As an Aussie I'm pretty cranky about this decision. We have really strict quarantine laws because of the damage that can be done to our flora and fauna. It can be devastating. Agree or not, these are the laws. Normal, regular people are often prosecuted with very harsh sentences and consequences for breaking these laws. Then someone like AH comes along and blatantly flouts our laws because she thinks she has the right to, couldn't care less about a place that has granted her entry, lies under oath in court when she's caught breaking those laws after completely disrespecting a nation and gets away with it. Makes me really angry because the 'normals' like me are treated differently. I'm always really careful when I travel internationally about what I bring home. I feel really angry about this.

Exactly. Even tho nobody was hurt, she should face the consequences of lying. Not prosecuting her will send the message that others can get away with acting similarly to Amber, feigning innocence. Smuggling things illegally into Australia that could “hurt” the ecosystem of our land is serious. That’s the whole point of the strict quarantine rules. I would have thought that especially knowing that this case is well known around the world, that the Australian government would have made a point of NOT letting this one get away. 🤷🏻‍♀️

I mean, did she get completely scot-free or is there still a chance there will be some repercussions for her should she decide to come to Australia? It's one thing to decide it's not worth it to bring her half way around the world and make her answer, but a very different one if she's allowed in again like nothing happened.🤷🏻‍♀

It is frustrating to me that more people aren’t held criminally liable for perjury when they blatantly lie under oath while on the witness stand. Doesn’t that undermine the entire purpose of giving an oath prior to testifying then? 🤔

While justice system is even more screwed up bc of this. Now that people aren’t God fearing as were when I grew up, not saying that was way to go, but see so many take their own word as if it means nothing.

Well a lot of it is the DA or prosecutors make up the story to convict you without a confession. Along with police and judges being able to lie to suspects or use false testimony to get them to admit to wrongdoing. So it’s hard to prosecute when everyone involved is capable & able to lie during testimony.

I despise our “justice” system. Police make arrests, but once cases go to court, many people get a proverbial slap on the wrist and are back on the streets. This happened last week near my work, a raid involved the arrest of multiple offenders who have been up to no good for a long time. Less than a week later they’re back doing the same dodgy deeds. Nothing changes here as judges seem to be afraid of being accused of being racist. I live in Australia, incidentally.

The Commonwealth Director of Public Prosecutions. The Prosecution Policy provides a two-stage test that must be satisfied before a prosecution is commenced: There must be sufficient evidence to prosecute the case; and it must be evident from the facts of the case, and all the surrounding circumstances, that the prosecution would be in the public interest. IMO there isn't sufficient evidence. After looking through Kevin Murphy's statement to the UK court regarding this matter, IMO there was no email proof that unequivocally notified AH that she was unable to bring the dogs to Australia and the ramifications if she did. Given also the false statements and blame game in his declaration to the Australian court, without his believable testimony on AH's personal knowledge, I believe she would have wiggled out of a conviction.

For Australia the cost to have her extradited and a trial would cost incredibly high. She is basically finished everywhere so they wouldn't really get anything out of it!! Plus, if she ever goes to Australia they can reopen the case!!

Hi Peter I am from Australia, you hit the nail on the head why Australia is not going ahead and charging Amber with perjury it will be the cost of getting Amber and witness back to Australia. I think Amber would have a hard time getting a visa to come to Australia if she wanted to come in the future. I remember case a few years ago a guy from O/S was going to be charged with hit and run because of a car accident he left Australia on his brothers passport. A few years later he came back to Australia because most of his family lived in Australia. When he got of the plane in Australia the police were waiting for him he was arrested and ended up in jail for a long time. Peter I know Australia is a nice place to live BUT yes we do pay TAX in Australia far to much tax lol If those dogs had been caring a disease or ticks etc that we don't have in Australia it could have cost Australia billions of dollars in lost exports.

