I went through a custody battle for my twin girls in so cal. Mom didn't want to give me joint custody but rather her have them and collect child support. I served her, went through mediation and then faced the judge and the judge granted me what I wanted, they were only 4 months old nd still granted me what i asked for. Soon enough she served me to reverse my rights, she lied and lied in her deceleration, our last judged past away so they assigned a different judge, again we went through mediation and faced the judge, the judge spoke to me only as she had a lawyer, ( both times) after she tried to talk the judge shut her up, yelled at her and once again I won my case. THEY are now 5 years old and I still have join custody, I don't know if it was luck, or things are changing now for men but I prayed and prayed and I believe God took part in what happend in that court room.

Or it was probably the fact that in family court you're not actually dealing with a judge you're dealing with a magistrate and magistrates have no power or jurisdiction to actually make a judgment. All they know is that every parent has rights and them not giving you those rights unless you're abusive to your kids the magistrate could get into some serious trouble. The magistrate is acting under color of law. Only an actual judge can make final decisions or judgments. The fact you didn't hire a lawyer probably helped you out a lot too. Being all lawyers take an oath when swearing in to abide by all FEDERAL LAW. Not constitutional law. Big difference in the two laws. When you hire an attorney you wave your constitutional rights and amendments. So it's never good to hire a lawyer unless they know some good loop holes.

You responded with words of support to a comment I left a while back about a high conflict custody case. I want to let you know, I won my case.... at lease the closest thing to winning one can have. Your videos helped me remove my own selfish agendas from the case and only focus on my child. If it was good for my child, it was good for me I thought to myself.....personal issues with the ex I left off the table and never went down that road....she did....and just like you said.. it wasn't a good look. When a parent says "my child is not safe over there" it is valid more often then not. Nothing to do with pride. Courts are behind the times when it comes to protecting children. Too often it's about working the calander/managing the case and not what is the best interest of the child.

And nothing happened to the other parent and I am still being denied access. Despite a final order granting me regular parenting time and 6 weeks vacation time.

you hit the nail on the head with the cell phones and the games played where if the child/Teen doesn't get her/his way.........Hey Mom, Dad's being MEAN. Come get me. And she does. Then the mom tells the court the child is not comfortable at Dad's house because he's cooking something for dinner that the child does not want. But does the mom say that's the problem? No, she just says the child is "uncomfortable" and the judge says ok then. The father is a threat to the child. This goes on in MA courts, I never believed it until I saw it. How can the father get vindicated? He needs so much help up against the wall of coached children who's mother undermines all authority and uses visitation as a tool to torture him.

My Wife's Alcoholism tore our Family apart. She had sex with a drug dealer in my Bed when I was in the hospital with my sick Niece. I finally pressured her into treatment for her to relapse 2 weeks after graduation. Multiple Police calls on her drunk around the Children, CPS, etc. She has been charged with Child Abuse twice. Convicted of Shoplifting alcohol last year. She just recently got Domestic Assault against me. I have a Protection Order now. It got to a point where I volunteered a CPS case. Now she is filing for Divorce??? Her lawyer is trying to paint me as a Domestic Abuser. I think I have a good case

If by "partner" you mean non-biological step-parent (married or not), then no - the partner has no right to see the child. Only biological or adopted parents have "natural legal rights" to see the children, and vice versa. Others (grandparents and other significant adults) may be able to obtain a court-order to establish some derivative rights for visitation. The specifics of each case greatly influence the possibilities. "Best interest of the child(ren)" is a legally-defined term, not a common sense term - and certainly not a child's perspective term (although there is typically an attempt to take the child's perspective into account).

You sound like me, my ex father was an officer, so he’s cool with the chief, the damn judge used to be his attorney for several years even recused himself and still made a decision on my emergency custody….remind you I have a restraining order on my ex for attacking me while holding out son and did I mention he has 3 open felony cases and restraining order violations and walking around free and dictating if I can move for me and my childrens safety I hate it here!!

