if she gets away with that plea- the precedent is set- a high, high percentage of women incarcerated have babies and/or toddlers, and they are locked up for a lot less then what lizzie has done, will have to be set free for the same reason

Even if they find her "guilty" That word doesn't mean much of anything in that world. The only ones that see the inside of a cell are people who have an ounce of pot. When you rip people off of their life's savings you only get probation or house arrest. Madoff was like the only exception and I'm still surprised they actually gave him real prison. Probably because it was the largest ponzi scheme ever created. I was expecting them to offer him a job as a consultant and forgive every crime he ever committed.

I’m defending her. She’s done what SV CEOs do - raise money and bring in business. The R&D and development staff did not deliver. Family funds (like DeVos) make their money by insider trading. They have zero ability to do any due diligence. Family funds have been cutting out VCs and they suck at early stage investing. This trail is family funds with government connections trying to stick it to Holmes. Her defense attorneys are a disaster.

@@scasey1960 it’s pretty hard to do due diligence when everything you’re being told and all the documents you’re given are fraudulent. The laws are the only thing that prevent companies from showing investors false statements, so without prosecuting the people that do this, a company can do whatever it wants and get away with it. The only person who uncovered their lies was a journalist who had to secretly talk to ex-employees to get the truth. Also it was a medical company who’s lies were putting thousands of patients in serious danger

We have to remember that during all of this trauma that she was experiencing, she neglected to think of all the people she could have killed with all her false test results, all the while enjoying all of the perks. Again it's about HER being the victim, but perhaps, just perhaps, it isn't she who is the victim here. She sure didn't sound remorseful in the least bit. It was all I'm the victim, forget about all the perks, not my fault, okay it's been fun I'm going to go home now. 🤔

I watched her deposition from a previous matter...civil case, maybe? She comes across as a very arrogant jerk (=her true persona, imho), especially when being questioned by opposing counsel and her counsel objecting to the question, or rather advising her not to answer. She’d do this “in your face” kinda smirk at the attorney questioning her then. I wonder if she’s coming across the same way here, in front of the jury.

She will be found guilty as “power and wealth totally corrupt “ and Sunny will be found not guilty. ...There’s lover retribution. Good overview. The crying helped at the time but it will be forgotten. She can't cry her way out of this. She didn't love this guy. She wanted his money. She got it. She had to use her body to get it. Evidence is overwhelmingly against her. Her dude has problems of his own. I expect the jury to be out for four days or less. I expect a finding of guilty.

It makes sense they would purchase a house that way because she was telling reporters at the time that she lived alone in a small, barely furnished apartment with a refrigerator filled with green juice. She wanted to keep up the narrative that she lived like a monk because her entire life was her business. I hope the jury sees through her. The bottom line is that she endangered the lives of innocent people because she wanted to play entrepreneur and make a ton of money.

My view from the cheap seats - putting her on the stand was a Hail Mary effort to appeal to “that poor young woman” bias for frail looking little blonds, which, as a female manager, I find quite distasteful. The ‘I’m a victim’ appeal is moot, in my view, because if, as CEO, she was forced to act illegally - go to the FDA on one of her junkets back East that she went on alone (such as when she visited Rupert Murdock in NY to ask him to force Carryrou to back down.…which he declined to do),. During that visit with the FDA regulators - spill her guts, offering to work with the FDA to correct Theranos’ violations. If she’d thrown Balwani under the proverbial bus then, 2014-2015 timeframe, I might have a wee bit more sympathy. Now? Frankly, I think she’s just playing the pity card. Having worked in the FDA regulatory environment for a number of years, I’ve observed first hand how Sr. Management, especially at the executive level, refuses to accept that they must conform to regulations. Egotistical conceit and the profit motive push many of Elizabeth Holmes ilk to seek work arounds, avoidance tactics and/or plain old corruption, as in pay-to-play, to circumvent regulations in place to protect the population from “Snake Oil Salesmen”. My prediction - the prosecution’s case was sufficient to bring the jury to a decision to convict, but I concur, I think it will take 5-7 days of deliberation to reach that decision. At least I hope they convict her. It will be shameful if they do not.

