I would love to see a video on the 303 Creative v Elenis decision with a focus on how the web designer cited a "customer" who apparently did not actually exist. How did that get to the Supreme Court with no one noticing? How does that impact the result? Is this still considered precedent or does it open up new legal avenues?

If you want a break from real life mayhem, I have two “real lawyer reacts” ideas: The movie “Enough” starring Jennifer Lopez. The tagline of the movie is “self defense is not murder”, but I’m pretty sure what she does in the finale is absolutely murder. She plays a battered wife trying to escape her crooked cop husband, taking their daughter with her. A metric TON of laws are broken on either side, plus it would be interesting to hear what legal options are actually available to victims of abuse. Second idea is WAY more lighthearted: The Bluey episode “family meeting”. It’s trial court 101 for kids and does a decent job showing kids how all that works…sorta 😂 there’s plenty of inaccuracies, but it’s a fun little legal romp to take a break from all the trump/real life nonsense. Love your work, you kept me sane through all the election lawsuits 😅 your channel is truly educational and cuts through all the chaos of real world to deliver facts and humor.

The criminal justice system goes out of its way to go extra easy on popular political figures. In order to appear apolitical (superficially), they extend all sorts of special considerations to criminal politicians, instead of doing the actual apolitical thing and not considering their political status or aspirations.

@@the_last_ballad that's fine if / when preferential treatment is the same on both sides. All Trump supporters want is unbiased litigation. For example: why isn't hillary in jail for benghazi? Or: why isn't anyone else been jailed for the cluster in afganistan for either side of t he isle? Also: why hasn't anyone been jailed in the past, you all couldn't even put Nixon in jail. If you want to get ticky tacky I can argue that Patton should have been jailed as well for saying that the Nazi's weren't the true enemy. At that point in time that would be considered treasonous to even think about let alone say to the press, which he did in 1945 after the fall of berlin. Some politicians are treated like golden boy teenagers, the rest are treated like black sheep when it comes to legality of actionable offense. Whatever your moral biases are they need to be set aside and a real adult talk had between all americans over exactly what it is the country NEEDS and not what a small group WANTS. If you want it to be fair then in fairness BOTH sides of the isle need audited for corruption. BOTH sides.... good day.

@@jayspeidell It's not hard to imagine: A lawyer needs to do some pretty crazy things before they're considered co-conspirators, and short of that: You're paid every hour you're sitting in that amusing mess. Heck, I'm not even a lawyer and I've had hilarious court sessions where our side concluded with me putting on a veiled insult against the other party, an arrogant lawyer. He then spent his full 20 minutes ranting and raving about me, while the judge's eyes rolled back further and further. Then the clock struck and.... he hadn't actually made an argument. And since he was the demanding party that means he lost by default. Which is good news because he had a decent case and my client had a pretty weak one. Now do I think it's good proper lawfare to call someone a lawbreaker in a court of law? Naah. But for 200 per hour plus VAT I'll happily do it and zone out for a while while the opposing side is losing their sh*t. 😆

I think he's a bit of a maniac. And yes, he made lots of money by investing in some up and coming companies, but he's no engineer. His "brilliant" ideas include a crappy tunnel in Las Vegas and a rocket that was too heavy.

I love the fact that Twitter tried to cite its disclosure policy as legal precedent for alerting Trump to the warrant, while ignoring the fact that its own policy precludes the exact situation they were arguing by citing the exact legal code being levied against them. That 'unless we are prohibited from doing so (e.g., an order under 18 U.S.C. 2705(b)' is incredibly hilariously damning. Truly, the best legal team ever.

Oh, obviously it's a different situation. Hillary Clinton was running for president in 2016. Donald Trump is running for president in 2024. Totally different situations and to claim otherwise is to be weaponizing the legal system unfairly against political opposition. See, this is the sort of legal argument you learn to make when you go to law school. Or at least the same law schools Trump's legal henchmen attended where apparently huffing paint is part of basic contract law and suffering severe head trauma is part of a mock court case.

