@Norinia2 жыл бұрын
Maybe, but it also gives too much time for the offender partner to screw the other over, gives them time to try to scam the entire house from them, or drain the bank accounts to zero because they are joint. Also gives time to use intimidation tactics like leaving dead animals on their soon to be ex’s porch, leave nasty messages, or god forbid, break in and harm them. There is no benefit to the partner who has been massively harmed already by the disgusting cheater. Yes, even in the United States, if you sign a Covanent Marriage contact, you can and will be forced to abide by that documentation and the terms of divorce. Some of the most terrifying ones I've seen stipulated that even if your spouse beats you, assaults you, and cheats on you, you have to be in Christian based marriage therapy TOGETHER for two to five years. Anna and Josh Duggar have one of these that she signed without his past behaviour being fully disclosed to her. @@TiffWaffles A religious divorce can be more difficult to obtain than a civil divorce, but unless you are really concerned about the religious aspect the civil divorce is more important. I got my civil divorce first which was required by my religious community, and then was granted my religious divorce with no problems. But a number of people get their civil divorce which covers alimony, child support, etc. and never get a religious one. The civil court has no concern as to whether a couple follows through with a religious divorce, they don't even ask about whether the couple is getting one. Once a couple has a civil divorce they can remarry as they will. The civil license simply asks if you've been married before according to civil law. If you reply "Yes" then the question of "Did you get a divorce? is asked." A simple yes or no is required. But they are questioning about a civil divorce, not a religious. The state doesn't care if a person is following any sort of religious practice which might have it's own divorce procedures.

Religion is mixed in almost any country's government/law, lol. Also in western countries. In the Netherlands they want to make it seem like state and religion isn't mixed either, but look at the amount of religious parties in our government. Or at COVID laws, where the church was the only exception to any COVID restrictions - because it was stated in the ground laws that everyone should be able to preach religion no matter how many got sick from it. Look at the US, where basic human (women) rights for abortion are less important than religion believes, or where LGBT rights keep being on thin line cuz of believes. Other people also mentioned reconciliation exists in the US too, in form of cooling off period. People in western countries like to believe that their country is so much better cuz they live in "freedom", but it's not. Those believes are still in the governments and laws, only they are better at hiding it (or found ways to get away with it). I do think the world would be a lot fairer for everyone if believes were kept out of the government or laws.

It's been almost 20 years since my divorce. It was in a no-fault state. After the initial court date there was a mandatory 6 month waiting period before the divorce became final. During this time there were temporary order in place (financial restraints so that neither party could clear out joint assets or run up debt in the other's name, preliminary custody agreement, child support). All personal financial information had to be disclosed to the court (assets, income, expenses). Also, if there are minor children involved, both parties had to complete a court approved co-parenting course (I think it was 8 hours total, could be done in one day or in shorter sessions); it was pretty basic information, like not trying to alienate the other parent; child support and custody were separate issues - so don't withhold visitation for non payment of support, and don't stop paying support if custody plan is not being followed, etc. There could be interim court proceedings for issues that come up but the paperwork couldn't be officially completed for that 6 month period. After filing the final order, it became official after 90 days. During that 90 day period either party could contest particular terms (like if you find out ex was hiding income or something like that). After the 90 days you couldn't appeal to change anything expect for review of child support or custody.

