Funny how we like to villainize citizens for having their taxes be used for their benefit rather than angry at Corporate America for not contributing to those taxes and given beneficial priority instead. Don't bother replying to assert that You wrongly think this is a non-sequitur when there could be a much bigger tax pool If certain actors didn't socialize their losses and privatize their gains so that they don't have to contribute. Could be distributing a swimming pool rather than a bucket but nope! Let's be angry that a citizen got to drink from the bucket. Pathetic.

This case went a lot better than many others. As far as I can tell, they didn't injure Ms Johnson and even treated her (relatively) well. There have been plenty of other times when innocent people have been badly injured or even killed in raids like this. The fundamental problem here was that the police couldn't be bothered to do a proper investigation before they went and damaged someone's home. And given that Ms Johnson seemed to be cooperating with them, they could probably have caused a lot less damage to the home.

Many years ago I lived in several police states. (play Dirty Deeds Done Dirt Cheap). I have a pretty good idea of what a police state is like and I can say, we ain't that yet. Unless there is a sudden out break of sanity I see the USA going the way of Germany in in the 1930s and 40s and present day Israel.

Probably not the judge or the DA, they have absolute immunity rather than qualified. And if they were just relying on the police having done a proper investigation, then maybe they aren't too responsible for this mess. As for the police, they were more gentle with Ms Johnson than other police in other SWAT raids, but their sheer laziness was inexcusable.

@@rodh1404 The issue with them singing off on it is that their job on signing these search warranties is to check if they are valid. They are part of the last check before having an issue like this. They are also the group that understands the laws best, and should understand what is acceptable. Police don't have to know the laws, only enforce them. They are still responsible, but in a different way than the police.

The magistrate asked what window they could see the scale through, & the deputy answered "the kitchen window." The magistrate, angrily asked where exactly in the house the scale was & the deputy answered "on the kitchen counter." The magistrate roared "WARRANT DENIED!!!" So, some judges & magistrates ask questions, others don't.

LOL, first thing I thought of the app map was the location pinged off a car passing through one of the two roads in the area. The idea that cop got a warrant on such paper thin crap is incredible. That county must have a great judicial system.

Here's an idea. How about making it law for police to have personal insurance to cover them for personal liability claims made against them. Practically every other trade has to have it. Why should builders need to carry insurance, yet police are just given "qualified immunity". Imagine a builder saying "sorry your house fell down due to my incompetence, but I was doing my job so you just have to suck it up" Any officer that has a claim made against him would find his premiums dramatically increase. Maybe even to the point that he can no longer afford them so he'll have to quit his job. That'll give him second thoughts about doing it again.

A freaking military style squad to retrieve a stolen Iphone, 6 guns, stolen cars (that clearly aren't there) and other stolen crap simply from a "find my iphone" map? This is absurd. And at 4:48 that only mean the FREAKING TAX PAYERS paid for the COPS MISTAKES. Until we actually change the LAWS, allowing us to sue cops personally this BS will continue.

Like any other professionals, they should be insured and the money should come from their insurance. Which will make their insurance fees to go up and if it happens enough times, it will mean it's not worth it for some cops to just get another job as a cop. That's probably the best way to keep bad cops out of the police force.

It should be paid out of the police pension fund. When it starts affecting the cops they'll straighten up. However, the favt they abolished qualified immunity in this state and the cops are continuing this duckery shows they still don't care about being held accountable.

The change was recent and it takes time for cops to react to things like this. It's highly likely that the cops thought they could just do business as usual. More cases like this will make them more considerate, provided the money comes out of the police budget and not general funds.

Adding as a top level comment cuz several people have asked about the garage and I don't need to reply to each comment: In the long form BWC video, she told them how to get in the garage and the shed, but SWAT's gonna SWAT because it doesn't come back to hurt them directly. She was WAY calmer and more cooperative than I would've been, and I'm decades younger and have thought about what to do in these scenarios.

Yeah, that's what happens when you (i.e., the U.S. Government) gives local police departments military hardware like armored personnel carriers and whatnot. They shouldn't do that. When you give cops cool toys, they're gonna want to use them.

This is simple. The officer wouldnt ask if he wasnt sure. So, the supervisor trusts the officer. The DA trusts the Supervisor. The Judge trusts the DA. And the SWAT team is called out with a warrant because an officer, had a hunch it would be in the closest house. None of these people scrutinize evidence anymore. Its a big game of telephone, and a search warrant can be recieved in 10 minutes with this efficient system.