So she should have been locked up for just that. Imo far worse than Trump not wanting his twitter dms to get leaked. What real evidence could they honestly find of an insurrection via tweets? or better what can be taken and presented out of context as most Trump things in the media since 2016...but again this is the same party that tried to use KZbinr "SaltyCracker" as proof of an elaborate insurrection plan during those riveting J6 hearings...great stuff

This falls under the "How stupid do you have to be?" heading. When the company I worked for was subpoenaed, while the lawyers thrashed around, and finally the court said, you have until x, to turn in the documents, in the background we'd already gathered up everything they'd asked for, so when we inevitably lost the contest, we were ready to go. I don't understand why that's such a hard concept.

Because they didn't know until two days before the due date and even then it was only the legal department involved , by the time any relevant department was informed in producing that data it was already mid hearing in the trial.

I have heard of Trump, so can I invoke executive privilege? I'm sure I can try, as many people affiliated with him do try, but I might be just as successful as they are. I also wonder if they are trying to invoke executive privilege under the assumption that 45 is still president (in denial about the 2020 election results).

Do you have any sources that point to it being a percentage of income, because the typical fines for contempt of court have cielings based on the type of court. Most of the states I've looked at had $500 for local courts and the state level courts had $50,000.

Pretty sure this video said the statute protects twitter in this instance, as it was in response to a valid government warrant. So Trump would only sue for PR purposes, not to actually win the lawsuit.

They know. But this is how the law works from a rich perspective - good and bad legal moves alike are just tools, toys and obstacles to throw into the gears and slow down the process. They will always have more money and more time (for hire) than you will, and even if they can't stop justice altogether, they can delay it to the point of meaninglessness. That's really the point of conservatism too - the law should be a set of chains on _you_ to keep you in your place, not a shackle on people like them.

The most revealing part of this is the failure of Twitter to produce the files immediately after the trial. They had all the time they needed to prepare while the trial was going, but were so confident in their case that they saw no reason to prepare for losing.

They also agreed to hand over the files the same day as the hearing. Instead, they took 3 more days and suffered the escalating fines. So it looks like the lawyers thought the files were ready to hand over. Question is, did someone lie to the lawyers, withhold the files, or is the damage to Twitters backend so bad that those simple database queries took a lot longer than they should have ?

They could argue that it's unreasonable timeline, but judge could answer "well, you had established timeline before, and you would be golden if you just followed it; you decided to spend a lot of time and money from taxpayers, so now you need to pay. I give you one chance to dodge penalty; if you believe it's unreasonable, just think that I imposed fine on you without ability to dodge." This kind of decisions happen. (Of course, if I would be Twitter's executive team, I would order this data to be compiled beforehand, just to be able to comply with the order immediatly; I'd order it in the day I filed motion, in case it wouldn't go my way.)

I love it when people believe they're correct. No. An NDA is an agreement between two signatories not to discuss a given topic outside of certain circumstances. You are specifically agreeing not to talk about something. The government will not tell you that you can’t disclose whatever is covered by the NDA. However, they will enforce judgements against you, should the other signatory choose to take you to court over your breaking of your contractual agreement with them. In other words, you’re still free to say whatever you like, from a First Amendment standpoint. You’ve just agreed not to talk about certain things and - if you do - you’ve agreed to certain penalties as part of the NDA language.

Keep in mind that this was set to scale exponentially with continued non-compliance. A full week would have gotten them fined $6.4 million. A second full week would raise that to ~$410 million. Week 3 the fines would start to exceed a billion per day.

They made up a lie about how Twitter was "unfairly biased to leftist politicians" before Elmo took over. Then immediately biased the company towards rightist politicians as soon as Elmo took over. They really did just self-report on their own schemes. Oh and to head off any commenter that tries to bring up "Muh Twitter Files:" they have similar requests from Trump campaign teams that they respected, and the Tweets actually removed by the documents featured in the "Twitter Files" were all reposts of private images featuring Biden's Son's Penis, fully-nude, that any citizen has the right to take down for privacy concerns. They were not opposing political opinions, subjects, or free-speech. They were not biased towards either political aisle, unlike now where they literally go out of their way to allow an hour-or-so long hate-speech video onto the site after it was repeatedly flagged for hate-speech, or attempting to notify someone under criminal investigation of those requests, just watch the video for that story.

