Katko v. Briney, 1971: The Court ruled that using deadly force, in the form of an unmanned spring gun, on intruders in an unoccupied property was not reasonable or justified. Briney would have been justified in defending himself with the shotgun if he had been home during the intrusion. The plaintiff's status as a trespasser is irrelevant when assessing liability in this case. The case stands for the proposition that, although a landowner has no duty to make his property safe for trespassers, he may not set deadly traps against them, holding that "the law has always placed a higher value upon human safety than upon mere rights in property." The court thus ruled for Katko, entering judgment for $20,000 in actual damages and $10,000 in punitive damages

But Kevin was in the house when the traps went off and most of them weren't automated. He could easily make the argument that he wasn't setting traps to protect property, he was doing it to protect himself. Especially since the bandits demonstrated intent to kill.

@@ashsweet Objection, your honour, I believe it was only AFTER Kevin had already utilized MULTIPLE forms of potentially deadly force that Marv and/or the other one say "I'm gonna kill that kid!" Therefore it could be said the Wet and/or Sticky Bandits were under the impression they were trapped in some kind of sick "us or him" game of deadly cat and mouse.

@@AceAttorny Something tells me the ol' "But he staaaaaarted it" defense isnt going to work in court when the bandits had no reason to be in the house and could have tried to leave at any time. Kevin may be a tiny sociopath but he did have every reason to believe they were trying to kill him from the start.❤
