I don't think people truly understand assault laws. You can have an assault without any battering (battery). You simply have to take some action with implied intent and menace, and cause fear in the person you are assaulting, which he clearly did. If he would have struck the officer that would be assault and battery. If he would have struck him repeatedly and/or with an object that would be aggravated.