I'm not in a custody battle, but my fiance is and I'm trying to be as supportive as possible because his ex wife is trying every way possible to take more time away from him. She is "disabled" yet goes on many trips that would deem her not disabled but anyways, she is very manipulative and will say anything to get her way and even so she goes to court with a walker and literally doesn't use one at any other time. I just wish it was a perfect world and they could both get 50/50 custody. He's an amazing father and I'm not bashing her one but, she is a good mom! She just makes things more about herself by trying to tale more and more time so she can feel like a winner. It's sad...I wish that things were better. Rant over

Keira Kagay please tell him to make a Constitutional argument under the 1st Amendment of the RIGHT to the care and CUSTODY of the child, it is an adjudicated FACT, look up the Supreme Court rulings. If he listens to an attorney he will get screwed. The statistics PROVE IT. also, tell him NOT TO CONSENT to child support, it is fraud and a violation of his rights. I'm not saying not to support the kids, I'm saying the government or a 3rd party debt collector has no right to make you pay.

She at the end of the first trimester and violated the court order due to her pregnancy and her doctor note it is in the best interest of her to not drive long distance with no reason mentioned. Is this reasonable that father does not see his child for 8 months.?

Yea my ex is best friends with our sons and let's them do whatever they want. Even to smoke those medical pens and other blunts. So I'm labeled as the boring , no fun guy parent. Because I want them to be responsible and be successful... She is a narcissist and is using my boys to be on her level of a ignorance..🤪

Live On Purpose TV I have children with two mothers and mom 1 didn’t start taking me to court until two years after splitting up because I was with mom 2 and she got pregnant. She took me to court 5 times to modify the custody agreement, each time over the pettiest of things and within 3 months of the last agreement we made in court she actually started asking me to take the children more often until she actually let them come live with me because of her work schedule and they wanted to spend the time with me and not a babysitter. The whole time going to court she tried to say how terrible I was and I just went in there calmly everytime and talked straight to the judge and did everything that was asked of me and in the end not fighting worked out for me.

My daughter is 14 years old and 9 months old, her dad doesn’t keep up with visitation time and he blames me that I keep him away from seeing our daughter. I don’t play mentally with my daughter like that, he abandoned her off and on he won’t call or text her for every few months. Last time he practice parenting time was July 2018 about a small argument. And he told her he will not pick her up anymore. Than few months later he texted her HI!!! And she didn’t reply back I asked her just say hi she said not right now I don’t feel like, I left her alone and have her the space. Few months later he texted again on her birthday he said happy birthday. She didn’t reply back and I asked her why she said I have no feelings for him as a dad. She said I’m not happy him, he doesn’t do one thing for me that I like to do or to buy. She said he’s always yelling. I know she not making things up bcuz I lived with him and how much he abused me and even when I was pregnant with him, he would abuse me, is that true yes it’s true. He is a very heavy alcoholic drinker. And he would drink and drive with me same thing he did with our daughter, and she said even his girl friend use to tell him can I drink since u had few alcohol drinks he would yell at her. I hired private investigator during visitation time. I took it to court and they gave him warring no drinking alcohol during visitation time and our daughter said he still drinks and drive with me. But I couldn’t afford to hire private investigator I told talk to him about it he said our daughter is lying and she swore that she was not lying. On December 2020 he filed a case to go back to visitation time the judge gave him every other weekend besides asking him this is last time I want to see this case in my court and keep up with visitation time. Now the problem is our daughter is overwhelmed and doesn’t want to to spend the night at his house. I told him reduce the visitation time till she gets adjusted to this again bcuz u keep abandon her for long time. He went and filed show case that I’m not allowing her to go which I didn’t. He picked her up during visitation time and she didn’t ride with him. She said I’m not happy to come with u. Any advice? Please thank u.

Have your daughter write out her experiences and feelings on her own. Then if you need to go to court, she can go with you and answer questions.

My child is allowed no contact with me.She is 10. Her dad and I successfully co-parented for 5 1/2 years, went to court, lied like the devil. I said if they give him primary custody, he would cut me out. He did that. Nobody cares about him committing perjury. I am going into 6 years fighting for my daughter to be free to enjoy close and continuing relationships with both parents again. I have no animosity towards her father. I can't believe how he has manipulated the court. He had a lawyer from the start and I didn't. My daughter basically got sole to the highest bidder. I followed court orders I didn't believe should have been issued. I trusted the system. I treated others the way I wanted to be treated. My daughter's dad gets away with all kinds of terrible things and our judge is biased and interfering with my appeal of her order.

j nolasco, I am not sure if you are talking financially or emotionally. You have a financial obligation to support your child. The situation may be temporary. Try sending them cards or texts or emails letting them know you are thinking of them and open to talk. It may take a while for them to respond. Don't give up.

