He’s just trying to find another revenue source to prop up his failing KZbin venture. Hopefully he will overstep his in depth understanding of the legal system and land himself in court. He recently did a couple of videos with the other idiot dj audits , which really just shows how desperate he must be. He is not a very nice person at all and I certainly don’t want this type sticking up for my rights please. What are we breeding in this country.

I still think it’s wrong on principle to pay out even nuisance money. It undermines your staff who did nothing wrong. Would be interesting to see what G4S’s staff unions think of that policy? Appreciate it’s a commercial decision but what about looking after your staff and spending a few quid standing up for them in court? Knowing of course it will never get to court because Blagborough et al. wouldn’t risk losing and paying costs.

I'm surprised G4S coughed up the money. No offences had been committed by G4S, and they ejected someone who was a PUBLIC NUISANCE and clearly a trespasser, having been told to leave using minimum force. Damage caused to the camera was not through intent but due to the nuisance of attempting to push through the officers, making bodily contact to re-enter the building. In doing so, the officer caused a legitimate action by pushing the nuisance backwards in self-defence. A stance carried out by police officers in the land on every similar occasion. In the case of the nuisance attempting to re-enter the premises and making bodily contact with the officers. NO ONE has the right, unless in self-defence, to touch another without permission, and therefore, a matter of common assault occurs, and the trespass becomes aggravated in this respect. Aggravated trespass is a criminal offence and can attract police involvement and arrest. The nuisance was a lucky man in this respect and had G4S officers insisted on police action, the nuisance could have visited his nearest dedicated custody, locked in a cell, charged, fingerprinted, DNA taken, and bailed to attend a Mag Court with a fine and a criminal record. Amateurs like Marti and Auditors must brush up on their law before having their collars felt. As for Mr. Nuisance alleging bruising. The video clearly shows a light fingered push to move the nuisance back, and unlikely to have caused bruising. In this respect, take care, Mr nuisance, in fear of making a false allegation of assault, either criminally or through civil recourse, might end up with the clunk click on every trip.

No government building local or national should be regarded as "Private" property as it is owned by the public through taxes etc. Whether there should be restrictions on access etc due to security etc is valid. As for using private for-profit security in government buildings should be banned. I am sure there are more than enough government buildings to make direct employment possible. Third-party private companies are used to avoid worker employment rights as to pensions, sick pay, hourly rates, etc. As regards auditors etc I do not think they should be needed or wanted. I also disagree with the way it is used for entertainment, but used for real journalism and investigation to bring power to account I totally agree.

As I mentioned in the video, I do think there is an argument that a job centre and similar public facilities such as town halls are a public amenity, and as such, should be accessible by photographers - subject to whatever reasonable conditions security/management wish to enforce in any particular situation. Arguably, this is the legal position already due to the likely effect of Article 10, it just hasn't been decided in a judicial setting in a way that could be applied generally rather than to a specific set of facts.

@streetvideoreviewer
@streetvideoreviewer 6 ай бұрын
@whitemonkey7932 Obtaining pecuniary advantage by deception was an offence under section 16 of the Theft Act 1968. That was repealed and replaced by offences in the Fraud Act 2006. Of most relevance here would be the offences in sections 2 and 3 of the 2006 Act. Although the claim was without merit, personally I don't believe the two of them were actually committing a fraud. I think it can be chalked up as nothing more than a vexatious claim. I agree with the 'agency' argument. In the video, I refer to the fact that although Marti did not sign the settlement itself, he did submit it to G4S electronically as agent for Alfie Audits, therefore he could be said to have undertaken the same obligations himself. That's quite apart from the common law duty of confidence, which I think also applies.

He can. He is within the law in that aspect of this because section 12(1) of the Legal Services Act 2007 states that, in the civil justice arena, 'conducting litigation' and 'exercising rights of audience' are reserved legal activity. Sending a letter before claim is not those things, meaning it's a free market and the client can appoint and pay whomever he wishes for that and other pre-claim tasks. The position would be greyer if in one of these situations Marti ever decides to assist with the claim itself.

in these type of situations it seems a snap decision is often made as to whether the alleged trespasser is in fact trespassing. could a situation arise where an alleged trespasser is in fact within the law and not trespassing? in such a situation, if it were perhaps later proven that no trespass was committed, could the security guards be committing an offence by physically removing the alleged trespasser and thereafter be at risk for damages or some other legal action or claim made against them?
