As i understand it, under the Logan Act, his conversation with the Russian diplomat about lifting sanctions can be categorized as unlawful as he's interfering in an issue between the US and Russia as a private citizen however, via precedence, it's unlikely it would be seen as treasonous. However, because he was shortly to hold government office, This is a no no because of the real possibility of influence by foreign powers to the policy decision of government. Flynn knew or probably at some point realized the implications and tried to deny the detail of the conversation but only made it worse as more came out, as it also tarnished the reputation of the VP who stood up for him. Hence his resignation. Furthermore, can you be sure he was insincere to the diplomat? You remember when Obama ejected a handful of Russian diplomats and Putin did not respond in kind? In the arena of world politics and the great game of nations that go on within,There are some who say that was done because of the anticipation that the sanctions would indeed be lifted by the Trump administration. I'm aware alot of Americans don't see this, but heed some advice from a citizen of a country closely allied and a close friend to the US: Yes, Russia is not the enemy as in the days of the cold war but it is not your friend; never have been. Observe them, for they first find out your faults.

"Illegally monitored", dude he's in the government, everything he does should be watched. Also the statement is a non-issue as the question is whether or not what was said is treasonous. You wouldn't go around ignoring a possible theft because the victim was a snitch. On to the actual conversation. From what i know Flynn made a remark to a russian diplomat without the knowledge of the greater government. The problem there isn't that Flynn said something potentially treasonous, but that he made a promise that the sanctions would be lifted. In the best possible outcome Flynn would've just been saying something to get on the guy's good side. Even then however, Flynn shouldn't make promises to another diplomat because the government kind of has to be on the same page with him. Imagine if the diplomat went back to Putin and said the sanctions would be gone and they weren't, he'd blame America for lying to a diplomat.

Flynn and other of Trump's cohorts were in contact with Russian government officials BEFORE they had formed a government - President OBAMA was still running the USA, whether they liked it or not. They had no right to be discussing American policy or anything else with officials of another country. Especially one traditionally hostile to USA. Indecent haste, astonishing naivety, gross presumption? Arrogant belief in being above the law? Trying to pervert the outcome of an election? Treason? Sanctiongate or Flynngate?
