In all fairness, I thought that "in jurisdiction of" also has inclusive power. Let's say that a baby is born on a ship in international waters. If the ship is under USA flag, it's under USA jurisdiction and thus the baby get citizenship. Same thing with USA embassies or consulates.

As soon as I heard "it's never been tested in court" I immediately thought of United States v Wong Kim Ark 169 U.S. 649 (1898). Wong Kim Ark was born in San Francisco in 1873 to Chinese parents who were legally residing in the United States. When he was a teenager, his parents returned to China. After visiting his family in China, Wong Kim Ark was denied re-entry into the United States because he was not considered a U.S. citizen. He sued the United States for citizenship by birth. The Supreme Court ruled 6-to-2 in favor of Wong Kim Ark, affirming that he was a U.S. citizen by birthright under the Fourteenth Amendment. The ruling protected U.S.-born descendants of immigrants from being denied citizenship. I learned about this case when I took a Constitutional Law course as an undergraduate in college.

This brings up both a question and an interesting fact; Q: Did the ninth Justice recuse or was this case decided in an era where we only had 8 Justices? (Biden could and probably should appoint a half-dozen more Justices, right now!). Fact: Nowhere does the Constitution say that you must be an American citizen in order to be Supreme Court Justice, nor must you be an attorney or have had any kind of legal training! The only prohibition I am aware of is that you cannot draw a federal salary if you're not a citizen, but in theory a non legally trained, non citizen could indeed be appointed to the Supreme Court as long as he, she or they served pro-bono and didn't take a salary.

Justice John Jay once pointed out that the framers of the constitution intentionally said "people" instead of "Citizens" in the constitution. The reason being that Justice Jay hoped that if America offered visitors to the country protection under the constitution, that other nations would offer the same to Americans visiting overseas.

The process of becoming a US citizen as someone not born in the USA takes up quite a while. It hasn't been for a very long time that you can become a citizen as soon as you marry an American citizen, nor when you give birth in the USA. While Barron was immediately a citizen when born on US soil it doesn't make the mom instantly a US citizen. There's a lot of hoops to go through to get a permanent residency status (aka Green Card), even when in a profession that is highly needed in the USA. When I finished my RN, BSN in the States, it took about a year and a half in order for me to get my Advanced Parole (not making this up, this is a document stating that you can leave the USA and return on the Work Visa ) ) and it took about 4 years to finally get my Green Card. After you have a Green Card for 8 years, you can start to apply for citizenship only reason it went so quickly for her was money! It also requires you to give up the nationality you were born with... so as Melanie is a US citizen, she can't be deported. If birthright citizenship would mean that the mother becomes a citizen, there wouldn't be a lot of illegal immigrants as it would automatically mean that all the women who immigrate and give birth to a child, would become legal citizens.

Long-time listener, first-time caller from Poland here. My ex was born in the US, but is not a US citizen, as her father was a Polish diplomat i.e. “subject to foreign power”. It’s actually a significant problem for her now: because her birthplace is “Queens, NY”, she’s automatically assumed (by banks etc.) to be an American citizen subject to US taxation… She ends up having to prove she’s not American, which is not easy: there’s no such thing as “certificate of non-citizenship”…

Does Poland's equivalent of the US Department of State not issue documentation for Polish citizens born outside Poland? That's how the US handles this situation: when, say, a US citizen/Air Force member gives birth in, say, Germany, she applies to the nearest US embassy or consulate, which issues a document that from then on serves as the child's legal US birth certificate.

Technically you can hold both the US and EU citizenships, they are not mutually exclusive… Since US citizenship is automatically granted to pretty much anyone born in the States, it’s almost impossible to prove you are one of the exceptions to the 14th amendment… Anyway, this was just to point out some unusual consequences of US birthright citizenship. I have to admit I don't do well with change. I found this channel about 2 years ago and followed Beau faithfully. Needless to say when he retired and I found out someone else was going to be doing it Ifelt sure that it wasn't going to measure up to what Beau had done. I'm happy to say boy was I wrong. the main problem is enforcement. trump is fully capable of breaking the constitution to achieve his goals. when he does this, someone actually has to stand up and call him out but the way i see it, very few in congress seem willing to do that.