So I have a friend who lost the love of her life 15 years ago when he was hit by a car. She spent many years in and out of relationships she would rush into where she would see glimpses of the man she lost as she was trying to fill a hole her deceased husband left that could never be filled. She married 1 of them after 2 weeks and wound up filing for divorce around a year later because the fake shine he put up in the beginning tarnished quickly, and he was very mentally unstable and abusive. She also found that at this time, he has a behavior of stalking exes and did prison time for kidnapping and stabbing someone. After she filed for divorce, a judge put a reconciliation order in place because her ex had asked for one. He court ordered marital counseling, so she had to. Within this period, she wound up having to get a restraining order against him, and he threatened to shoot her in front of her son (whose father was the husband who died) and then kill himself. I don't even want to get into the police and their lack of assistance in enforcing this court order until he came to her 85yo grandmother's home looking for her and shoved his way into her home. It finally ended when he showed up around 2am on mothers day and rammed his truck into the ramp walkway that was built into her porch, she woke up in terror thinking this was it, she screamed for her son to hide. Her ex ran onto the porch screaming her name and other things she couldn't make out, as she screamed for him to please go away he stuck his face in the window of her front door and then blew his brains out right in front of her. I do not think judges should be able to force women or men to reconcile with someone whom they no longer wish to be with. Especially when this person is dangerous.

There are states in the USA where you have to file for a Separation and maintain that for a year (maybe more?) In order to get divorced. I think there's another where you can't get divorced without approval from both parties, so one spouse can just hold that on you for forever.

Just like a judge can order a 6 month period of reonciliation, there should a mandatory period of relationship before you can get married.
@keninam33052 жыл бұрын
That is the case in many places. California has a 6 month "cooling off" period (aka reconciliation period) before a divorce can be granted. And another 6 month waiting period before you can marry someone else again

I'm out... done with his abuse I'm not able to keep it up anymore so he decided to kick me out of my house and i left cuz i was scared of him... and now I'm mentally in a better place and found someone who treats me with respect and kindness. The cptsd is obviously still a thing i have to deal with (and i got let go from my old job until i got over my cptsd... like seriously.... ugh) but my current partner is so patient and kind and we help lift each other up and respect each other... now i help other people in toxic relationships and now to get out of them

Oh in germany we got something like that too calle a "Trennungs Jahr" year of separation (google translate no clue if this is the english term) , were couples need to "prove" that there separatet for more then a year. When the divorece is both sides they mostley can "lie" so it is all easy, if not they need to wait a year (or that is how I get it, I am no expert here) or if the relastionship is abusive there is the possibility for a "Härtefall Scheidung" hardship divorce (google translate no clue if this is the english term), to get a divorce as fast as possible (but I don't know if cheating is in there).

My mother was forced to go through it. It was cut short after my abusive father nearly killed her so yea certain judges are hell bent on keeping catholic or Christian couples together in the US. The judge is still working to this day to that is what gets me. He litterally said "you will always be married in the eyes of god so you either get along or get over it".

I live in Michigan and when I got divorced 13 years ago, there was a minimum 6 months before we could even begin mediation or court because we had minor children at the time. I’ve heard that some judges will waive that occasionally.

If a judge ever ordered a reconciliation period one me with a cheating partner, I'd probably get nailed for contempt for saying "sounds like something someone who cheated on their wife/husband would say if they were a judge."

I would've said, "With all due respect, your honor, what are you smoking, and where can I get some? Or could you give me the name of your dealer because you have to be on some seriously illegal or strong stuff to order a reconciliation period with a cheater."
@cynicalminion2 жыл бұрын
i mean obviously there's the whole religion/gender/property angle, but also, i could see having a "reconciliation period" as a legal option to "cooler heads prevail" and an actual agreement as opposed to a judgement from the court, and as such i wouldn't view it as much from the perspective of "maybe you won't want the divorce" as i would from the perspective of "maybe you'll come to an agreement on your own"... however, my personal opinion (which definitely doesn't sound like happened here, although i'm not in the UAE, so i'm not surprised) would be "the divorce won't be finalized for six months, in case you decide to settle it on your own, but here's a no-contact order as well, covering you, your family, and your work..."
@tamsinmoore21112 жыл бұрын
When trust is broken, respect quickly follows, so there is no true foundation for love to grow and be maintained. No matter what type of 'reconciliation time' any judge may order. Judges are there to adjudicate the law, not act like a couples counsellor! This has just started appearing in posts, it's ludicrous!