When my husband and I divorced ( and it wasn’t a pleasant separation) I’m so grateful that regardless of how much either of us were hurting we put the love we had for our children, first. We were not going to allow a court to decide how much either one of us would see our own children. We did have a schedule, but it was flexible. There was never a “ no, you can’t go with dad today, it’s not his day” BS. We used a mediator, not a court and I wish more people had that option or went with that as a solution. Our boys are grown now and have thanked us up and down for managing things as we did. Now that we have grandchildren, I’m so thankful we can attend family gatherings together ( I’m remarried) and our kids and grandkids don’t have the uncomfortable task of having two events and can enjoy their entire family.

My issue is I've never been married and my kid's mom doesn't want me to see nor have my kid at all for any reason and I've never done anything for her to be acting like that. I'm in ohio and it's a mom state even if they're on hard drugs. The system here is the worst in the world. I'm worried the judge will be a woman and we know how that goes(never fair) plus her family knows everyone in that little town.

This is great advice! I have heard so many horror stories about disastrous divorces. My ex and I consulted an expert on how to prepare our children for the breakup. We also used third-party mediation, and that made a HUGE difference. We saved money, and we remained civil. Too often lawyers tell their clients not to talk with their spouses or do any negotiation on their own. I think that is a huge mistake to cut off our conversation and communication. Attorneys look on a divorce as a battle to be won rather than a puzzle to be solved. My ex and I still argue about stuff, but we don't FIGHT about it. We also try to remain flexible with respect to vacation and family gatherings. And, we put the well-being of our children first.

Many times I thought the mediator was biased in favor of my ex-wife, but she thought he was biased in MY favor so I think that means he was doing his job correctly.

The first rule is why my ex lost custody. She moved with our children, 1,250 miles away. I didn’t see or hear from the kids for 74 days. I hired an attorney and she had to fly back for court. The judge switched custody. It was the best day of my life.

I know of a situation where the kids were afraid to go back with one parent, due to their heavy handed tactics in disciplining them (excessive yelling, swearing, and threats). Not spending time with the kids, and asking things like if they preferred play time with that parent, or for said parent to cook and maintain the home for them. And, also, for allowing their significant other authority over the kids, to yell at, make disgusting jokes (mocking things the kids love), and to be involved in correcting them. The parent I know withheld the kids, after one of the children expressed desires to self harm. All kids said they didn't want to go back there anymore. After a while of withholding them, the kids started to miss their parent, though there were phone calls allowed between them. Now, my friend has hired a lawyer and started the process for court involvement, but is afraid to send the kids back beforehand. And courts are very backed up because of Covid. They fear retaliation, either on them, or on the kids, for having spoken up to people about the issues. The kids aired their grievances to counselors and CPS. It seems that things are trending to trying to maintain shared custody. A very hard situation to watch unfold. And the stress is slowly killing my friend.

Here is a peculiar case for y’all. -Frankies son is now 9 and only recently learned that Frankie is his real father. -Frankie been paying alimony all this time. -State of Texas ruled that Frankie is to have his son for the weekend twice a month. -Court of the glorious state of Texas has no power over the Republic of Belarus, where the mother took off to 8 yrs back. - Frankie can’t enter the aforementioned republic, because ex nullified his parental rights in the court of Belarus and Frankie can’t obtain anything but a tourist visa which would be lying to the visa officer of Belarus.

@@LiveOnPurposeTV IT is a tough one indeed. I wrote this primarily to show that sometimes situation is so dramatic and unusual that all you can do is help that dad to calm his pain. After learning what happened to this man, I went online and learned that this problem (separation by border) is not unique. There are many cases where both dads and moms lose any ways to contact their kids due to international kidnapping by the spouse.

