This video was a long time in the making. KZbin had us make multiple versions of this. As you know, we leave out a lot of the disgusting details of the case, so we couldn't figure out exactly what their problem was with the story. After roughly 30 messages back and forth with KZbin support which took about a month, we finally were able to present this story in a way they were happy with, very minor things had to be changed. The major parts of James' story are still there and we are relieved we are now able to share it with you. Will you be around to watch an episode from us on Wednesday, or will you be out with family? I don’t understand how the people that did care didn’t gather outside of cps the court and police station! I know if I became aware of any child going through this kind of abuse and nobody doing anything about it I wouldn’t rest until I knew he was safe and justice served

Yes and if they did they might do the job they are supposed to do. This is a horrible unbelievable story that POs mother did not love that child she must have been getting money from the government or she would have left him with people who cared for him. It makes me sick she should be in prison for the rest of her life ! Maybe a better punishment should be done to the abusers what has been done to the child. There is no regard for human life anymore especially a child’s.

These CPS workers are just as guilty as the people who murder these poor little children. They continually take children from the safety of other family member and put them back into the abusive arms of their ‘parents’. So many children would still be alive if not for CPS.

Agreed. Everything is so backwards. I knew a lady that was allowing her daughter to SA-ed and was there while it was happening. I'd called CPS multiple times and was told "yeah, she's what we call a 'frequent flier'..." like, whattttt??? CPS would call her ahead of time to let her know they were coming to do a home check. They Knew both kids were in a disgusting, unsafe situation and did NOTHING. She's dead now. Both kids are almost grown and doing well, thankfully. Seeing these cases breaks my heart bc there are soooo many people who can and will help care for and love then. 💔💔

And what kills me about that is the ones in CPS who are DOING THE RIGHT THING get shut down by bureaucracy or indifference. Like the lady in this story who TRIED to get her supervisors to listen and they told her "Calm down--" like-- THATS how you kill kids in CPS, PEOPLE!! I wish they'd hold those supervisors just as accountable

I’m glad the judge called out CPS for their gross negligence and incompetence, but when do they actually start being held accountable? Kudos to the attorney because most have no idea how hard it is to find an attorney willing to go against CPS with any real effort. This needs to stop being a “civil matter” & transition to criminal because that’s exactly what CPS is. A criminal organization…

I agree with you, many kids have died because of caseworkers not pushing enough for the removal of the children, CPS should become a part of police department like the k-9 unit or the narcotic unit, trained officer instead of bureaucrats. @@artix548 Same. My ex is a literal psychopath that tried to unalive me while pregnant & tried to do the same to my son & I several times after he was born. When he couldn’t find where I lived, he called CPS saying I was a drug dealer, mentally unstable, all kinds of outlandish stories in an attempt to get my new address… They treated the stories as truth & put both our lives in danger. He thought my neighbors house was mine because they allowed him to glance at paperwork with our address. He broke in & shot up their babies nursery thinking it was mine… CPS was threatening to take my son due to the danger THEY put me in. I finally left the state, leaving everything I’ve ever known & loved behind. If I hadn’t, we’d all be dead.

This is crazy. Little boy is saying hey these people are hurting me, got bruises and stuff from the abuse, but it was unsubstantiated? Wtf? This is why CPS nationwide has a bad rep. Taking kids from families that shouldn’t be taken but in the reverse got cases like this little children could be alive if taken away.

CPS is so screwed up, my parents were pretty physically abusive towards me, and I was never taken out of that situation. I have permanent issues in my joints from the abuse and CPTSD. CPS got called 15+ times on my parents. Cases like this just highlight the failings of the system

⁠@@CaelTheWaxAngelI’m so sorry that happened :( I’ve been in the same boat so many times, and yet CPS took the abuser’s side and determined that I, at the ripe age of eleven, was making up all this stuff to waste everyone’s time. the effects of what happened still live with me today, but im working on healing. I hope that you and anyone else who’s had to suffer at the hands of these monsters find lots of peace and healing

Yeah the hypervigilance was evident. He had to constantly be in tune with the emotions of the adults in the room in order to keep himself safe. It's a trauma response.

I had my kids removed because my bf (at that time) got pulled over w/all our kids in the car & they found drugs. I was at work. He failed 3 drug tests. I passed all. Yet even after breaking off the relationship & doing parenting classes, it took me over 2 yrs to get my kids back. I did everything by the book. Never had any concerns from CPS. But after 13 yrs it was found that my particular case worker not only had a thing for my new bf but had slept with my kids father. While a case was open. Don’t ever tell me CPS is not crooked af

That's awful, I'm sorry you and your kids had to go through that. There's probably not much you can do with the information 13 years later, at least not through the judicial system, but there are other ways... I'm sure it's probably best to try to put it behind you though (for context, I watched a video by Rotten Mango yesterday about a mom who took things into her own hands to avenge her daughter when the justice system failed to, so the idea is fresh in my head, lol). Seriously though, this sh!t has to stop. My blood pressure can't handle all this absolute f**kery.

@tracesee681 - Yet they will take children away, who have serious illnesses, and the parents are doing their level best for the child, but CPS has decided that the child is being abused, and makes up stories to suit their own agenda. ‘Taking care of Maya’, comes to mind, and indicates just how screwed up the welfare, some hospitals and justice system, actually is. In this case, some of the hospital staff decided without any proof, that Maya was a victim of Munchausen’s syndrome by proxy. First and foremost, those nurses, and hospital staff, were in no position to diagnose the condition, and Maya had been under the care of a doctor, who had helped to relieve many of Maya’s symptoms. But, child services was called in and messed up the family’s life so much, that the mother made the ultimate sacrifice, to get her child out of the evil people in the hospital, by removing herself, through suicide. She knew while she was around, they would never give consent to allow Maya to go home. The whole system stinks!

