There's no way any of this should hold up in court, as long as they get decent lawyers. But they probably won't, because they can barely get by as it is most likely. It most likely was theirs, but that it doesn't matter. The cop didn't see them toss it, he didn't see them smoking it. It was just in the vacinity of them at a public area. Imagine your walking in a park, and cops show up, and they find a small bag of weed 15 feet from you that some teenager dropped out of his pocket, and because you just happened to be in the area, they arrest you and say its yours. Now that goes on your record forever. If you had any hopes and dreams to one day become a cop, to become a senator, to even be a security officer. Now you can't. Just because you went for a walk in the park.
