarantee you I will get a side eye from them. When people casually name off drugs and doses, they are viewed through the lens of abusers, then chronic pain sufferer. Unfortunately, because of DEA regulations, they have to cover their backsides as doctors when prescribing narcotics. She doesn't fit the profile of any known CRPS case - in symptoms, nor in the way it spreads and progresses. My CRPS is in my right ankle. I now have a left shoulder injury, for which I require surgery. I may or may not get CRPS in that shoulder. I already have it in my left arm due to a pinched nerve, and prolonged injury/pain feedback to my brain. My guess is that Maya discovered how to get attention from a singular injury, and it snowballed into a psychological issue. The hospital, reading her medical history, also suspected this. They went about it the wrong way, though. If they would have touched the actual area of pain, and if Maya truly believes she is in pain, it will elicit a pain response. They should have recognized that the ketamine wore off, and attempted a 2nd dose at whatever dosing they felt was appropriate, and let the family believe it was the dose they asked for. Assess to see if that dose worked. If so, then they could move on to getting physical therapy and psychotherapy. Allow the family to see her, but monitor with cameras if they had concerns. We do that in the hospital when we suspect abuse or Munchausen type behavior. How else do you get proof? One thing I was always taught about in healthcare, was that if the patient says it hurts, it does. Until we prove with further testing that it isn't something physically wrong, we treat it like it is. There would be skin changes to show CRPS - the skin becomes blue, white, or red, and the affected limb becomes swollen, especially at the joint. I walk with a limp and my ankle has limited range of motion, in addition to my foot and ankle being swollen, and either white or red. It's also cooler to the touch than the rest of the body. Other cases have the affected areas hotter to touch. It would be interesting to see the hospital documentation of their findings regarding her. My experience at hospitals has always been good once they find out about my CRPS. They are always careful not to touch my affected areas, and they are on time with my meds. The fact that they were so convinced it wasn't real suggests they weren't seeing any physical findings. It still didn't give them the right to treat that family the way they did. There is an actual process for suspected abuse, and that wasn't it.

she did got better eventually through other means but that’s what her mother wanted, treatment for her. the hospital just looked at beata as an abuser when she was trying her best to find her daughter’s relief. these idiot doctors didn’t know how to fix it, she tried her best, and they used that ammunition to ruin this whole entire family. a family knows best of their child’s condition than these foreign nurses or doctors. they all need to pay. stop privatizing child welfare!!!!!!!!!!!

@@jenx5870you may have CRPS and I’m very sorry for that but it doesn’t mean that everyone has the exact same symptoms as you or the same trajectory. I am a physiotherapist and have treated many people with CRPS, some much more severe than others. For example, 1 patient had CMJ replacement of their thumb and ended up with extremely severe CRPS that effect their hand and arm but no other joint. She had significant swelling but was able to tolerate a swelling glove to help relieve some of the swelling. Then on the other end of the scale had a small child who had a simple injury to his leg and ended up with 3 limbs affected and wheelchair bound but began making progress with intense treatment and physiotherapy. Another teenager girl who also had 3 limbs effected and so severe where she was unable to even tolerate light material on her skin (she use to cut all her leggings and trousers at different levels depending on what she could tolerate on each leg. She was also wheelchair bound but her progress unfortunately was extremely slow with intensive treatment and physiotherapy so although she presented similar to the younger boy with 3 limbs effected her trajectory was completely different. I will also argue that you mentioned about the skin changes, sometimes hot sometimes cold.. redness, swelling etc. if you have watched the whole trial you will hear that they have mentioned that many times. They did not mention mottling of the skin or increase hair growth in the area as often noted in CRPS but again every presents slightly differently. I have also seen patients who have had really great and fast improvements when the condition is diagnosed earlier and who may go from not being able to walk to being able to walk within weeks or short months but who may relapse in the same joints or other joints at any time whether that be another physical injury, a small bang to the arm for example or a stressful event or situation that may trigger the condition. Again, I’m very sorry for what you have experienced but my point being even though I am sure you know yourself and your condition very well, we need to remember that in the medical world nobody presents the exact same and just because they are not the exact same as you it doesn’t mean they do not have that condition. Remember she has been tested, investigated and diagnosed by not 1 but 2 and probably even more medical specialists in that area. Johns Hopkins abused this child and they need to held accountable for the damage they have done and the loss they caused. If you have read the whole case you will see that in the end John Hopkins also billed for medical treatment for CRPS so they knew she had it but they chose not to listen, they chose to abuse her and many other children that was found after this case.

I was involved in cps as well and most of those people dont even have kids. I lost my children cuz i fought against a surgery and they called me an erratic mother. It took me 18 months. To get them back

It's just so wrong, because Munchausen used to rarely sought out. So this hospital, went so drastically opposite from the first day Maya was admitted. They just wanted to collect over half a mill. It's always about making the mighty dollar for hospitals. 8:53

I havea situation like this. A hospital kept me for over two weeks completely unnecessary. I finally told the doctor I am not paying a single dime for the hospital stay and neither is my insurance. They discharged me the very next day. They are a hospital known as just sucking the money out of people. I've worked in the medical field for 25 years and know the tricks and seen so much shady stuff its unreal.

