Requiring a potentially uncalibrated handheld breathalyzer under VA (like you mentioned at 5:36) is already insane. I'm surprised nobody has challenged forcing participation of any pre-arrest sobriety test under the 5th Amendment.

Amazing how a cop can absolutely ruin a person's life with no consequences, but a simple misunderstanding by a citizen with no victims or even a potential victim can land them in prison.

The Fifth Amendment states in part: "nor be deprived of life, liberty, or property". The Eigth stats in part: "nor excessive fines imposed". Cops routinely damage property as part of their searches, and they can ruin people's lives in cases like this. I think when you put the 5th and 8th together, the cops should provide proper compensation for any damage they cause, and if you consider the loss of reputation to be a "fine", then if the person turns out to be innocent they need to compensate for that too. Police officers in the USA are basically doing what the Redcoats used to do. It wasn't acceptable back then, and it's sure not acceptable now.

@@Microtonal_Cats Yes, but the breath test it depends on your state, here in New York if you refuse the breath test you will lose your drivers license for a year immediately and you'll be arrested and taken for a blood test.

@@williezar2231, issue is unlike a calibrated machine that measures breath or blood, field test is based on the officer's opinion. If you watch DUI auditing videos, something as trivial as turning around can cause you to fail step test. For example, if the officer says take 9 steps forward, one step to turn around, and 9 steps forward - and you took two steps to turn around, that's a failure. But, taking two steps to turn around might be normal and natural to the average populace.

The problem is that too many cops have a casual attitude about bad arrests. For them, it’s just another Tuesday. For the people they arrest - innocent or not - it’s a serious and often traumatizing event. But yes, by the time cops get to the point of roadside gymnastics, they’ve already made up their minds that you’re going to jail for DUI, pass or “fail.”

I grew up with cops, promotions are generally based on arrest records, those with the most arrests with charges that stick are the ones that are preferred for promotion. So if you wanna make Sergeant or higher then you better get your arrest record up, so that's the motivating factor with a whole lot of cops, they want to arrest you because it looks good for them.

@MickG-r8o Exactly. Cops and their apologists will often say “don’t argue in the street, argue in court!” They don’t seem to understand that going to court is a costly inconvenience for most people, while cops get OT pay to be there.

You should never do field sobriety tests. Demand the breath test at the station only. And then sue the officer personally and in their official capacity.

Agreed. In the very best light, these are physical exams performed by someone who is NOT a medical professional, and who will probably assume that any "failure" they observe (or worse, lie about) is because of a crime. Say no people.

And they'll give the officer "qualified immunity" and the breath test has been known to be unreliable. Only the blood test is known to be accurate (maybe).

You can refuse the sobriety test, unfortunately, you can't choose the test (blood or breath) that's up to the officer. They will ALWAYS choose the blood test because they are taught in DUI school to do that even if the breathalyzer is available. They even laugh in the class about how most people just plead guilty and pay the fine if a blood test is used instead of fighting it putting money in the coffers. The reason is the blood test takes a long time to get a result.

"Qualified Immunity", the system protects it's own. Cops, District Attorneys, Judges, all have qualified immunity, they stick up for their own.

Just like Andrew said in the video Alcohol is not the only substance that can cause impairment. Just refuse the field test and wait for a blood draw. So you can be arrested for DUI on suspicion. Then the battle begins.

@@M1A2_Abrams_MBT they do a blood draw now. Breathalyzer wont detect other drugs. Thet is why they are arrested on suspicion of DUI. Then hopefully the blood test will come back negative so not pursued in court.

My son was falsely arrested in a DUI checkpoint and we didn't know where he was for over 5 hours... We had a missing persons reports out and feared he was dead on a little highway road somewhere while they kept his arrest info off the books for hours so there was no way to find him, meanwhile they mistreated him and placed him in very dangerous situations... all with impunity and no recourse after the bloodwork comes back negative months later. All the fear, money,emotional and legal damage we had to endure and there is no other option but to take it and say "thank you, may I have another."

@@Steve-mk6rq the cost of persuing any kind of action would be greater than what we could look at receiving. I have talked to lawyers... on both sides who say it isn't fair, but it is the reality.

"proper" nhtsa training isnt the issue. The issue is many just dont care. A cop that's motivated to make an arrest, will always find a reason.

A Clinical Chemistry Blood Analyzer can do 1000 Alcohol tests per hour. 8000 Tests every day. Yet it takes "6 months" for lab results. They knew the blood alcohol level within hours.

Mugshots should not be able to be posted until conviction. The companies that do this send kickbacks to the police for the mugshots; then they extort money to have the mugshots removed.

People need to realize and accept the fact that we live in a police state and our Constitutionally guaranteed rights are at the bottom of the priority list of "law enforcement." There are zero, none, absolutely no law enforcement agencies that are our friend. You can trust law enforcement as much as you can trust a company's HR department. Just don't do it.

Been arrested twice for "DUI". The first time there wasn't even a field sobriety test. Someone else blamed me for "DUI" because there was a pile of beer cans on a sidewalk nearby. Cops believed his story and they arrested me. The amount of corruption in today's society is absolutely unreal. It is staggering, it is surreal and it will only get worse. The crash by the way wasn't even my fault. The person who blamed me hit the Driver's side corner of my bumper because he was most likely on his phone.

I have Multiple Sclerosis. It is difficult enough to climb stairs, much less perform an "evoked potentials" test, which is the medical community's term for a "Field Sobriety Test".

My knees are messed up from skateboarding and playing hockey in my teens and 20's. I can't walk up and down stairs, either. I walk with a permanent limp and have horrible balance because of it.

False arrest seems like kidnapping under the color of law it is a gross abuse of power and the court should deal with it accordingly, just like any other criminal. NO ONE is supposed to be above the law, badge or not. Qualified immunity is a concession made for police misconduct.

