As a 10th amendmemt question, how does the state of Georgia attain subject matter jurisdiction over an election for federal office? It seems that multiple federal circuit opinions hold that the states have lack of subject matter jurisdiction over federal processes (e.g. cases holding that state laws pertaining to process servers do not apply to a Fed R Civ P rule 4 complaint; state private investigator laws do not apply to a rule 11 investigation, etc. upon the grounds the states may not regulate what is a federal government process or matter. ) Therefore, it would seem that the long established federal appellate law outright bars Georgia's cases because the nature of a federal office confers subject matter jurisdiction to the federal district courts not to the state courts. Can you expound upon this a bit? Because to me, it would seem that the pleas must be vacated and the cases dismissed for lack of subject matter jurisdiction upon grounds of the nondelegation doctrine (e.g. the congress cannot delegate federal election law to the several states thus rendering Georgias law as applied unconstitutional).

That futurama reference aside, what you should be vigilant for is anyone else, yes, from any party they see fit to associate with, appearing to see this behavior as validating similar behavior on their end since "well they did it and it worked, why cant I do it?!" This whole ...thing... all of it, sets a horrible precedence for future potentially problematic behavior..... It doesnt matter if it comes from pretty sounding 5 second sound bites about fluffy clouds and warped statistics in order to enact the will of the few upon the many. Oppression can come from any side of the aisle. Remember folks, its the freedoms, rights, liberties, pursuit of property, and wellbeing for ALL. Not just the people who dont do the thing the talking heads said were bad. Use your brain, reason on your own. Keep in mind that the mass media profits on sensationalism, there are two sides to Occam's razor, and only one of them can be used for clicks....the less walked more logical, often closer to the truth doesnt make for good clickbait titles....No one is obligated to tell the truth or act in your best interest. So avoid allowing them to dictate your opinions about a subject without playing at least a little devils advocate. Events are blown out of proportion, and people are falsely accused all the time. Dont fall into that trap. Otherwise....nothing will ever get better. Be good to each other out there, kids.... You can do it. I believe in you.

Sydney Powell, who pleaded guilty in court, and got off easy, goes outside, the court, and immediately claims that she was forced to confess and starts spreading the same stuff as before. Why does not the judge revoke the sentence she got, and converte it to jail time

I was in charge of physical ballots once, in an election where the results were decidedly not what I would have preferred. The results had already been recorded, signed off on and announced but I still had a sealed collection of ballots in my possession. I knew exactly what my responsibility was, what the law was and I took that responsibility incredibly seriously. It didn't matter what the result was, people's votes had been entrusted into my care and it was my responsibility that every single ballot was kept safe and secure. There would have been no universe where I would have let some random lawyer or anyone have access to the ballots or let them leave my control. I took better care of the collection of ballots that couldn't be cast! Genuinely shocked anyone in that position would be that cavalier with something that important.

Must of them have already lost their ability to practice in some states. Rudi for example. Others have been protected by dark money. Like Powell won her case in TX to stay a lawyer but will probably lose GA now that she has entered guilty plea. Basically, each state has to decide on each lawyer. No single "national" bar to join/leave.

I used to believe that treason was an outdated charge no government can be trusted with the power to prosecute for, but this whole debacle is making me think, I still don’t want governments being allowed to execute people for treason but this lot definitely need to be given long prison sentences under a primary charge of treason. Because they didn't just defy the government, they harmed the nation itself and hurt innocent people.

For real!! I understand the function of plea deals in building a case like this, but frankly there seems to be so much extant evidence from security cameras, public statements, seized recordings etc, I can't truly see the need for it...? 🤔 And the fact they haven't been charged with treason for their election-rigging attempts of various kinds does my head in too, esp. when you consider how significantly their actions contributed to the further treason & actual death in the Jan 6 Capitol riots?

@@alexthewrecker4666 Its a way to get them to publicly (and on the record) admit that they are guilty. So if they go to FOX and try to say "haha I didnt mean it" the court can point to it as evidence and reinstate the charges. Think of it as a verbal leash of sorts so the fact that Jenna went up and talked about how its not actually her fault since she had to trust a more seasoned lawyer is a slap in the face. Girl you passed the bar and you are an adult, there is no excuse to blame others for your actions.

Well it depends, I feel like if her testimony manages to burn the biggest kahuna in this conspiracy, it balances out the lack of punitive measure here, for me its about the balance, if a person commits 2 bad things, but then commits one really good thing, then the bad things, while still happened, are a little less important.

