asking this question on earlier date, CUE AND/OR 38 3.156(c). Had a HLR and was granted 50% for both in feet in 2022 on military medical records left out in denied in 2011

I'm told my case is unique by multiple attorney's that have rejected me based on this... I had a non service connected lung cancer surgery (lobectomy) and I have had problems every since, mainly with GERD and stomach pain that I began to get while still in the ICU and complained then, multiple times. I'm still complaining. The Surgery was supposed to be 3 days - I was in ICU for 10 days... something went wrong. The issue is the 2 year statue of limitations to sue the VA has expired and they don't want the headache of a long expensive claim process. My thoughts are many, it was June of 21, in the midst of Covid where appointments were taking 6 months or longer and with the Supreme Ct ruling on Chevron - could either of these be challenged to allow me to sue ? Another reason I think this should be challenged is the Dr's are in training and appointments are few and far between without Covid so why are Veterans being penalized for the problems at the VA ? This should be reason enough but what is the civilian statue of limitations, I can't find that data but Veterans should not be less then the civilians. I am now on multiple medicines for GERD, can't work most of the time and it is causing my service connected PTSD anxiety and depression to skyrocket. They now want to take part of stomach and wrap it around my esophogus to control the GERD they caused ?!?!? They ruined me for life !!!

I filed a claim for bladder cancer back in 2007 and was denied. I filed again after bladder cancer was part of the new pact act. I was approved by not back to 2007 but instead to the time the pact act came to be. Is that right?

I finally was able to review my records… I was denied service connection for Rhabdomyolysis …. The C&P doctor recommended service connection but VA rater denied it. It happened in 2019 do I have enough for a CUE based on these findings?
