pretty sure if he gets caught there will not be a conviction, He was not seen on camera taking the diamond and if they don't recover the diamond there is nothing but hearsay that he is the one that took that diamond. Whos to say an employee didn't take it and blame it on a honest customer?

Easy to prevent. 1) Show the stones in a small recognisable colour coded case which makes swapping impossible. 2) Like any normal jewellery store, use a safety door. 3) Only open the safety door AFTER you checked the goods.

Since there is no video of him actually swapping it he will probably get off if he has a decent lawyer. They can argue that the employee behind the counter is the one that swapped it and then tried to blame it on him. No video, no evidence, no case. It is the stores own fault for not having more cameras. If I owned a store that sold diamonds that expensive I would have cameras covering every square inch of the place.