Colorado has been passing some effed up unconstitutional laws over the last few years, but this one allowing people to sue for violations of the state constitution and no qualified immunity is a diamond in the rough. A rare one they got right. All the other states should follow suit.

I'm a former cellphone tower equipment technician. I want to make a video, if I ever get help and time, showing how inaccurate cellphone tracking is. The technique the police use is extremely inaccurate especially in areas with mountains and high hills.

@@Shadow__133 I'm not really sure how that works. I haven't studied up on them. GPS is the most accurate, but the police use triangulation which is not. At my house my phone will connect to a tower that's 15 plus miles away and triangulation shows me at a place about 6 miles away.

@@Shadow__133 Even GPS data can be inaccurate. Basically the bubble is there to show the estimated range of accuracy. Have you ever just go into your phone maps and your position is jumping around? It doesn't happen often, but it does. While using directions from your phone, make a wrong turn and see how long it takes to realize. Then realize that is with its best connection at the time because when it has been running, it has more data than when you just turn it on and only look occasionally. Part of what makes it accurate is how many gps satellites you can connect to. I think you need a minimum of 3 to get enough details for directions.

@@snoopdogie187 Theoretically you could get a 3D position with 2 sats but inaccurate and unreliable due to ambiguity, 1 could give you a rough location with time/distance but no elevation. Commonly 3 are needed, 4 to reduce relativistic errors and often half a dozen used (depending on Latitude). A decade ago I used to track things with a boxy GPS with short lifespan, poor signal reception and a 2G communication, and it cost monthly subscription and hundreds of dollars upfront. Nowadays, despite the shortcomings, a $20 airtag does the job reliably enough for non critical assets. I 100% support police using them as a part of an investigation to recover things, but not to the point of violating someone's privacy on it's own.

The scarry thing is that if this lady had been angry and irate with the police, she would have ended up with multiple guns pointed at her. From there the chances of her being shot by a trigger happy SWAT guy would have been significant!

36 MILLION REASONS... That Denver's "police department" practices should be addressed. In the past two calendar years, the city of Denver was forced to pay out $36 Million in civil rights violations. Considering these settlements are financed by tax payers and as a consequence basic city functions are crippled. Good or Bad, my pending civil suit for being denied my rights of the 14th amendment, the criminal has gone on to assault FOUR more citizens in a calendar year because the judicial system released the known criminal without bail.

@@elhior23 I did watch the video. The proper course would have been to investigate the house first. Maybe keep the house under surveillance? Maybe watch who is coming and going? Get additional evidence that the iPhone is actually in that home? But instead, they send a SWAT team based on the flimsiest evidence into what could have been a very dangerous situation. Cops now routinely seem to choose the worst possible response to any situation.

"Knock knock! Police, we have a warrant! Hello ma'am, we have reason to believe you're in possession of stolen goods. Here's our warrant. Can you wait outside while we search the house?" Boom. Four sentences that could've prevented the lawsuit. Less than a minute.

It amazes me the disparity in what plaintiffs get in a lawsuit. In some cases like this one, you see that she wasn't harmed, she was treated decently, but yes her rights were definitely violated. One might think 100,000 maybe 200,000 would be a reasonable compensation, but she gets 4 million. In another scenario they've actually harmed the people damage their property put them in jail, and they wind up with 50,000 payout instead of a multi-million dollar payout they might deserve.

This happened in Atlanta and the SWAT Team raided the wrong house and murdered the elderly woman who lived there. The City of Atlanta disbanded the SWAT Team. And fired all of the officers involved.

Wonder what would have happened if she was a young male of color and was startled. Like in the split second before they know what is going on they were reaching for their phone or something in their pocket. The army soldiers I mean the SWAT would have acted in self defense gunning down the combatants in an active war zone sorry I mean they feared for their life thinking the person was reaching for a gun.

Andy is mistaken on why the SWAT team went to this old lady's house "armed to the teeth". The reason has nothing to do with a stolen truck, I Phone, and guns, THE REASON the SWAT came dressed in full military gear and busted in her door is... THIS IS WHAT THEY LIKE TO DO. These people LIKE dressing up like G.I. Joe and beating people up. And, make no mistake, this old lady was one flinch away from being thrown to ground every minute these bullies were there. This is what these people LIKE to do.

Did the police even see the app produce the location, or was it a screen snapshot from the truck's owner? A screen snapshot can be fabricated or manipulated. Glad justice prevailed in this case.