As a nuclear power plant worker drug tests are required randomly, for cause, on first day, and after vacations usually. Results are obtained within 24 HOURS FROM THE LAB. Why in the hell does law enforcement take months and months for results.

Qualified immunity is civil law, not criminal law. There are nearly no officers that are charged with the crimes the commit daily.

Its not about detecting drunk drivers its about getting arrests. Any cop that arrests someone for DUI and the driver is proven to be sober should be penalised. The worst example of this was the college kid who went through every test even drug testing and was sober and not under the influence of drugs. They tried everything to get him in other words only driven by the desire to get an arrest.

Can't you just refuse to answer any questions, including when the cop asks you to perform the FST? Like, don't answer yes or no, just state "I won't answer any questions without my lawyer..."

Yes, that's exactly what you should do. If you're in a state that required FSTs, you should citehorrible issues with both your knees and ankles. Also, always drink vodka, since it's odorless.

I’ve got several uncles who are or were cops, and they all told me and my brothers no NEVER take a sobriety test. If they indicate that you smell like alcohol or they believe you’re drunk request a breathalyzer

Don't request anything. If they have enough to arrest you they will. If that happens, they'll get their tests at the station, and should have no problem getting warrants if required.

I once had a county deputy pull me over for speeding in an unposted stretch. He claimed he could smell alcohol. He ran me through every field test. Finally, he said, "I am detecting impairment, sir, but I'm going to let you go." :-D If he HAD found impairment, I would not have continuing my way to work! But his pride wouldn't let him say he was wrong.

So the best thing to do is remain silent while they arrest you, take you jail, and force you to spend a night there? Very humiliating, it robs you of your time, and it even makes you look like a criminal. Wow we have zero options

Once they ask you to take the FST they've decided that they want to arrest you. The variable is whether or not they have enough evidence without you volunteering to provide more.

My response to officers requesting "field sobriety tests" on the road. "I'm not a dog, I don't do tricks for you. Absent of proof, you don't have a case for DUI/DWI/OUI/OWI, and any arrest WILL result in legal action against your department, and then I will go after your qualified immunity, and when that's gone, I'm going after every penny you have, and everything you own. You attempting to falsely charge me with any of these offenses, is in fact, doing the exact same thing to me, so I would advise you, if you don't want your life turned upside down, you don't attempt to do the same to mine unless you have absolute proof."

My rule: You arrest one person for DUI and they're sober, you're suspended for two weeks. Do it twice, suspended for a month. A third time? You're fired. ... There's absolutely no consequences for these cops making these false arrests. Meanwhile. the accused has to pay to get out of jail, pay to lawyer up and have a DUI charge on their record until it's (hopefully) dismissed.

On top of that, cops will lie about what you were doing. I was on jury duty last year for a DWI case, and the cop gave grand jury testimony that was contradicted by the body cam. It’s going to be a five figure legal fee to beat that. So a lot of people will take a plea bargain, but their insurance will cost them way more than fighting the bogus charge.

@@kevinerbs2778 probably the body cam footage wasn't shown in the grand jury. All it takes for an indictment is 'reasonble cause to believe ' and 'legally sufficient evidence '. I was on a grand jury once, a cop's testimony is enough to indict.

Lying should NEVER be covered by 'qualified imunity' rather it needs to be grounds for the officers suspension without pay for at least 30 days for the first offense, dismissal for a second.

There is NO way I can do those balance tests. One foot is messed up because of tendonitis, arthritis and a bone spur. It is a week foot. Besides us older folks have balance problems, sometimes. I will NEVER do those tests.

The amount of physical danger they put you in just by being in county jail is significant. My friend was held on a similar charge and within 30 minutes into being booked he was attacked by another inmate in a holding cell. He held his own but imagine if this was someone who couldn't protect himself.

Field tests just like "Casual" conversations are designed to give "Probable Cause" to the officer. Without these they may be liable for their actions.

Great video! I live around Nashville, TN, and have heard several similar stories, even worse ones. Especially in small towns where all the cops laywers judges and the districtaterny work very close together, the DA seems to pressure people into taking plea deals before blood work is back, just to find out later that the suspect was sober

Fake DUI arrests are a serious problem for licensed healthcare workers and those with security clearances. Both can face revocation for a DUI arrest. This is nuts. I was a police officer in Virginia for about four years. Every time I suspected someone of impaired driving, I asked them to perform tests after which, I ALWAYS offered the field alcosensor. EDIT: that was over 15 years ago, so things may have changed in that time.

I actually blew .03 once i had a beer before dinner. I have a seizure disorder so i can't pass a feild sobriety test. This cop had no idea my dad was a cop so i said sure as long as your Sargent approves it because its illegal you get 1 blow. My dad was not happy rookie was written up.

Been pulled over and gone through these “field tests” 5 times in my life. Was stone sober(no drinks within days or years) 4x and well below the legal limit 1x. I’ve never passed the physical tests and it’s always come down to the breathalyzer. Now when I get pulled and they start down that path I just ask to skip straight to the breathalyzer since I haven’t had a drink in a decade.

the best one is that college kid who is so cocky cause he knows he’s sober so he’s mocking the cop the whole time he’s doing the tests, and then her gets arrested, and they clear him, and he sits down with the arresting cop and says “do better man, i’m disappointed in you, is this your first false arrest?”

1:34 in Alabama, you're not even guaranteed the right to a blood test. A drunk driver has the right to "object" to a blood draw and insist on a breathalyzer-only test - with no penalty, by law - but a sober driver who just wants that cold exoneration of an actually reliable blood test could be denied access to it, by law, at the discretion of the local police chief.