I am looking for help with this issue. I now have over 6 years about of proof of my ex wifes deliberate attempts to keep my from seeing my daughter. We had a court order, that she refused to follow, which I have proof in the form on text messages, emails, online communication through our family wizard, and talking parents. The problem is my income has been such, because I lost in court to reimburse costs that were already denied 2 times prior, because I had no paperwork on that date due to my 1 lawyer I had enough money for to hire, refused, and still will not give me copies of my file, which pissed the judge off cuz he thought i was lying I guess, that I can not afford a lawyer now, and it has built up to a massive financial burden to even try to get help from any service or lawyer just to fill out papers. All I need is a pro bono lawyer that will help me fill out the papers as now I am so overwhelmed I am not sure where to start. It is insane the amount of times she refuses to follow the order, I filed contempt charges years ago but did not fill out the paperwork right and her lawyer demur it and it got thrown out. I went through 5 supervisors trying to get her to show when court said I needed to do 10 visits. She refused to even respond to them for over 18 months, in which my old lawyer has proof. I hope anyways. I have evidence she lied on court papers to get a TRO, lied about why she did not come to visits or why people could not supervise anymore, she bribed me at one point to sign away my rights. I have begged pro bono services to help with no one returning calls or not getting back to me I am guessing because it has just become a mountain of issues. I know for a fact though if she loses the contempt, which with all the proof I have I do not see it possible for her to get out of this, I can get lawyer fees, and she makes more then enough money. I am here because I am desperate. Please any help you can give I will take or advice. Thank you.

Hey Rocketman, my ex did the same thing to me. They both just vanished without a trace. A co-worker of mine, told me that my daughter is in the same class as his kids. I went to the school to find out what was going on, they wouldn't let me see her, because the moms boyfriend at the time was listed as my daughters father. The next day I was served a RO by the police on the grounds that I was stalking my daughter by going to her school. That was the beginning of the nightmare that robbed me of my daughters childhood.

Sometimes being quiet is the answer. Sounds like the other person is looking for a reaction to maybe use against them. Remember, the child is the important one in the relationship. What do I do if I know that there is domestic violence in the other house in front of my kids where it goes as far as a knife being involved? My children come home and tell me how there's constant fighting. I told the cops, my lawyer, the law guardian but for some reason if his girlfriend won't admit to it (which I know she's scared because I was to when I was with him) they can't do anything because there's no proof. My kids keep telling me but I feel helpless. I'm their mom and I should protect them. But no one can help me. They keep telling me but won't tell anyone else because they say their afraid of their dad. Without their testimony and his girlfriend's testimony they can't help me. It's just hard to constantly hear it and I can't do anything. What do I do?

Tina Gonzalez, this is one of the hardest situations that I can imagine for a parent. Get clear on what you can and what you cannot control. Be there for your kids, like you are. Listen to what they have to say and be empathetic. The time will come when the girlfriend or the kids will decide they have had enough, it happened with you. This is difficult.

This may be true in the US. This approach doesn't matter at all in the UK. After told these secrets by judges in hearings and witnessing the law degree level of professional gaslighting by barristers and social workers over many years of court cases, I'll share it with you. In the UK the welfare and best interests of the children involved in the case aren't really of any importance. The court secretly puts the resident parent at paramount priority. Their logic is that the happier the court makes her, the less distressing and traumatic she might be against her own children. Also the longer her false allegations are entertained the more money all the key law professionals, witnesses and court appointed child service makes. Whichever parent is happiest to steal money from their children to give to law professionals the better they fair in UK courts. So even though preference is favoured for abusive resident mothers the Father could potentially be the family destroying plotting resident parent. Child abuse in the UK is a multi-billion pound industry for family law courts maximising profit while minimising do diligence

I can tell you from experience that how you phrase this to yourself and others makes a big difference. Your ex may be Narcissistic. However, they are still your child's parent. make your focus on your child having two parents, always. "Exposing" them by pointing out their flaws (saying things like dangerous, self absorbed, abusive) is the type of game they are OK with playing because they are likely much better at it than you. It takes the focus off of where it belongs.

Ok, all valid points, however, explain to me these outrageous child support payments when you’re following all of the above. Why does the higher my income the more I pay? I understand the child has grow up healthy protected and sheltered, but from $1000 to maybe over $5000, it’s outrageous

christopher brabham, I am not sure what is happening so I can't explain it. Ask your attorney to explain how it happens, he probably knows the law related to the support and how it is calculated.