Google "Divorce waiting period" to find out about laws in the US. Some states have no waiting period, some have various periods of months. There are two states where you have to wait a year! Maryland and Nevada (!). The Nevada one is funny because it used to be the place you got quicky divorces back in the day when It was difficult to get one at all.

Sadly, in MOST jurisdictions there is a 6 month-2 year "cool off" period, depending upon jurisdiction. There are 2 forms that period takes. "Reconciliation" most of the time means there has to be proof that an earnest effort was made to save the marriage. The other is "Separation" which simply means you have to have been apart for a certain amount of time. Proof of separation is an easier burden to prove. In addition, some divorces have to be granted by the original jurisdiction of marriage while others will nullify a marriage anyways. It comes down to the marriage contract itself and how it was written and also what jurisdiction each spouse lives in at the time of divorce proceedings.

My guess is the OP in this story is from India, like me. In Indian legal system, even if the couple apply for a mutual divorce, the date for hearing is set after 6 months. 6 months is supposed to be 'rethinking period'. Truthfully, a waste of time. Here, marriage is considered 'sacred' and even the legal system tends to go along with that rather than thinking along more practical lines.
@keninam33052 жыл бұрын
In the US we also have waiting periods. California's, for example, is also 6 months. They vary by state.
@MrClarissacain Жыл бұрын
I live in Oklahoma, family judges can order a 3 month "cooling off" period in divorces, and do so basically as a matter of course since they "don't have time for divirce/remarry/divorce again." I don't know if it's just a weird quirk around here, but my bestie has a personal policy of "never badmouth the ex, there's a good chance they'll be the next."
@heatherdickau5335 Жыл бұрын
The reconciliation period is outdated. And should never be a judges requirement. If someone wants a divorce, they should get one. Having to jump through more hoops is ridiculous.

I heard another story at some point that made mention of reconciliation periods and it said that the country in question (unnamed as well) was conservative in nature, so the OP may be from a country like that.

I had no clue my wife was cheating on me until 2 years after my divorce. I ran into a mutual friend and she told me that my ex had a guy on the side for about a year and a half before our divorce. I got really pissed at said friend for not telling me but I do understand why she didn't. Ya see I had pretty bad anger control issues back then and after a few years of therapy I don't really deal with it now. She decided not to tell me in fear of what I might do. I did confront my ex while picking up my kids one weekend and she got the very terrified look on her face and couldn't look me in the eyes for like 2 years after that. The worse part was the guy on the side was a very long time friend of mine from grade school. I met up with him at a pool hall and confronted him and I'm not proud of this but I did beat the ever loving hell outta him in the parking lot.

wow, dat story >.>. The ordered reconciliation is under the premise of attempting to force cool heads on exceptionally heated & emotional topics. It's saved more than a few relationships and has been used in ones where it shouldn't have been, but the honest difference between some of the cases are almost impossible to tell. It seriously gives time to sort out marriage ending lies/misunderstandings (which ironically are typically are around one thinking the other is cheating) and can be mixed up with real cases of actual cheaters. What I don't get is just the kind of insanity and what the bloody end goal of that guy is.

Sick of hearing courts ordering separation periods, marriage counseling and now reconciliation periods. That is not the courts place. If someone files for divorce the courts only business is separation of assets and child custody and support. Anything else is overstepping their boundaries and meddling in matters not their business.

My divorce back in 1979, Oklahoma,USA, had a 6 month ; no co-habitation or sexual intercourse with each other clause, before it was finalized. Basically the judge granted the divorce but if you moved back in with each other or had consensual sex with each other the court could revoke it’s grant of divorce. I’m not sure the reasoning behind the waiting period. Neither happened and I received my notary stamped copy of my paperwork in the mail 4 days after the 6 months ended. My spouse cheated on me also.

My country has a thinking period of 6 months. You file for divorce, wait 6 months, file some more paperwork and then it'll hopefully be granted. (If the couple divorcing has lived separately for at least 2 years the divorce will be granted without a thinking period) Edit: added more info