​@@WolfieDawnEven when I was a defiant middle schooler (more like undiagnosed and unaccomodated autism caused meltdowns that were then punished as if voluntary misbehaviour), I considered an apology letter a laughable slap on the wrist and was insanely grateful to be assigned one instead of "real" punishment. An apology letter is a slap on the wrist even to the children it's usually considered appropriate punishment for, let alone an adult who committed a serious crime.

​@@WolfieDawnThe entire way the US approaches drugs prohibition is completely insane, no doubt. That said these people are still facing consequences in the other related cases and there will probably still be further legal consequences for them. As mentioned they may well lose their law license, assuming there would even still people people that want to employ them after this. Its not a fair comparison to someone with petty drug charges facing a lifetime sentence, but it is a good deal if it leads to the convictions and/or cooperation from other coconspirators and takes down those at the top.

The "apology letter" is a complete admission of guilt, in writing, made as a public statement, so that there is no way for her to turn around and say she didn't admit it or she wasn't serious or she was taken out of context or whatever other argument one could make. That has value.

100%😡 When you spread this much disinformation that lead to public divisiveness, ill-informed voting and actual violence, surely part of the sentence should include a) A gag order on trying to further reiterate or compound those lies, on pain of jail time, and b) An obligation to make a statement in all the platforms you used before, admitting all the supposed conspiracies you uncovered were actually just a smokescreen for internal fraud efforts within your own cabal? Otherwise, the damage from all their lying never goes away and simply continues to poison the well of public discourse! There's the question of libel and slander too, surely - all those false accusations of tampering she previously made against innocent parties seem to have no further consequences? If I was the smart-ballot firm she libeled, I'd completely be prepping to sue her *ss off!!

I'm no lawyer, but legally speaking, American law generally requires the plaintiff to prove that they were harmed by the defendant's actions. If your opponent tried to rig an election against you but failed, then the government could still hit them with criminal charges, but a civil lawsuit would be tossed out as a waste of the court's time.

Out of over a dozen conspirators, a few of them are getting more lenient deals. This is common with RICO cases, as without a few flips it would be very hard to get the necessary evidence to convict both the small fish and the big fish. A few months back, Legal Eagle showed up on a WIRED video that discussed, among other things, the difference between pleading guilty and pleading "no contest". The point arose that a guilty plea makes a civil case on the same charges pretty much a slam dunk due to the greater burden of proof required.

Sidney Powell legitimately screwed EVERYONE in this case 😂 Kenneth Chesebro requested a speedy trial to try to get ahead of conspiracy charges (after all, it would be hard to prove he was in a ‘conspiracy’ by himself), but Powell screwed him over by requesting a speedy trial as well, getting tied with Chesebro as part of the conspiracy. Then, when Scott Hall pleaded guilty, Powell was under pressure herself since he was working for her. When Powell flipped, Chesebro was screwed, because Powell was going to testify against him, so he flipped. Then Jenna Ellis flipped because she could see the deals were coming off the table. ALL OF THIS is because Powell decided to jump on the “speedy trial” bandwagon. 😂

Not really. They, Powell and Chesebro, got off with incredibly lenient sentences. Chesebro should thank Powell, because he was at a level where he would have likely been sentenced to a stint in prison if this had gone to trial. He got off easy. He and Powell should have served jail time, but, because they made deals so early on, before the lower tiers did, they got especially lenient sentences.

Wha??! This makes no sense. Nobody "flipped" on anybody. They both asked for speedy trials at the same time. That forced the DA to have to try them ahead of everybody else which in and of itself is a problem for the DA. Risk previewing the case, risk adverse rulings, waste time etc. So they decided they wanted them gone! That's why they were offered sweatheart plea deals and all walked away unscathed. There is not even a conviction on even the lower charges they "plead". It is like a traffic court plea. Take the safe driver course, pay fine, no guilty judgement, not on your record. All it costed them was the humiliation of an apology and a small fine.

@@JasonBoyce In order to "flip" the charges and conduct have to have relevancy to somebody else's charges and conduct. There is no overlap between the two. And the charges they each ultimately plead were not even connected to the main case or to each other in any way. This is the DA try to avoid trials ahead of the others. And perhaps also an admission that the case is not particularly strong....prosecutors with solid cases do not typically offer sweatheart deals a day before jury selection!

@@arlokloiber2715 I mean...if, as a teenager, you had evidence that could literally get an ex-president out into prison, you'd probably be able to skip prosecution for that crime entirely. Or even if you could help testify to convict someone of a particularly nasty felony. Not trying to downplay what you went through, mind. As someone who also had the direction of his life altered by an incident that happened when I was a teen (chronic illness, not a crime, but still), I can totally understand your being sore about it. Hell, I think Powell should have gotten punished worse than she was, plea bargain notwithstanding. But it's still logical, if a bit of a bitter pill to swallow..