It's actually fairly commonplace now. My doctor had recommended it for my CRPS, but another pain specialist said the cons outweighed the pros (expensive and the effects would probably only last a few months at most, then the treatment would have to be repeated). Most people cannot afford the ketamine treatments on an ongoing basis. They should always be done in a hospital, because it is conscious sedation. However, there is nothing controversial about them. They are now widely recognized as valid treatments for certain issues.

i understand authority figures make impressions on many lay people but judges should analyze a case per case rather than automatically taking a authority figure’s word. some judges are so stupid. no wonder a lot of decisions get overturned in appeal. judges are not there to decide the facts, thats the jury’s job. that’s what new judges get reprimanded after ruling a summary judgment motion and throwing a case out. judges should not try to act like a jury. they are referees. there are disputed facts, as a judge, they can not rule on that mere fact. that judge was an asshole. i feel if a judge who gets their ruling appealed for the same substance multiple times, should be dethroned.

I'm going through something similar in FL. Both judges in 2 Zoom courts didn't let me speak and made ruling from hearsay. False allegations and didn't look at facts. DCF kidnapped my disabled mother and denying visitors and calls. I haven't seen her in 5 months. I hope to get her back before she dies. So much corruption in government, healthcare and judicial systems. This shouldn't happen to anyone. Hope they win big!

I have a theory.. epigenetic playing a big role along with the cough as it started first.. maybe a virus the the body had an extreme immune response or fungal infection... the are literally hundreds of viruses in existence and prions and other stuff that may not even be known about yet. As a nurse or just a scientific analytical mind, I'm wondering what testing they did.... they needed House in the house , instead they had ignorant clowns and callous imbeciles.

Maya’s feet remind me that is Brain losing oxygen and lost breathe and get that, that should do lot of Therapy, this happen to my Granddaughter while snow falling down from roof, and she got burry to underground over 15 mins,, but later through over two years , through mothers call back from death, all those Therapy time, keep doing lots game, walking, reading, with classmates send love notes, now still not 100% recover, but has go back school, play valley ball. Last year sometimes still extremely happy or screaming, but use love and parents company with her study, she has catch up good grades.

I am sorry I did not speak or see my 5-year-old son for a year due to a custody fight with their other parent. At no time did I ever want to harm or kill myself especially since I had another child home and was never going to stop fighting to regain custody of my son no matter what I had to do. Something is missing from this woman's story. I know this is not a popular opinion at all, but she had some guilt in something that she was so willing to not only leave all the children she loved so much but at her own hands. How do you love your children and yet now they have to deal with your suicide and the fact they found you dead from it. Sorry, she is no hero.

Your situation is literally nothing like hers was. It was made clear that if she was not in the picture her daughter could go home, and every day her daughter spent at the hospital she was being abused, mistreated, and ridiculed. It was also made clear that the authorities didn’t believe the husband would separate from her to bring her home. So she saw the situation as “either I eliminate myself from the equation or I let my daughter continue to be actively harmed”. This was proven when Maya was sent home literally a few days later. I’m not really sure why everyone seems to think that if they have a single experience that’s even tangentially related to some other horrific experience that they can use that to vomit out unearned callousness for a situation they actually have zero experience with. I’ll tell you why- It’s because your experience didn’t make you empathetic - it made you judgmental.

The rules of evidence provide: Generally, leading and misleading questions are proscribed during the cross or re-cross examinations by either party [Plaintiff & Defendant] Counsel. However, one of the exceptions where it is allowed thereto is the Rules of Court on "Child's Witness Cross Examination. Differing States have uniform rules relative to the child's witness. That is, proponent is allowed to cross/re-cross examinations a child's witness, the rationale is the liberal construction of the rules, speedy disposition and best interest of the child especially if they are in a prying & harsh witness stand, much more televised. Afterall, admissibility of evidence is not per se limited to one or two relevant facts but to the totality of evidence presented for considerations.

Much emotional testimony here, but perhaps others who had been in the same situation did not go and kill themselves. Mom tried to treat daughter and she started the avalanche that caused daughter to be kept by the state. Probably blamed herself for. Daughter being kept and that’s why mom hung herself.

Wtf!? The mother and father took the medical advice given for CRPS by a doctor… how is following a KNOWN treatment protocol ‘starting an avalanche’?! Of course she blamed herself for her daughter being held medically captive, because that’s exactly what the hospital were using to hold her. She was obviously distraught and knew that if she wasn’t in the picture Maya would be released, and she was right. She should never have been put in that position to begin with. She sacrificed herself to get her child out of there….

Are you kidding me? This poor family was put through hell by the Hospital and CPS! Not the only time cps has taken a child that was perfectly fine with their loving family. After a fortune in attorney fees and being put through hell I am sure this woman lost the battle she thought for her child to be safe and happy and home again. Cps takes children who are fine and leaves abused children to die at the hands of their abuser while cps are busy putting children who are wrongfully taken and their parents through hell.
