The Feds state there are certain rights all 1099 contractors have, like the UFC claims their athletes are. Technically the client is the UFC and the fighters are contracted. There are rights like the right when to work, the right to a fee, and most importantly the right to accept contract work in addition. The UFC can’t, by the letter of the law, tell fighters they can’t sign other contracts. But at the same time the UFC can terminate that contract whenever they please and without any reason. This how corporations like the UFC manipulate contractors. It’s a classic way companies use to treat people like employees, without any rights of an employee. The UFC are one of many exploring people like this.

This will settle or won't go to a verdict in favor of the fighters, just based on my knowledge of antitrust and having a distant understanding of the facts. My reasoning is that this isn't a Section 1 violation (which is left for horizontal conspiracies, for example if Target and CVS decided to fix the price of their products). Section 1 is the most impactful antitrust suit you can bring. This, however, only implicates the UFC, making it a Section 2 monopoly violation. Section 2 violations often require a showing of market power, and then they are judged under the "Rule of Reason" which almost always favors defendants (the UFC is the defendant in this case). Antitrust suits that go under the Rule of Reason are so difficult to win it's almost futile to even bother. Best bet is a settlement, but settlements don't affect the law, they just grant money to the plaintiffs. Just my two cents.

great break down. The fighters really need to just unionize. Normally I'm not a fan of unions but in this case it's warranted. As another commenter pointed out, the UFC does not pay these fighters for training nor do they provide health insurance if they get hurt while training. They only get paid when they show up for a fight and they only get health coverage if they are hurt during that fight. This forces a lot of guys to hide an injury until they step into the ring, just so they don't have to pay for surgery out of pocket. Then to add insult to potential injury, even though the fighters are not getting paid for their time in training, they are still prohibited from fighting in other events that fall outside their UFC contract. In other words, "we own your time even though we are not paying you for it". This is all grossly unfair. It's possible for a fighter to spend 6 months in training without a paycheck, and then get hurt the day before their fight and lose out on their paycheck and be responsible for their own medical bills. They take on all this risk in order to provide a product that the UFC is making millions on. This all has to stop. (Dana white is personally worth over half a billion)

@@PurpleLightning6was9 I'm not a fan of unions because they tend to abuse their power. I was working a trade show in las Vegas back in the 90's. We needed an extension cord. Just the little kind you buy for $4.00 bucks at Walmart. The venue charged us $75.00 to rent the cord and then they required us to pay a "union certified electrician" $125.00 to plug it in. Unions can and do go from protecting workers to a way to fleece consumers. That is why I don't like them. But in the absence of honest business owners then a Union can be the answer.

@thehammer31932 жыл бұрын
@@zombieepx1933 Is that you Dana? Yes the fighters really have it that bad. The UFC treats them like independent contractors who only get paid when they fight but require them to go through months of intense training to get ready to fight. Meanwhile they prohibit them from fighting elsewhere to make money so they own their time without paying for it. In this last fight the UFC pulled in 32 million in PPV buys alone. They paid a grand total to all the fighters of 1.8 million. That is about 5% of their earnings that actually goes to the fighters. All other professional sports pays about 50% to their players. It is deeply wrong on many levels.
@zombieepx19332 жыл бұрын
@@thehammer3193 well that’s a lie. Francis made 600k and then another 600k from ppv shares. Gane made 500k and then 600k from ppv shares so that already exceeds your fictional payout of “$1.8 million to all fighters” lol. Brandon Moreno made 200k and then 600k from ppv shares, Figueredo made 150k plus 600k from ppv shares. That’s $4 million already in just four fighters. Also there isn’t even any information on how many PPV buys there was at UFC 270 yet that takes time..there was only a $5.2 million gate which is small and no official information on ppv buys so your numbers are just as wrong on your total revenue as they were on your fighter payout. Try again kid. You can’t compare “professional sports” to UFC payouts. They’ve been established for many years and have a fan base and revenue much larger than the UFC.. like the NFL for example (American football) generated $12.2 billion in revenue last year while the UFC did $400 million.

In all honesty, I feel extremely split on this issue. On one hand I want the fighters who risk their lives out there to make great money. They deserve really good pay, health care and some form of retirement after a certain amount of fights/time. On the other hands some of the things fighters complained about are general contract tactics by most sports organizations. The promoter/team always wants to sign a longer contract so they can financially plan & lock in that talent for as long as possible. Promoters/teams often bully or punish players/fighters who do not cooperate with them. In fighting that might be making them wait on fighting while in the MLB it maybe sending them to the bench or even to AAA ball. All major sports in the United states have one league that does have a full fledged monopoly on each market. Only hope for the NFL will be the Rock working with the NFL to develop the XFL into a league that is a developmental place of young talent and somewhere vets go before retiring. Ask any professional athlete and they will tell you it’s a cutthroat business. Ultimately fighters do deserve a higher percentage of the companies earnings.. something at least like 35-45% to compare to the other major sports leagues. But just like every other sport.. the more talent & star power you have the more money you earn & power you have during negotiations.
