@@jillianmizzen8850 no , a few years before by dad passed he wrote up a simple will , he had about 500 k in cash in the bank and never did a living trust and it worked out fine , no probate either because a year before he passed he put his children on his bank accounts as joint account holders . this experienced lawyer was mostly correct . this plaintiff only had ONE real asset , a house , and u dont really need to go though the trouble of trusts or probate if its just a house or less than a million bucks . he was right .

Not true about only needing a trust if you have a large amount of money. Not sure about all states but a Trust avoids probate. If you have real estate, definitely put it in a trust and the deed gets changed to the name of the trust. Now I believe it’s possible to pass on the property tax rate to children if they are named on the on the deed to avoid property tax reassessment. Tax laws keep changing so best to check with a CPA and an estate planner. I’m sure this is state dependent as well.

this experienced lawyer was correct . the simplest way with less than a million dollars is to simply have a will and add the names of any beneficiaries to your assets before u die and then everything will immediately go to the beneficiaries without probate .

She should have placed the property under a trust with her children as her successor trustee’s and beneficiaries of the trust. This would avoid them having any complications with being owners by simply placing them on the deed. Having the children inherit the property via a will is also still a process once she passes that can be avoided with a trust. Any knowledgable attorney/financial expert/ estate planner etc could have advised her of this, him mentioning unless she has 2-3 million dollars there is no need for a trust is false especially since he mentioned she has other properties as well.

no , this experienced lawyer was correct . if there is only one asset involved and its less than a million dollars then trusts and probates are overkill and not necessary . a simple will and the adding of the names of the beneficiaries onto the deed , title , or bank accounts before death is all that is required for the beneficiaries to immediately inherit assets after the parents pass away .

Doing a Transferable upon death for home deeds makes so much more sense to me. You don't necessarily need a lawyer to file these for you. Having people added to the deed, aside from spouse, is something I would never do. So many things can go wrong especially if you're an older home owner.

what that second attorney said to her is true; do not put your children on the deed. What I found out goes with something dealing with a "tenent" situation....i can't remember. dang, I can't remember. My biggest concern for her is, in case she decided to get married to again and she passes away without a will the house will then go to the husband and not the children. Then when he passes away, he can be slick enough and passes it to his children; and now they lost their mom's legacy for them; even though she doesn't care what happens to it.

Don't quote me but, I think I've read that adding names to a deed means those added then inherit the property at original value and therefore pay much higher capital gains when they sell. Whereas, if they just inherit, they do so at the current market value and so have much lower taxes. That's the main reason not to add a name to a deed but to a will, instead.

The plaintiff initially presents as fairly sharp and on top of her game. But it quickly becomes evident that she has some degree of dementia, poor lady (hopefully her POA is for financial as well as medical matters). The defendant looks pained; it must be difficult for him to see his long-time friend losing it.
