PD 1529 - Property Registration Decree
Section 109. Notice and replacement of lost duplicate certificate. In case of loss or theft of an owner's duplicate certificate of title, due notice under oath shall be sent by the owner or by someone in his behalf to the Register of Deeds of the province or city where the land lies as soon as the loss or theft is discovered. If a duplicate certificate is lost or destroyed, or cannot be produced by a person applying for the entry of a new certificate to him or for the registration of any instrument, a sworn statement of the fact of such loss or destruction may be filed by the registered owner or other person in interest and registered.
Upon the petition of the registered owner or other person in interest, the court may, after notice and due hearing, direct the issuance of a new duplicate certificate, which shall contain a memorandum of the fact that it is issued in place of the lost duplicate certificate, but shall in all respects be entitled to like faith and credit as the original duplicate, and shall thereafter be regarded as such for all purposes of this decree.

AN ACT ALLOWING ADMINISTRATIVE RECONSTITUTION OF ORIGINAL COPIES OF CERTIFICATES OF TITLES LOST OR DESTROYED DUE TO FIRE, FLOOD AND OTHER FORCE MAJEURE, AMENDING FOR THE PURPOSE SECTION ONE HUNDRED TEN OF PRESIDENTIAL DECREE NUMBERED FIFTEEN TWENTY-NINE AND SECTION FIVE OF REPUBLIC ACT NUMBERED TWENTY-SIX
Be it enacted by the Senate and House of Representatives of the Philippines in Congress assembled:
Section 1. Section 110 of Presidential Decree No. 1529 is hereby amended to read as follows:
"Sec. 110. Reconstitution of Lost or Destroyed Original of Torrens Title. - Original copies of certificates of titles lost or destroyed in the offices of Register of Deeds as well as liens and encumbrances affecting the lands covered by such titles shall be reconstituted judicially in accordance with the procedure prescribed in Republic Act No. 26 insofar as not inconsistent with this Decree. The procedure relative to administrative reconstitution of lost or destroyed certificate prescribed in said Act may be availed of only in case of substantial loss or destruction of land titles due to fire, flood or other force majeure as determined by the Administrator of the Land Registration Authority: Provided, That the number of certificates of titles lost or damaged should be at least ten percent (10%) of the total number in the possession of the Office of the Register of Deeds: Provided, further, That in no case shall the number of certificates of titles lost or damaged be less than five hundred (500).
"Notice of all hearings of the petition for judicial reconstitution shall be furnished the Register of Deeds of the place where the land is situated and to the Administrator of the Land Registration Authority. No order or judgment ordering the reconstitution of a certificate of title shall become final until the lapse of fifteen (15) days from receipt by the Register of Deeds and by the Administrator of the Land Registration Authority of a notice of such order or judgment without any appeal having been filed by any such officials."

Correction. Contrary to what you said that you can't settle estate if you don't have the original title, you can actually settle the estate tax. You can't just transfer ownership.

What I said was that it would be difficult to settle the estate without the title. Because it is through the title that the heirs would be able to ascertain the existence, extent and ownership of the property and, usually, the possible liens and encumbrances on the property. Morning attorney. I bought a land in 2010 when we bought it they owner did not give me the title his reason was he needed to sale 10 more land before he can give me my title in the mean time the owner is paying the taxes until he is giving me me the title. Hi Po! Nawala po ng RD ang titulo ng lupa namin. They said judicial reconstitution po daw ang dapat gawin namin ( very unfair since sila nakawala). Sabi nila administrative lang daw po sana kung walang annotation sa likod yung titulo namin. Question po, dating nagkaissue ang lupa namin, pero nanalo kami at umabot ng supreme court. Ask kolang po, is there a way na maging administrative reconstitution nalang ang dapat naming gawin? Ang mahal po kasi.

Atty. Ano po ang magandang gawin sa problema ko, binayaran ko kasi ang lupa bago ko pinagpatayuan ng bahay sa lupa ng bayaw ko kapatid ng misis ko pero walang kasulatan. Syempre kahit sino naman ang bumili kahit magkakapatid pa yan at iisang compound gusto ko ring magkaroon ng title para naman maipangalan ko sa anak koo ang lupat bahay pero nong kinausap ng misis ko ang kapatid niya tungkul dyan ang sagot hindi na raw kailangan. Bf nasa Amin po ang original copy ng titulo namatay na po yung tatay we heard na nagpapagawa ng bagong titulo yung isang anak dahil they lost their copy which is they know that Naka Sangla sa Mom ko . Hello po. Tanung ko lang po, ano po ibig sabihin Ng judicial form no. 140 na nakalagay sa title. Masasabi po bang original copy ito. At safe po ba bumili Ng lot pag ganyan ang tittle.
