Humiliation is usually the price to pay to get off scot-free. All of them (Powell, Cheseboro and Ellis) walked away without a blemish. They had charges completely dismissed and new peripheral charges inserted (Powell) or plead to something peripheral to the main case (Cheseboro and Ellis) and in fact it was not even a true plea. It was a traffic court plea. Take a traffic school course, no admission of guilt or guilty judgment, expunged from record, walk way looking like nothing ever happened. They entered plea proceedings where the disposition was GA first offender status which holds in abeyance any guilty judgment until the terms of the program are fulfilled and then it all goes completely away like a traffic ticket plea!

They were unindicted co-conspirators in Jack Smith's DC indictment, and pleading guilty even to these counts does not make it less likely that they'll be indicted eventually, and if they ARE indicted it makes it harder to mount a defense. That is probably why they insisted on those counts, which I think makes legal sense--it's not just this trial that matters for them.

I worked in management of medium sized corporations for 30 years and I feel that I knew the role that officers of the corporations held. The role of trustee the the Trump boys played during the Trump presidency is the same, I think. That role is "the buck stops here". If fraud is committed on your watch you are guilty. I spent several years as the chair of two different not for profit boards of directors, one for a jazz festival and one for a music institute. I clearly understood that signing my name on the financial statements was a legally binding attestation that to the best of my knowledge those documents were accurate and honest. I knew that I bore a personal liability if they were not. I also made it clear to all new board members that accepting a position on such a board meant that one was liable "separately and severally" for the actions of those organizations. These were organizations with budgets less than $1 million annually, not the multi-million dollar businesses that the Trumps are signing off on.

As for Mar-a-Lago, it was built in the mid 1920s by Marjorie Post, daughter to the owner of General Foods Corp., as her winter home. When she passed away in 1973, she left it to the US government to be used as a winter home for the president, only none had any interest in using it. She left money to maintain it but it wasn't enough, so the government returned it to the Post family who decided to sell it. Trouble was no one wanted it & it sat vacant for years untl Trump bought it in 1985. He offered $15 million, but they rejected it so he bought the land next to it for $2 million to build a home which would block the beach view. The Post family ended up selling it to him for $7 million. The problems with the condition of the property along with it being zoned as commercial & the fact it was designated a historical landmark in 1980 are more than likely the reasons its property value is low. If it was a home like the others in the area, it probably would be worth more but it would never be worth $1 billion. The man's delusional to believe that.

I feel like there is a chance for Rudy to avoid going to prison. It's small, but he did used to be a federal prosecutor, pioneered the use of the same laws he's charged with breaking, and Fani Willis has already been pretty generous with Trump's other henchcreatures. Anything Rudy says or does will be handed to Jack Smith on a silver platter as well, so if Rudy were to make some kind of plea deal (a process he's been on the other end of many times before) and sell out his traitor of a boss, then his advanced age and previous service as a prosecutor could cause him to evade prison. If he does go that route though, I think there's an even chance of him avoiding prison as he does of ending up in some sort of retirement home or state hospital after his depositions revealed signs of dementia.

That's the thing, that is what is getting him in trouble. And I honestly don't think Trump understands what is happening. The Judge isn't going out and appraising the value of Mar-a-Lago himself, the 18 million number he used is what Trump has claimed the property was worth when it came time to pay his taxes, he then turned around and claimed it was worth a billion when he needed a loan. That is the crime he is accused of here both undervaluing it for tax purposes and then overvaluing it to the bank. And he is basically admitting he is guilty to half of it, on national TV. While this trial doesn't actually cover the undervaluing on his taxes, if he wins the IRS is then going to want a word with him.

He also brought up the GAAP thing and I sent that to my friends in the class so we all laughed when it was brought up as a class subject. Sarbanes Oxley section 302 establishes corporate responsibility for financial reporting. The CEO and CFO must sign off that the financial statements are not misleading, are materially correct, and that they are responsible for internal controls. By signing it you are saying you understand what the accountants gave you. Even if you just sign it you are still responsible. Although not a public company, you are still not exempt from the penalty portions of SOX. Also, if he is an executive he should be aware of private GAAP rules. Accounting rant over.

This waiver expired in May 2019 without an extension. Data from the UANI Tanker Trackers, which monitors global oil shipments, reveal that Iran’s exports stood at 2.9 mbpd in April 2018, just before Washington’s JCPOA withdrawal. By October 2018, this figure dwindled to 1.8 mbpd as buyers sought to minimize their dependency on Iranian oil. During the six months in which the waiver was in effect, exports averaged 1.39 mbpd. After the waiver’s expiration, Iranian exports averaged 0.775 mbpd for the remainder of Trump’s tenure although there were significant fluctuations month-to-month. Tehran’s exports began growing as soon as Biden took office. They reached 1.14 mbpd in 2021, a 32 percent increase from the year prior. This level of sales persisted in 2022 before another significant leap this year. The average export rate from January to August 2023 has been 1.38 mbpd, a 21 percent increase from the year prior and 59 percent greater than the last year of Trump’s tenure. This steady ascent hints at a sustainable upward trajectory in Tehran’s exports. To estimate how much Iranian exports increased each month because of lax sanctions enforcement, this analysis subtracts the average daily export in the “maximum pressure” era (0.775 mbpd) from Iran’s export level in each month of Biden’s tenure, as shown in Table 1. In effect, the analysis posits that Biden could have held Iranian exports constant had he chosen to enforce sanctions vigorously. Assessing the Worth of Iran’s Oil Exports Tehran’s efforts to obscure its export activities and sidestep sanctions make it harder to determine both the quantity of exports and their likely price. This analysis assumes that Iran offers its buyers a discount for purchasing oil from a sanctioned entity. Since Tehran’s discount offerings likely fluctuate based on time and clientele, this analysis posits three scenarios in which Iran’s oil is priced at 5, 10, and 15 percent below the Brent rate, respectively. For each month of Biden’s tenure (February 2021-August 2023), this analysis takes the estimated increase in Iranian exports as calculated in the previous section and multiplies it by the average monthly Brent price, less the discount for that scenario. Depending on the scenario, Iran’s total revenue during Biden’s tenure ranges from $81 billion to $90.7 billion. Had Iranian exports remained at the baseline “maximum pressure” level of 0.775 mbpd, revenues would only have been $54.7 billion to $61 billion. The differences between these two sets of figures indicates an Iranian gain of $26.3 billion to $29.5 billion, depending on the discount.
