Encouraging info on the Fiat! Like your policy on sending sold cars out with some fuel but think this is quite rare. Most cars I've brought have had pretty empty tanks when I have picked them up so finding a petrol station in an unknown area is often the first challenge!

I know some dealers who take the risk with distance selling, even with the best cars it's just not worth it. There doesn't even need to be a reason to reject a car. I believe if you don't notify a customer of their rights to reject, this period extends to twelve months, and you must to put them back to their original position. Trouble is the law doesn't take account of dishonest customers. A dealer near me sold a car to someone over the phone, had it delivered, and the customer used it to go to Scotland and back, then rejected it because they didn't like it.

Just done another refund bud, 64 plate corsa diesel, now it's turned cold it's slow to start sez the customer, its no good to me he says, it smells (it's a diesel) anyway I said let's cut to the chase I'll give you your dosh back, as soon as he'd got his money back he started telling me what a good car it was, bizarre, he was then on about had I got another similar car, I said I didn't want to deal with him.

Strange , Distance Selling Regs, reject for any reason but I think it is return to sender and return cost is only if defective (and reasonably known to be defective) at time of sale ? check with black belt barrister as what recompense has the dealer against previous servicing ? did dealer arrange the finance ? sadly the way the system works means its open to abuse by dodgy buyers, sounds like someone has got a year and a half of free motoring and will probably do it again, the biggest issue is when this crap becomes common knowledge then everyone starts doing it, as a dealer you walk a very fine line, i used to deal in cars many years ago, but today's laws would terrify me, you are damned if you do and damned if you dont, you can kind of understand why there are dodgy dealers around.

Just been checking the gov.uk website, etc. Consumer Rights Act 2015 - customer can claim various remedies when goods are faulty or not as described. Providing your mate did not describe the body as being in perfect condition there's an argument for fair wear and tear - needs a solicitor who understands commercial law better than the judge. Also, modifying a purchase (eg taking the bodykit off) could be argued as implying a customer acceptance. When's the Ssangyong coming back?

I love cars and buying and selling (privately) has been part of my life since 15 years old...But all this nonsense with distance buyers ripping the car apart then rejecting it...18 months after sale being forced to take it back!!! Thats why i walked away from it all. I just trade in my cars now (at a huge financial loss) and buy from whoever seems to be the most legit fir what i want...i.e. I bought a 4 year old Suburu from a local main agent who was fantastic. I sold it back to him 5 years later for peanuts and bought a cheap run around private. The cheap run around was the third vehicle i looked at of the type as i didnt like/trust the private seller. If i feel they are sketchy...They ARE sketchy and so is the car.

I bought a car before, from a main dealer "Bristol Street Motors". The test drive was literally about 20 minutes and we only went on B roads, the salesman said he'd put fuel in as it was almost empty when we went for a drive so he put £20 in it which barely did anything. When I got it it had less than 1/4 of a tank and stupidly I part exchanged it for an older Mercedes C220 which I gave to them with just under a full tank of diesel! Feb this year the Focus ST I bought from above said dealership went bang... the engine exploded. Was going to cost me in excess of £5k for a replacement engine and labour. Sold it to co-part for £4k. Annoyingly i'd just had a brand new set of 4 Bridgestone Potenza Sport tyres put on it, less than a month earlier.... just shy of another £550 down the drain. You could say i've a habit of doing myself over.

The only wrecked engines I saw were from no maintenance or hydrolocks in floods. They weren't really any worse than the other manufacturers. I know some engines are weak in certain circumstances in many makers. I too have a new set of tyres on a car that barely runs tho. It pisses me off seeing them wasted. I was on a dual carriageway doing about 70mph, loud bang and a horrible shaking sensation from the car as it ground to a halt, there was no hard shoulder so I ended up having to stop in a live lane. Eventually a police patrol came across me and sat with me for hours before they recovered my vehicle (as the RAC had nobody to send and myself and the officer waited 2 hours already for them). Got it picked up the mechanic said there was "more out of the engine than there was inside it". A rebuild wouldn't suffice and it would need an entire new one. A used one was anywhere from £2,000-£3,000. Plus a good 10 hours+ labour easily £1,000-£1,500. He's a family mechanic we've known for years and not in the business of ripping people off, but even he said there's no guarantee any replacement engine will work fine and if it's fitted, and then there's a problem, the engine has to be removed again which of course makes sense. To rub salt into the wounds... about a week after the engine blew, I then got notified of a claim against myself by my insurers... by who? Highways England. they turned up when called by the officer to clean up the oil that had leaked from my engine when it exploded, oil had gone across most of the 1st lane of the dual carriageway. 10 months later my insurers still haven't settled their claim (I was told they were only claiming for about £250 for the 'cleanup'). Luckily I had a protected NCD but i'm test driving a BMW 335D in 5 days and it's increased my insurance premium by £85, by just declaring that one claim even though NCD wasn't affected. Irritating! Wasn't my fault the engine exploded on me and yet I get a claim for a highways cleanup crew who I didn't request. I assumed they were paid for by Road emissions fund, taxes, etc... never knew they claimed on driver's insurance policies!

James maybe you can help on a problem my son has with his car he bought in end of April 2022? He bought a Fiesta 1.6 petrol from a dealer had it for around 3 weeks on the road, it then developed a missfire ! granted he had purchased a warranty this I feel should be covered? The dealer told him it was the air con and a radiator fan!!! Anyway after around 5 months in which my son could not use this car !! the dealer looked at it a said the head gasket had gone, but the amount to fix this was not covered under the warranty, but it was done anyhow under durress I may add. My son has at the end of November had the car returned to him. Now 10 days after this the car has started missfiring again and the coolant has drained away from the header tank, we have had it diagnosed and its come back with a code stating that cylender 4 has a problem. He has contacted trading standards all the way through this problem for months now (they told him he must give the dealer fair chance to repair) he has contacted trading standards this week and he and them have contacted the dealer who has not returned to them. Makes your friends case look good don't you think?