I’m going to disagree here. The Fourth Amendment exists for a reason; you’re implying that innocent people shouldn’t worry about abuses of power. Edit: Me have big dumb and misinterpret comment. I thought for some irrational reason he was making that point in a vacuum…rather than in the context of this video. Yeah, I know 😂

I would bet that Twitter's lawyers were given the Herculean task of trying to polish this turd into a diamond and told the executive team about the unlikelihood of success. Also any decent lawyers at Twitter have probably quit the company by now.

More an interesting argument cause he is currently suing former Tesla employees for breaking NDA. Or that he used NDAs to compel silence from former Twitter employees by threatening to revoke their contracted termination payouts (which is being investigate by state regulators)

@@boxhead6177 you need to understand what a NDA is and how it applies. An NDA is an agreement between two signatories not to discuss a given topic outside of certain circumstances. You are specifically agreeing not to talk about something. If the ex twitter employee broke his NDA we'll elon is well within his right to pursue legal action. There's no such thing pertaining to your second comment/statement.

How on earth can a lawyer so blatantly lie in court and not be hit with a contempt of court charge? "Your honor this principle is super important to my client, they do it all the time!" "Show me one instance where you have done this" "Uh... I couldn't find any" That is straight up lying to a judge. How can that go unpunished? Not punishing that is an incentive for lawyers to keep lying until they get away with it.

Mental Note for future: Physical paper copy of warrants to be prepared in case of digital portal shenanigans. IF an organisation has a legal portal online for delivery of legal requests, such as search warrants, they should have a legal requirement to prioritise that portal's maintenance and functionality.

In some cases, it's because the client demands the lawyer takes an indefensible position. So the lawyer does what they can. In other cases, it's because the client has a history of refusing to pay bills. So competent lawyers go elsewhere. Or it's both.

I have a lot of friends who were duped into thinking Ketamine is a harmless drug (yeah, basically the Burning Man sort of crowd). Elon Musk is the most public example possible of how it can destroy lives. It's not a guilt-free alternative to just drinking like a normal person.

Lot safer than most things when used in moderation but yea does a load on your kidneys and can be addictive. Given how expensive it is and how hard it is for someone outside of the festival/wook crowd it's hard to get addicted for practical reasons. Ketamine is a great drug, Lotta medical use, fun as hell but yea its far from harmless. You ain't coming back from a K addiction like you could from H or booze.

-Twitter- X is the gift that keeps giving. Man, I like these videos. Legal issues, potentially some rather complicated legal issue, are explained in a clear and easy to understand manner. It probably also means that things might have been dumbed down a bit, or perhaps some nuances are lost, but still. I've been married to a lawyer (although now she's a magistrate and sends people to prison) for over 20 years, and the legal system isn't anything like the average person thinks it is, or thinks it should be.

I think doubling the fine every day was a good idea. Although it only reached $350K after three days, after 2 weeks it would have totaled over $800M and that would have had a real impact on the company. So yes since they complied in 3 days it was not a major expense but it did force them not to drag things out any longer. This is not ideal but it is nothing new that there is one law for the rich and another for the poor.

If POTUS is using it to communicate with another social media user, who happen to be, say, their chief of staff or general attorney, and they're speaking about governmental matter, it can be under EP. POTUS probably shouldn't, but that's beyond the point; I don't believe there is a law limiting POTUS in communication means.

What’s weird to me about this is that, from what we know from the publicly-facing information on the warrant, it’s probably at least partly about finding out if he (or his security detail, or his aides) used devices other than what has been turned over to the authorities during that time frame. Yet Twitter is acting like they’re protecting his speech, not his freedom of association.