When I worked for Verizon, I had to tell _so many_ people, including police, that the little blue dot inside the circle is _not_ the location of the device, it's just the middle of the area where the device probably is. Seems like they'd wonder why there's a circle there in the first place, but they never do. They just see the dot.

Here's something to think about. If the app on the phone was working properly it means the phone, and quite possibly, the thief and stolen truck were somewhere in that circle. No other attempts were made to locate the phone, thief, or truck. Is that what the police call "due diligence"? Although Colorado has changed the rules and allowed citizens to sue the police for state constitutional violations, they also capped the amount any individual cop was liable for paying. If memory serves, it's $25,000 per cop. The law states that any amount over what a cop is liable for must be paid by the state\city\town that the cop works for.. So, once again, the taxpayer gets bent over the proverbial table.

Who leaves 6 fire arms in a car at a hotel? There are cases in Chicago and Las Vegas where people have been arrested for having a gun in their room. Las Vegas even made people at Shot Show open the safe in the room

Defund the Police: The police officers who commit this sort of violation of Constitutional Rights of innocent citizens like this old lady, that is. To pay off the judgements. Defund their pension accounts and a portion of their salaries; as well as the salary of the idiots who sign off on these unwarranted search warrants.

I think you bring up a good point if you are being wronged, there’s a time to fight, and there’s a time to not. I have my own experience with that in which I only laughed and joked, but refused to give anything up and everything was dismissed. I’m not a criminal, but you just smile while you exercise your rights act cordial and exercise your rights. That’s the only advice I can give I’m not a lawyer, but they’ve got nothing when they go to court provided your innocent because if you did break the law I can’t help you there. You need an actual attorney.

Most of us are pleased that she won the suit, but also very irritated that the funds have to come from taxpayers. However, these videos are VERY important. The various police offices around the US are AWARE of high awards against each other. When a new police executive wants to get voted in, the opposing person can disclose the big losses sustained against their previous one. These videos also "promote" lawsuits against the police when the police screw up. That also is good, because it tends to raise verdicts against authorities and promote lawyer income. @sanjosemike3137: Generally, police department heads (chiefs), are appointed by the city council, not elected by the voters. County Sheriffs are elected by the voters. State Police chiefs, are gubernatorial appointees, mostly approved by the legislature of the appropriate State.

Also like to point out a part of the law is that police can be held financially responsible in their individual capacity. Meaning they can be held personally financially responsible out of their own pocket.

A few more questions...besides the dozen of fishy things in this case. Why was a full SWAT team needed to check for some stolen goods? They hit the house like it was the center of a criminal enterprise. Also, you have the home owner in custody. She is friendly and polite. You come across a locked door. Do you A, ask politely if you can have the key to the door, or B, get the battering ram and do a super cool dynamic entry? Pick A if you are a well ajusted adult. Pick B if you are a man child who wants to live out an action movie fantasy.

After hearing about Street Cops Training, I am thinking that these raids and when police escalate situations are part of that class teaching them they are Gods of War. I think someone should see how many of these SWAT officers attended those classes.

Was watching the video of Roby Frank being arrested and wondered what you would say... They pretty much moved her out of the way and told her to sit down. They would explain later why they didn't need a warrant. They had reason to believe her children were in danger, rightfully so -- but still...

A) They KNOW there will be NO repercussions from law enforcement (because one of the SWAT guys is like, his brother in law, or something) B) They individually exceed the collective stupidity of the group of government agents that sent the SWAT team looking in the 1st place . . . so perhaps I misspoke - STUPID right wing gun nut with friends on the police force.

Thank you for highlighting the being civil to cops. Some cops are not professional and will escalate things. It always infuriates me when people argue with cops. Yes you have the 1st and 4th rights but cops don’t like being disrespected. Even if they are professional, they can do crappy but perfectly legal things to make the stop worse.

That information should have been enough to drive over and take a cursory look if they could find the truck. Then they would have probable cause for a warrant.

The sad part is that it's the municipality, not the cops themselves, on the hook for the money. Take it out of the police department's budget. Take it out of the hide, er, bank accounts of the commanders who decided to go ahead with this. Take it out of the police union's coffers. If the cops can't afford to pay, sell their gear. If it means the cops are unemployed for the rest of their lives, I'm kind of okay with that, as it would give them the perspective that so many of our unhoused folks suffer.