My ex and I aren't divorced yet. We've been separated for over 5 years. Neither of us can afford a lawyer to get divorced. But qe get along. Our child stays with each of us on certain days. We both take care of our child. And my ex and I hold no grudges against each other. We fell in love. Then the love drifted away. And as soon as there was a sign of things getting bad, we called it off. No point in dragging it out and making things worse for everyone. So yeah, now I'm a better person because of the situation.

2 kids 2 ex wives. they collaborated and sharing information. I haven't submitted anything negative about them and all they do is rip me apart....well their lawyers do. I represent myself, trying to not lower myself to their level. but it seems to be the norm to attack the image or person on the other side. I'm just trying to get time with my kids, i don't want to hurt their mothers in the process. But they feel it is an attack on them by me requesting 5 weeks out of 52 weeks of time with each of them. I don't get it, i'm exhausted and really about to give up because of the barriers these lawyers keep putting up for them. I won't though. 2 years ago i got screwed because the lawyer made the system work in a way that i only had 16 hours notice of the hearing. i was served with over 200 pages of proceedings in which i thought a decision was already made by the judge the way i was given the information. almost 3 years later, i snap out of it and re-read everything and see how they purposely did it to me. So now I am fighting back. Hanging in there.

It also depends on the judge. I know of a case where the father calculated his child support based on the New York guide lines and paid it every two weeks without an order. He recalculated it every year. I convinced him to stop paying in cash and to pay by check and write "child support" in the memo line. This worked fine for years until the mother applied for welfare. When she applied she lied and said she never got one cent in child support. When she went to court she claimed again, she had not received any money. The father had a box of cancelled checks proving he had been paying child support for years. What did the judge do? She recalculated the child support and said the father was delinquent and owed 18 dollars. The mother lied to welfare, lied to the court, and she had no consequence. This was a small county and this judge was known to be completely unfair to fathers in custody, child support cases.

My husband and i had an abusive marriage. I divorced him because he was sexually abused by my husband while in the bed with my children. I want him to have visitation but i also do not want over nights. I have a restraining order with supervised visits. Do you think this will suffice?

What do you do when your a grand parent that's put in the middle of two bad parents. My pre teen grand kids are being sexually permiscuous and no one knows what to do about it but ignore. Suggestions of counseling is being ignored. The kids are losing all trust and respect for mom and dad because they hate each other. Always telling the kids to hold their slander comments secret but back stab each other to kids daily.

My case of custodial interference was so bad that I was told the Custody Evaluator, Reunification Therapist, and the Judge had never seen anything quite like it before in terms of severity. It took over 4 years in my case and I will admit that 50/50 custody at the end (after almost none for years) was a bit of a shock not only to me but seasoned professionals as well, given my ex's verifiable behavior. BUT. HERE'S THE THING. All of these things are still helpful. Don't try to control things you cannot control. (Like the judges, your ex, evaluators.) Control your own behavior. PUT YOUR KIDS FIRST! I also know this judge dealt with more than one case of parental kidnapping and my ex's lawyer showed herself to be really aggressive, to the point an appellate court slapped them on the wrist and as seasoned family attorney believes several of the things that were done are potentially sanctionable. Best interest of the child also includes not potentially being kidnapped or worse. Is it a perfect system? Not by a long shot. But I am among many people actively involved in improving things. I believe the arrangement I have is much better than I might have gotten even 10 years ago. I stand on the shoulders of those who were strong enough to get involved with change and listen to common sense tips like this as a foundation.

Hello... I go by Peanut. I just turned 13 and I want to live with my mother. My father is very intimidating, and he scares me. Though he's never hurt me, I do believe I'm going through mental abuse. I went to a Psychiatrist(think that's it.. the one that prescribes medicine) and had a breakdown the first day because I was talking about all things I'm going through at my dad's. I want to know if, since I'm 13 now, am I allowed to speak in court? If so, will my opinion matter? If I asked, could I talk privately with the judge? I'm scared that, if I go to court then because I'm intimidated by my dad, it will affect what I say there. Meaning, I won't say what I really think. Can my opinion help my mother win custody? Follow up question... I have a 10 year old little brother. He also wants to live with my mom. I love him, and I don't want to be separated from him. If my mother were to win custody over me, can I speak for my brother, too? I'm really scared and I don't have anyone I can ask about these questions.

