That's why you need to defend yourself the same way you would against any other violent @sshole. Up to and including using lethal force. I’m in agreement but disagree at the same time. I haven’t thought it all through. I like the idea of having officers fund their own liability instead of the taxpayers. However I believe that that would create something as bad as unions. Just another organization that would be difficult for the average person to defend themselves against. In saying that I’ve just realized that I should make a donation to a legal defense organization or two.

@@earache_srt8790 while I totally understand your concern about then having to deal with insurance companies, I think the balancing of then having the wide world of personal injury lawyers to take your case vs. the difficulty of finding a constitutional attorney. The mountain would move a little bit closer. I don’t know of a better system… I wish I had. But having an independent agency at risk, not a governmental one, would be a better overall solution. Dependent on the case, you may be facing the Federal government as well as state and local and their vast budget and advantage under the law. Removing these huge hurdles would make the system more balanced - not perfect, but better. I think a system much like the interstate truckers that is regulated by the Federal government would likely work for cops. The nation wide database that is maintained about every trucker makes keeping up with their driving record pretty clear. It’s not perfect either but it’s better than it was before.

They have that. Every cop has a bond (insurance policy) on them but it can effect their career if there suits are filed so they just have tax payers pay.

No law enforcement officer should be allowed to resign in lieu of being terminated. No investigation of any type of wrong doing (policy, criminal, or Civil Rights) should just stop because an officer resigns.

At the core, this is simply a criminal case. Honestly, though, anyone else doing the same thing would probably have gotten just probation. That being said, this criminal assault being carried out under the color of law should have garnered a few years in state prison. A cop assaulting someone is waaay different than some Average Joe doing the same thing.

What's really criminal is when the prosecutor continues to back the officer and offers a deal to a citizen as a way of blackmailing them to avoid these lawsuits! Some back down not wanting to go to jail for even one day! I'd turn around, tell them to hook me up, and "keep me for as long as you want!" It only makes the judgement higher when officials are this stupid! How can they believe they're in the right trying to preclude public picture taking or videos? It's insane! Logic should tell them over their own shortcomings of intelligence!

Pullman posted the full body cam that shows before the guy recording ever showed up officer Tyrant played a prank on Mendoza and him and the other officers and firemen had a big laugh about it. Officer Tyrant heard it was Mendoza at the traffic accident and he headed over to see if his prank he had set up a few days before on Mendoza was still good so he could reveal it to Mendoza and all of the guys there. That was the purpose of officer Tyrant being there.

I showed about 18 minutes of this deposition to my 23 year old daughter without showing her the video of the incident. I asked her based on what she had watched if his testimony was believable. She said she could tell the officer didn’t believe his own statements but was determined to make sure he told the story that he wanted to be true. Should have seen her face after I showed her the video of the incident LOL

Officer Tatum has lied in the past many times. This time someone said "no more". Reyes called this corrupt cop' bluff. The other thing that strikes me is when police officers have beaten someone in an interaction there is very little concern for their injuries or welfare but everyone in law enforcement on scene is extremely concerned and keen to take many photos as “ Evidence “ if the office has a scratch or a broken finger nail .

I have a BS degree in teaching. I graduated from college in 1970. I remember courses I had to take, like Anatomy and Physiology, Kenesiology, First Aid, etc. I was in a profession where I was not issued a badge or gun, but was responsible for dealing with the public. How can these people with 6 weeks of training in the police academy, not remember what they learned in dealing with the public. From watching many videos, it's puzzling how a large number of cops don't remember their training. Additionally, they get hired at a higher salary than teachers. This needs to be addressed on a national level.

Qualified immunity only applies to civil litigation. It has nothing to do with criminal prosecution. You could take away QI today and, although that would be a good start, not one more LEO would be criminally charged because of it. You have to deal with the corrupt PD's to refer charges and then deal with the corrupt DA' to pursue charges, and then deal with the corrupt judges to have a impartial trial and sentencing. All things worth fighting for, but abolishing qualified immunity isn't the silver bullet some make it out to be.

@@CeanStrauss QI abolition wouldn't be the silver bullet, but it would be the crack in the armor to make things more transparent. If the defense gets QI established, it quashes discovery. And discovery can be brutal! Discovery info can show how the local DA is colluding with the cops and not charging "in an effort to retain police assistance"... ie the cops aren't about the law, they are about themselves.

I've said the same thing for years. Also, it's my understanding that once a law has been in place for a long enough time that a reasonable person should be aware of it, that "I didn't know that" is not a defense. I think it varies from state to state, but I've read that about two years is considered long enough for a cop to know what the law is once a law is passed. But apparently it doesn't mean anything, because cops use the old "oh I thought that was illegal" defense all the time and never get called on it

There is no way in which a police officer can reasonably believe filming in public like that or filming license plates is illegal. Which makes all officers involved criminally liable for things like USC 18.13.241 and 242, assault, battery, unlawful restraint/false imprisonment, kidnapping/abduction, etc. etc. etc. These cops could easily be convicted and sentenced to decades in prison or even death in any honest court.