Sounds like it could have a crack in block. When a head gasket is done and it still leads the same issues (assuming the head was skimmed and they did not just put a new gasket in) it is normally the block (again assuming radiator is ok). So in the this case the fault was present within 6 months and the dealer did a repair to resolve. Even if the ownership now exceeded 6 months there is evidence that this fault existed within the first 6 months and was not resolved.. The Dealer had 1 chance to resolve the fault. As the same fault has come up again (missfire) and his first diagnosis was wrong you have a right to return for refund less a reasonable discount for the use you have had. Especially if its for a Accident Management Company. High labour rates allowed, vehicles usually "unroadworhty" when a Credit Hire car company has instructed them, to "assist" in justifying hire.

Doing finance is OK, but customer still thinks its your car, like their hiring it for the 36,48 mths, never mind a basic 6 mths warranty period, its probably OK on a 12 mths old car but offering finance on say a 12 plate is asking for trouble.

I've direct experience of rejecting a vehicle, if the vehicle was delivered and is rejected as part of the sale dea, Then no matter the distance it is the sellers responsibility to collect it and at the seller's cost. The process of rejecting the vehicle should not put the person rejecting it out of pocket. In my instance the car was not as described with several major mechanical isues and I got refunded after sticking to my guns. All this being said the vehicle should be returned in the condition it was supplied in. Personally If I were Royston I would pursue the cost of refitting the body kit via the small claims court.

I disagree completely. I totally believe they should be out of pocket for a simple change of mind etc it was their decision not to make the journey, why should someone else pick up the tab. Don't forget the law allows them to reject for ANY reason within 14 days so they could just not like the colour. Different matter of course if not as described or faulty.

I get your point however how many customers reject for a change of mind. If they have documented evidence of a of a mecaanical defect from a reputable third party and are within the initial rejection period then the law is firmly on the customers side. Like I say the car should be made available to be collected with the body kit back together but the cost of the return can't be the customers.

This was a funny one mate, they came for the car so it didn't come under distance selling regs, they were happy with it initially but took it to a garage for a check over, the garage took the plastic sill covers off and found corrosion on the sills, obviously that's a big no, no, with the covers on it couldn't be seen, covers off, corroded sills, mot tester didn't see it, neither did I, I offered to refund it St away, but they were on the Isle of Wight, 300 miles, I refused to go for it, I offered to pay any Garage they liked to repair it, but customer just refused, so I stuck to my guns but the judge had no idea of cars and just said there's a fault customer can reject, he did side with me tho over that she was trying to claim a grand over the purchase price, basically I'll refund her, pick it up, 300 miles away, get it welded up and re sell, tbh at the end of the day rusty sills are a big no no, but you don't start removing parts to check and tbh your not really looking for rusty sills these days, basically I'll steer ckear of jlr products as we've got a 61 plate freeloader in limp mode and a 16 plate one with a duff chain, there a lot of trouble, tbh selling a car with rusty sills is more or less a criminal offence, so probably got off lightly, a trader who sold a rusty vw camper got 6 mths porridge.

I’m curious under what circumstances was the dealer forced to take the car back after 18 months? Don’t think there is any valid argument for that, even in a court.

If the dealer arranged the finance then the finance company could threaten to remove his finance facility and if the customer stops paying then any commission paid to the dealer for the finance is recoverable. Blackmail really unless there was another reason.

@@RonSeymour1 yes but the finance company is financing the car towards the customer, goes under the same consumers act, states very clearly on any agreement between the finance company and the dealer that the car goes under the consumers act, it’s not like the credit act were the consumer being the customer can claim up to 6 years the money back if the vehicle goes wrong. The deal between the finance and the dealer goes strictly under the business to business deal, legally the finance company have no power over this after the 6 months have passed, unless it can be proven that the car left the dealer premises with a known fault and the dealer has willingly hidden it away.

@@RonSeymour1 the dealer only introduces the client to the finance company, we don’t arrange the finance, that is up to the finance company to decide whether the client is eligible or not. The finance company can remove the finance facility but they can’t cancel my FCA license or ask for the commission back. Just because the customer refuses to pay after 18 months due to the being broken is the customer that is breaking the agreement with the finance company. If the customer shouts his consumers act rights out he should also know that buying an used car has it’s risks and also as the car gets older and lower in value there is a fair wear and tear section for which legally the dealer has no obligation to cover it. So in this situation I would say to the finance company to F off and deal with the situation themselves, if they want to remove my facility with them, they can also F off as there are plenty of brokers out there

@@cartradediary6131 Things may have changed but about 20 years ago I worked for a small, one-man band, finance brokers. He arranged finance for local car dealers. A lot of the dealer's customers were high risk. The dealer would send us the customer's details and we would try to source finance. My boss would receive a commission based on the interest rate charged. If at some point the customer stopped paying then the commission was deducted from the next. If the dealer arranged his own finance I would have thought that he would be in the same position. I am not here to argue. I am just stating how it was. I agree with your sentiments though.

@@chizzle6237 not sure of your point, trade cars are not sold at trade price as they are bought at trade price then prepped. If you buy a car at trade price and then prep you will of saved about 500 quid but have no warranties or consumer protection. I think I can be a pretty reliable source on this about 350 cars plus in!