You asked for predictions, so here you go. It depends on when the jury gets the case. If deliberations start Thursday afternoon, they'll come back Friday morning, take an early lunch at Il Fornaio, announce they have a verdict at about 2, and beat the Friday afternoon traffic out of town by 2:45--give or take 15 minutes. Ms. Holmes seems unlikely to present much of quandary for a Santa Clara jury.

These Facts that can’t be denied. 1. Ms. Holmes was brilliant at selling the "vision" of her business. 2. Some of Ms. Holmes investors had a lot more money than brains. (In this case I am referring to the brain of a sheep.) 3. From a poker stand point Ms. Holmes was trying to “draw to an inside straight”. Contrary to Steve Jobs and APPLE, Ms. Holmes did not have all potential blood analyses technologies and the experts to achieve the vision. Her final position was to keep the money flowing in as long as she could in order to buy time, and hopefully the technical expertise would be developed.

There are so many issues that I have with this case and this defense! The way Elizabeth Holmes does not want to take any responsibility as the CEO is one. Blaming Sunny is ludicrous since he was the finance/computer guy and she was the one that came up with the concept and supposedly had the science/engineering background. This is a company that gave scientific test results that affected people's health and lives! However, there is also the larger issue that the rich elite, professors, public etc. were so taken in based on superficialities and the perception that it must be ok if others are investing in it, instead of focusing on and researching the SCIENCE. No scientific experts were on the board and Elizabeth had like two semesters of college. We all need to be a lot smarter about who we so readily believe and trust and put on a pedestal!

Do you think the prosecution will just let Elizabeth “get away” with that rape story without questioning her regarding whether it was reported, who raped her, etc? If the rape was the reason she decided to drop out of school and start a company, it should have been important enough to report. And, why oh why are they dragging this trial out so much? More than three days a week is just too much to manage?? As for what other trials I would like to see you report on, the Ghislaine trial would definitely be of interest. I love the way you cut right to the chase and explain what they are doing and why you believe they are doing it! It makes it so understandable and interesting for those of us who are not trained in the law.

This coverage has been fantastic. Listening to the whole playlist one video after another, it sounds like the classic fable about Icarus. I'm not necessarily saying that Sunny was Daedalus; but he certainly understood that Elizabeth was flying too close to the sun despite knowing her 'wings were made of wax'. With investors like the Devos family who were happy to wait for a return on their investment, Theranos should have operated in accordance to regulation whilst developing a working Edison device. Their vision was admirable; their deception was unforgivable xxx

that would be interesting- especially the laws at the state level- am thinking that maybe the laws are a bit different in California then say if this trial was tried in say NY- federal trials are the same wherever they are tried though-- Kyle Rittenhouse got off in Wisconsin (I think it was a miscarriage of justice) but looks like he may have a federal trial in the new year- feds have deep pockets to mount a stronger case

I'm certainly no lawyer, but it seems to me that far too much of this trial is centering on the so-called guilt of Holmes' LOVER, not HER guilt or innocence. I wish the judge would confine the entire course of this trial to determining if she committed material fraud or not, leaving all of the sexual allegations to be settled in a separate civil suit between she and him, after the larger issue of criminal fraud is resolved. As far as his personal implication in the deception, that is already scheduled for a later date. As far as her lover advising her to commit questionable activities is concerned, that was entirely her decision to make as Theranos' SEO and owner. The fact that she accepted his advice at all is the smoking gun in this case. As a fully-functioning, intelligent adult, she had the right to leave or rebuke him at any time, and she chose NOT to. In my opinion, they were "two peas in a pod," and both complicit in criminal fraud.

The question for the jury is: Did Holmes discharge the duties that were expected of her?