@@Nixeu42 i dont see how logically the application of " justice" should be inflexible, like for an example of what i mean. For instance if like in certain european countries you recieved a speeding ticket and had an income level that placed you near the poverty line then lets say its a fine of 100 dollars thats still a punishment , but if you were a millionaire 100 dollars is pocket change and you can keep causing harm so long as you have a bank account big enough to tank the hit. So instead they scale that fine to the person so they get charged 1000 instead. Maybe im explaining this poorly but its a bit like getting spanked as a kid , if that was the baseline punishment but never changed after a few years it stops being effective because an adult can take much more, so in this hypothetical as the person becomes an adult the implement of punishment should change ,per se, a large paddle so its actually a punishment and the action will be less likely repeated. So fiscal spanking needs an upgrade to be effective

@@arlokloiber2715 I'm...not sure why you think I'm saying that the application of fines shouldn't scale with one's general worth, though I can actually see issues if you make it net worth (which includes non-liquid assets that can't easily be sold at their theoretical "value") instead of how much free cash someone has...though I can also see issues if you don't. Seems like a tricky line to walk. Also, I am more than a little concerned about that corporal punishment analogy, honestly. That's...not really where why mind would have gone.

It does seem like a bad sign that these guys got off without any jail time. Who are the bigger fry? Obviously, Rump bit maybe !eadows and Giuliani? If they let Giuliani and Meadows and all the rest go without jail time we may be seeing no jail time for anyone. Sickening indeed. It seems that these “lieutenants “ should have at least had to serve a few months. This sends a bad message to all. And worse, foot soldiers who believed all these lieutenants’ lies go to prison, some for a very long time.

I used to be a poll worker for about 10 years in Indiana, and at my station we were a heavily populated area so we had two check in stations with one of "each party" on the stations as well as one of each party as officers supervising. And a person of one party who handled all the calls and stuff between our station and polling office. With each voter scanning their own ballot at the station. Then after the collection of ballots by 2 of each party into the security bags which had a specific tag number that had to match up to what was noted upon the distribution of the ballots, etc. then one of each party (usually the supervisor and the opposite party officer) to deliver the ballots to the office where there was a bipartisan ballot count and compared against the electronic scan of the ballots at the station to make sure everything matched up. There are safeguards upon safeguards to prevent tampering.

My hot take is that the people who have pleaded out have been the ones with the most exposure to the criminal justice system, 3 lawyers and a bail bondsman. These are the ones who understand what is at stake and, at least in the case of the lawyers, how strong the case is against them. Honestly if I was a defendant here and the lawyers start accepting plea deals, you better believe my butt would be down at the prosecutor's office first thing in the morning with a box of Starbucks coffee and a couple dozen doughnuts ready to sing like a canary.

They (as in, the general population) aren't naive. They are targets of misinformation orchestrated by groups with political interests. There are many factors that affect why a person will engage in conspiratorial thinking. But often the underlying need is the same: that person has a specific world view, and the conspiracy theory is what would have to be correct for their world view to also be correct.

Even if they were right about "dead people voting," the critical statistic to keep in mind the US that in the us ~9.3k people die every day. So... yes, there are many people who die after casting their ballots but before they're counted. ~1-3k for same-day voting, and tens of thousands for early voting.

I've worked in several elections (in NZ, not the US though) and the people all working there vary wildly in their political beliefs, as they should. Being passionate about elections is not something reserved for any side of the political map. I thought about that with Trump, that he might be a flight risk, but there's a problem: as a former President, he's guarded 24/7 by the Secret Service, and the Secret Service is a law enforcement agency under the Department of Homeland Security. As law enforcement agents, they can't aid and abet a criminal fleeing justice. They have authority over his physical safety, but that authority over his safety gives them a certain amount of control over where he can go or not go. That is, they can actually stop him from going to places that are judged too risky for his physical safety, they can stop him from illegally fleeing, and they have the direct ability to make sure that he safely arrives to every required court date. Although he's being protected, he is also under guard.

because if they were tried for treason the AGs and any juries/judges would end up having to either let them off, or end up in prison themselves. under the U.S legal system what they did wasn't actually treason, treason is extremely well defined in the U.S system, to an extent that murder and assault are less well defined. it is intentionally extremely hard to commit precisely because kings used to use treason charges against anyone that opposed or spoke badly of them