Hi Peanut - thanks for watching! Unfortunately I can't specifically answer all of your questions here because each case is so unique and each locality has its own rules and laws. Probably the best you can do is to keep those lines of communication open with your parents. They will get caught up in their own concerns and issues, so you may not get exactly what you want, but whatever happens you can find a way to handle it. Wonderful video thanks... My problem is now that he had involved the courts in controlling our child... How do I get the courts to not take me for granted as he does... I don't file papers as he does for everything however he always lose...I have been trapped I he and the courts web if it is fair then I should feel some benefit... I don't have a personal lawyer to explain to me validity so I keep pressing on... I am 49 with an 11 yr old and between the two I am tired... He has his court order and has never followed saying they can't tell him what to do which leave me stressing over all that he does and don't I would be in court everyday...nothing has help my child which I thought was in the best interest... Since he never molested her anything goes... She comes home a mental wreck most visits... Her goes my Christmas stressing because as usual he's not going to pick her up as order so there goes my plans I made with my now 18 daughter because I have custody and the courts can't make him come get her if he doesn't wants to... To think they have controlled me for 11 yrs now I say but what about ME.🤔🤔🤔😭😭😭

In Sweden it's ok if the mother does all these things. It's incredibly biased against the father/men and much like a feminist GDR. The mother can safely procude false allegations against the father, for example accuse him or sexual abuse of the child or of her, or of beating her etc.. - and he will be prosecuted without evidence. In Sweden hearsay is counted as evidence so good if she just tells a friend and the friend will automatically be a witness. Two friend = two witnesses. I discovered this the hard way. I have managed 50 % time with my daughter but am contunuously fighting false allegations by the mother who is a covert narcissist. She didn't fool the custody evaluator (thankfully) but she can fool the police and prosecutors.

This comes late for some. I am not convinced the system, by that I mean Judges, social services, Guardians are bothered. about the child. They system helps to discredit parents ability to look after their children and it sticks. My grandson lived with his mother with no issues. His father ( whom was domestically violent to his mother and his mother ( who worked for local authority was favoured more than his mother, who cared for him single handedly from birth until seven years old. The lack of factual evidence, was beyond us and how keen they were to accept hearsay was another disbelief . There is no hope for the poorer people of this society. It is a two tier system and you are lucky if you get any help in it. Please look at my channel. It is called My grandson, his story, child without a voice . Thank you.

My grandkids are in foster care and have been since last July. They have a GAL that has only met them once and claimed my daughter has traumatized them. My daughter has a KZbin account that shows that’s an absolute lie. They’ve done absolutely nothing toward reunification and her lawyers keep refusing to take it in front of the court. Now they’re asking her to do things that they know are absolutely impossible for her to do. Please someone help her. We can’t afford a lawyer to help us 12:02

Second, no one in the court building cares, they just expedite cases, to get $! Third no one seems to care about the children's futures, I live in the real world where AFTER these decisions I see the WASTE of the children's lives, which helps the system u worked for anyways, children have to continue in the training they were receiving and if they don't THEY lose, so how is it that U CARE about the children when u don't want to hear truth. It's just creepy to leave your FAMILY FUTURE in the hands of people who don't even seem they love GOD, but want to play as if they were. This whole video seems creepy when it's actually YOUR children, the whole system seems creepy, when you can see it's just another day at the office.

My son's father's girlfriend has been pushing him down throwing him on the couch terrorizing my son the attorney referee won't change the visitation so she can't be left alone with my son we have not even been in front of a judge yet it's been 2 years

What if mom is attacking step mom. Because, School and government has sided with you. Because, Step mom has done everything that mom is supposed to do. Mom was barely present and could never fulfill her court agreement. As in the days to keep them. We had to file emergency custody order. As for. The last time mom had kids. Kids saw drugs being handed out. Our attorney and CPS all said we should not return the child.