I use to be a cop in Northern Ontario, Canada, and many of my colleagues purjured themselves in court on an ongoing basis; in fact, some of them broke into vehicles, planted drugs, to charge the individual(s) with trafficking, to be convicted and jailed, yet they were innocent.>>>>They thought it was hilarious! (No wonder people do not trust cops)

I am very disappointed to hear that Australia is not prosecuting AH for bringing her 2 dogs into the country. Johnny told her NOT to bring them. She knew about the 10 day Quarantine and that is very important to their Eco system... Amber knowingly took them to a groomers there as well... AH also threatened 2 employees of loosing their job unless they lied for her.... To make matters worse AH when back in Los Angeles got another dog and named it ~ Barneby Joyce to further mock Australia. Just unbelievable!!!

Oh people try to do it all the time and get caught - being an island makes it harder to get in without being caught. I think it is just a case of too long ago and too much cost to bring it to court - bet you she will be denied a visa if she ever tries to come back here tho

Here in Australia we pay plenty of taxes, personally I am happy not to charge a foreigner and then pay to incarcerate them. Better to just never let them come here ever again. Some may say Amber has got off scot free but she has burned down her life.

🇦🇺How can the Justice System improve when everyone committing Perjury is given a free pass? As an Australian, I'm very upset over this decision. If the Government want to spout about our "strict bio-security laws", then they should practice what they preach. The issue goes back to 2015, when the Liberal/National Coalition Governemt were in power. The Labour Party is now in power and wouldn't be as enthusiastic to pursue this issue. Amber did plead Guilty to lying on the paperwork in Queensland and Johnny fully supported her, even showing up at the Magistrate Court Hearing, when not necessary, in a limousine. They agreed, reluctantly, to make that pathetic 'hostage video' that was meant to be a deterrent to others, yet fell flat and made the Gov't a laughing stock. If we want to take our bio-security seriously, no matter which Political Parties are in charge, then we need to take advantage of situations where 'celebrities' are involved. That's what makes it newsworthy. Far too many are continuing to bring in bio-security risks, when knowing fully well this is illegal. Making Amber Heard responsible, no matter the cost, would go a long way in getting the message through to those worldwide. It will also make everyone more careful about lying freely on the stand whilst under oath.🇦🇺

While I'm personally disappointed that AH will not face perjury charges, is it likely it would have led to a conviction, and at what cost? The main witness, the estate manager, also perjured himself, but allegedly under coercion from Ms Heard. "In making this decision, our prosecutors must evaluate how strong the case is likely to be when presented in court.They must take into account matters such as the availability, competence and credibility of witnesses, their likely effect on the arbiter of fact (magistrate or jury), and the admissibility of any alleged confession or other evidence. Our prosecutors also consider any lines of defence open to the alleged offender, and any other factors that could affect the likelihood of a conviction."

Yet, when you get handed a gift like this to shout to the world how stringent our bio-security laws are, you have to at least have a go. It's already acknowledged that the estate manager was coerced by AH, which only goes against her, the one with no credibility. At least he actually manned up and told the truth. It would also go to setting a precedent for those who continue to bring in bio-security risks to Australia. Yes, it will cost much, but we have much to loose! We're still recovering from the massive loss of animal life and species made extinct from the year long Black Summer Bushfires. When this all happened, people the world over were damning us for Barnaby Joyce's stance for the dogs to be removed or euthanised. No-one gave a damn about us, yet lobbied behind Amber and Johnny, as he stood up for her. I don't care about her personally, as she's nothing to me and most of the world. I'm looking out for the country I hold dear and want an example set by going after this entitled screw-up who dared to ignore our laws. Pleading guilty in a Magistrate's Court is not a deterrent to anyone. Either was that ridiculous 'hostage video' they made. It did nothing! You never look a gift horse in the mouth and I think that using this woman to press hard to the world how strictly we are going to enforce our laws, then we should take advantage. We already have her admission of guilt and Australia does has an extradition treaty with Spain. With the years of investigation this has already taken, there has to be enough evidence to convict. She's admitted guilt herself, so why will it be so hard to gain a conviction? The evidence has already been collected. It's time we grew a pair and stood up for what we believe. If she was punished properly in the first place, I'd say to leave it be. Yet, she wasn't and needs to accept the consquences of her actions. I'm very upset at this decision, which has nothing to do with her, but Australia!💖