He knew taking photos of plates was not illegal. He will come to regret saying those words. What he was doing was enflaming the situation with the clear intent to make an arrest on something else. The problem is at the time he had no regard for the US Constitution and felt that he could do whatever he wanted under the color of law and the dept would back him up. Well, now that we know all of their training is by online "classes" it explains everything. No practical experience, hands on instruction, group discussion/ interaction or testing. Sit for a seminar while they drink beer and watch the game.. we tried online instruction within our company: it doesn't work as there is 0 information retention for the majority of employees.

In texas, it's "lawfully arrested," so even if he said the cameraman was under arrest, the cameraman technically still wouldn't have to ID himself..

@@falseprophet1024 - in texas, "legally detained" is ASSUMED to be arrested...civil courts however have repeatedly shredded that doctrine, yet it remains...nevertheless, only when formally arrested are you obligated to identify yourself, and that means the officer MUST inform you that you are being arrested...ironically, the arresting officer is under no obligation to inform you what charge you are being arrested under. The host of charges that cops love to file on people in these cases (failure to ID, interfering with investigation, etc) are all secondary charges that cannot be the primary charge...which is why virtually every 1rst amendment auditor gets the charges dropped, dismissed, or knocked down to keep it out of court (also illegal, as it prevents due process, which would end in a courtroom).

I really do believe they do put their lives in danger but some are just not good officers . I want cops on our streets . I just want honest cops who have think skin to handle some people. Had a few in my life that where trying to be rude or maybe tryed to make me feel like I was a criminal but I always just said " yes sir " and just tryed to go with the flow to not make them mad and thankfully it worked . But the bad cops does make it hard to trust all . I'm all for police but I do think they all need training and lots . And de-escalation skills . Plus need to have descent communication skills and need to know the law . I know their not perfect and make mistakes especially rookies but the ones that have been officers and climbed the ranks should know they can't let their emotions of anger or ego make them do something violent .I do want cops but just hope they start getting more training . I want them safe and us .

I’m so proud of these auditors and so ashamed of the police who trample our rights. Every mayor, governor, police officer and department head needs to watch 100 hours of these types of videos. When looking for crime videos on KZbin you are just as likely to find examples of cops breaking the law as true criminals.

If it was a scene where forensic evidence would need to be preserved and sterile, it would be taped off. Obviously, this was just a non-fatal vehicle accident, so there was no evidence to be contaminated.

Typically if the resignation happens prior to official penalties coming down, there is no record placed in the perp's file. Then he can mossy on down to the next dept. with a CLEAN file and transfer right into that service with the years prior still counting to his 'experience.' Journeyman copping.

I just watched another cop of 20 years not knowing a damn thing about the law, it's the cop that arrested the girl for taking pictures outside the courthouse, and even said the judge wanted her camera to delete the pictures. That cop is clueless, you have to watch it ..

Every single training center for cops should make it mandatory for trainees to watch these type of depositions. Maybe, that would stick with them and make them think before they do something they will regret. They could call the training class "Don't let this be you."

I worked in a police department. I swear it was like high school. You had officers on the same shift hating the other officer. My supervisor was sgt. I worked with the TAC officer (she trained officers on running NCIC), she was the only officer that could. She was going through a divorce and I think k she called her husband after looking at the bank statements one day and was crying because she figured out her was cheating. Officer Yancy snitched to the Sgt and the sgt nor anyone else cares. We worked at the TRU or front window and 2 or 3 sat in the front and 3 sat in the back . The ones in the back just made sure warrants had the correct info on it. So we could take personal calls and watch TV etc. He hated her for some reason and tried for months to report anything she did to get her fired. Just petty for no reason.

Could be more if it went to a jury trial. Who knows, possibly millions. On the other hand, most people are bootlickers, and would be inclined to buy the cop's story. So it seems most are content to just settle. People are constantly bombarded with Blue Line propaganda, every single time a cop is shot anywhere makes national news, and we're constantly being told that the police are the only ones who can protect us.

So there was someone interfering in a scene of an accident and illegally filming license plates. Except, the investigation was complete, no officer observed him interfering and decided to enforce someone’s feelings, stated false allegations he never had any training on and did not understand yet took an oath to uphold the constitution, and the person was conducting constitutionally protected activity. Got it 🙄

You are exactly right. When I was considering a career in law enforcement, it was drilled into our heads how to stay within the lines and coverage of QUALIFIED IMMUNITY. I saw the corruption early in and discovered that I would not be able to change things within. IF things can be changed, it will take public knowledge to stop it.