One of the things I find interesting is that Liz was lying from pretty much day 1. Shortly after she dropped out of school and started her company she did a radio interview and said that her technology was completely developed and ready to go into production. But she had no technology at all, it was just a science fiction fantasy. Someone must have taught her from an early age that the only way to start a company is to lie your ass off. Usually when people just start out in business they first try to learn the correct way of doing things, but on her very first day she didn’t even consider being honest, she was already ready to con everyone before she learned anything else. I really wonder why she was so hell bent on this path from the beginning

I've really enjoyed and appreciate these summaries. While its clear she's 100% guilty, she's playing every sympathy card in the book and you never know how a jury will respond.

She admitted to at least one count of fraud when stating she put Pfizer logo on letterhead - could be some other instances as a result of the logo. Her plea for sympathy is unbelievable.

Somebody asked how many women are on the jury. I think it's fairly even but can't recall for sure. I think the female jurors will be the ones most...unmoved by her allegations of boyfriend abuse. Two things can be true - he abused her, AND she committed crimes. But trying to leverage the abuse as an excuse for her crimes is distasteful at best. It hurts women and sets back the Time's-up/anti-sexual assault movement. Most victims of abuse don't go on to commit fraud. It was more likely narcissism that did her in.

I think she would have a better chance if the jurors did not have so much time off before she completed her examination. The jurors are going to be overwhelmed with bad press during that time.

Elizabeth Holmes might have succeeded in hoodwinking investors but now does she think she can hoodwink the juries into believing that she was being mistreated by Sunny Bharwani and he took all the major company's decisions in spite of her being a CEO of the company? Perhaps she could as juries are not capable of understanding how the company is run,, the responsibility of the CEO and board members, etc.

My suspicion is that Elizabeth and hey lawyer(s) know that the verdict of guilty is highly likely, so they are doing damage limitation it reduce the impending sentencing, with the very faint possibility that she may actually pursuade the jury. Her defence is like a tick sheet: - She was manipulated - She was abused/raped in university - She wasn't the person in control, she in fact was controlled - She has a baby on the way. Any of this might or might not be true, but all (apart from her pregnancy) is difficult to prove and indeed the evidence seems to say otherwise. In any event, none of the above absolve her of guilt if true, but they may influence the jury and/or Judge to be more sympathetic. Personally, my belief (admittedly without all of the facts, so based on what I have heard) is that she's guilty as much as her (ex) lover and they should both go to prison. If she does then her baby will have to go into care or go to her parents/family, which is bloody horrible as the child is not to blame - Elizabeth is. She's the one who decided to get pregnant at such a time.

I think she should have stayed off the stand. If I were a juror, I'd feel like I was just another "investor" to be bamboozled. Bad move on defense part bringing past rape/abuse allegations..... sorry, we've all had bad relationships at one point or another. Curious, was the "rape" ever reported to Stanford University?

Wow. They actually tried the battered woman defense. Are we supposed to believe that he cast a magical spell over her? That he used jedi mind tricks? That he held a (metaphorical) gun to her head? The only "gun" here is that she wanted to be in a romantic relationship with him. That is NOT a gun by any stretch of the imagination. She had her reasons for being in a relationship with him. I don't even care if there was genuine love one way or the other. He wanted her to do this or that, but she was not his puppet. She did the things that she did because she made those choices by herself. That's what it means to be an adult, a big girl. She certainly wanted to be a big girl, acted like one, and perhaps most relevant of all, her age qualifies her to be an actual adult, meaning that she owns what she does (both legally and morally) and can't just dump it on someone else. She was happy to receive the benefits of adulthood when the company was flying high; therefore, she accepted eligibility for the punishments when it came crashing down. THAT is REAL gender equality. Anyone who disagrees doesn't understand the basics of adulthood.

I hate to say it but I think she will be found not guilty. Juries are lay people, not specialists and can be swayed by sentiment. Holmes’s defence is “none of it was me. I didn’t know, I didn’t do anything. I had a baby. I cry on the stand under friendly questioning from my own lawyer after arriving at court every single day holding my mummy’s hand and my boyfriend’s hand because I’m so weak. I’m white and from a wealthy background. It was a nasty older (brown) man manipulating and sexually abusing me after I got raped at a Stanford”. It’s all pathetic. Totally pathetic. But a jury…and only one member of the jury is necessary at that, will probably fall for it