She offended against a senior right wing politician named Barnaby Joyce who was Deputy Prime Minister at the time. (She named her dog after him). They lost the election and the left wing Labor Government hates his guts and is certainly not about to fight his battles for him. So it's politics pure and simple. They would have to deal with FBI, get her arrested, pay for her to be brought to Australia, international lawyers etc etc etc. I would say she has provisions and I don’t think AH will come to Australia again as Australia doesn’t forget and when they say in this instance if she doesn’t comply they will re open this case.

A key factor IMO in whether the Australian prosecutors would have realistically obtained a conviction would be the credibility of the main witness. The estate manager also perjured himself, but allegedly under coercion from Ms Heard. Is he a willing witness and can the prosecutors prove the aspects of the case? "In making this decision, our prosecutors must evaluate how strong the case is likely to be when presented in court.They must take into account matters such as the availability, competence and credibility of witnesses, their likely effect on the arbiter of fact (magistrate or jury), and the admissibility of any alleged confession or other evidence. Our prosecutors also consider any lines of defence open to the alleged offender, and any other factors that could affect the likelihood of a conviction." Edit: I just looked through Kevin Murphy's statement to the UK court regarding this matter, and IMO there was no email proof that unequivocally notified AH that she was unable to bring the dogs to Australia and the ramifications if she did. Given also the false statements and blame game in his declaration to the Australian court, without his believable testimony on AH's personal knowledge, I believe she would have wriggled out of a conviction.

If you lie about another person and falsely accuse them of something, YOU should be prosecuted for the same crime as you accused them of. Or the same punishment they would have received/did receive. I wish this was the law.

I wonder what the possible outcomes would even be. I can’t imagine she’d get any jail time, so maybe a fine? If so, would it be a fine that was worth the cost of prosecution? Edit - researched this. Only two states or territories have financial penalties for perjury. The other five are jail time only, including Queensland which is where I think they flew into. In Queensland she could have faced a maximum of 14 years

And to be honest, I can’t actually find any statistics on whether Queensland has prosecuted anyone for perjury in recent times. I can find a bunch of stats at a national and state level, but none mention perjury at all. Not even in the description of ‘other offences’. Unless it’s in the ‘miscellaneous’ part of the other offences..

I’ve been rewatching some of last years Depp v Heard trial coverage by lawtube and there are so many questions are about whether she will be charged in future with perjury. Overall every says no, as it’s rarely ever charged. I never imagined that this would be more likely to be charged here in Australia when the accused isn’t even in our country

What is the point in court or anywhere to have strict laws on lying and bringing animals in illegally knowingly and threatening people to lie for you if nothing happens when someone is busted? Same with just lying under oath. It makes no sense. It happens to often in a lot of cases

I had a judge flat out lie in her decision, also she omitted information when stating her reasoning for her decisions... I know that even if i complained nothing will happen. Its made me very skeptical of everything. I hate liars!!

Does anyone ever get prosecuted for perjury? I've never seen it, but I've seen plenty of cases where witnesses lied under oath, including cops. If it never gets prosecuted, why is it a law?

The statement is from Department of Agriculture not from Department of Public Prosecutions that made the decision not to proceed. I speculate that the Department of Agriculture and the Department of Immigration & Customs might have wanted to prosecute Heard but DPP have final say. Heard tried to blame Customs officers for not checking their bags & being more interested in photos and autographs.

On your question about deposition and testimony. It's easy because testimony happens a good while after a deposition and people aren't computers and remember things verbatim. Depositions are really dishonest if you think about it.