They should be trying harded when people are avoiding them. They should be contacting the police to help locate the poor child. CPS is woefully inept and should be investigated and re-vamped. Right now, they are less than useless. At least the case worker tried to do the right thing. Doesn't usually happen.

It makes no sense!! I'm an avid true crime consumer, and it absolutely baffles and enrages me to hear a CPS case is closed because they couldn't get a hold of the parent(s). That should be even more reason to find these people! It also frustrates me knowing these CPS workers can't be held accountable for their complete failure to protect these children.

They should not be allowed to close a CPS case just because somebody does not call back. These people that aren't taking care of their children are learning that if they don't call back they close the cases unfounded stop closing the cases of these children and protect them

Imagine being the case worker that begged their supervisor to change their mind. Imagine knowing that this little boy was on borrowed time and desperately trying to save him, but being told no. To that case worker, I hope you dont blame yourself. You did what you could to try and save him.

The question you should ask, is how many times have the case workers reported these type of abuses on children, demanded action, and have been outright bullied by those in charge. The frustration of trying to do your job properly, just to have your bosses belittle your concerns, change your reports, and tell you to “calm down”. All while a child suffers and dies.

I am FURIOUS! Someone please explain to me… why a close friend of mine (who is an amazing hard working mother) had a FULL BLOWN CPS investigation because she missed 2 scheduled Dr appointments for her daughter…someone at the office actually accused her of medical neglect. All the while these literal pieces of trash get away with horrific abuse and neglect ending in death!!!??? WTF! So many chances to get this beautiful baby out of harms way yet case closed after case closed. They should be held accountable, why is this not happening!

I have a friend whose child was taken from her. He had severe food allergies. She was accused of Munchausen by proxy. Within a couple of days on regular food, he had gotten very sick, and within a week, the foster parent said ‘oh yes, he has SEVERE allergies.’. It took her a YEAR to get him back. When she had done nothing but advocate for his needs. But a child covered in bruises is left with awful people. Make it make sense!

Yes, having worked with child protection, I’ve seen it so many times…kids taken away for a messy house, and abuse ignored because all the stuffed animals are in a row, on the kids’ beds. 😡

Someone from my insurance company threatened to refer me to CPS because I wouldn’t schedule a “well child” visit. This as he was IN the hospital, in and out of the hospital and visits with his pediatrician for 19 days one July as we couldńt figure out what was making him so sick. Turns out he had cancer and needed a bone marrow transplant. But I was flabbergasted. At least one of these threats happened while I was literally in the hospital with him. I think once he was in the hospital for the actual bone marrow transplant they got the message that I was not medically neglecting my son. Ugh

Please talk about how CPS can be improved in all states. I was a public school Guidance Counselor. A child, attending our school, died at the hands of her mother & grandmother. CPS came to the school & tried to blame us. The police came on a Saturday. I wasn’t there. The principal opened my file cabinet. But, my records were completely detailed & complete. I watch your videos often & cry. This time it’s hard to stop crying. Thank you for the constant attention you give this horrific problem. I send my heartfelt gratitude.

The difference with CAS here in Canada, at least in Ontario, they take away kids that aren't abused. It's action before proof. Then parents have to fight in CAS court to prove it. 8 autistic kids were removed from their homes in Durham region in 2004 because cas said they needed to be institutionalized in homes with multiple staff. Yet those homes have 3 to 4 staff per 6 to 7 kids and the kids lose their therapies,diets etc. Plus funding except residential. Parents went to court,ombudsman and cbc who ran the story. My sons case was first. Ombudsman told them to give my son back then the rest. We were great parents. I had him on the list for the homes for when he was older. He's in one now and I have full parental rights and make all of his medical and other decisions. Full guardianship

In most of these cases the kids are used as punching bags. In many of these cases the kids could've been saved if child services did their job. I think they should start doing jail time as well. They are just as guilty. They are supposed to protect these kids, it's their damn job. If they know they'll do jail time, I know they'll start doing their jobs. They are just as guilty for these deaths. Actually they are the reason for the deaths. It's totally unacceptable, and disgraceful.

They failed when I was a child, but we had a BI who reported us to CPS because I let her know that the children had lice during a lice outbreak in school and the lady from CPS came to the door actually seem to understand that the letter was sent out of the anger for the BIA personal inconvenience and that separating the kids from the family would be the worst thing for them. My son already had PTSD from his father going away to Iraq for a year and my daughter, who is still a baby at the time was uncontrollable whenever my husband was flown out to work at other units, but it was a traumatic experience for all of us and they’ve never trusted anybody outside of our immediate family since then. Don’t use child protective services or DCFS to attack people that you’re mad at. This actually happens more than you think and it takes time and resources away from cases like this where action really needed to be taken and so you’re ending up with many more traumatized children.

This little boy was so sweet. He cared so much about the people around him, he was honest and polite. This little boy deserved the world. There are so many children that are failed so hard by the people around him, and he's been failed big time. Watching that video where he asked the police officer if he was okay made me want to cry. He had to be in pain, was probably scared, but all he saw was someone else who needed his care. My heart is so broken for this sweetheart. Rest easy, little baby boy.

The Cinnamon Tree apartments also have a lot of issues. They're nice apartments, but in a very bad part of town (it was once known as the War Zone, though the current mayor had been trying to be sure we all call it the International District for several years now). Not kid-friendly in the least!

I totally agree with the grandfather. There needs to be a total dismantling of the current system and a completely new process implemented immediately!! More documentation, more accountability, more visits, more resources! These people need to remember that these are CHILDREN & not just a number or a means for a paycheck. When they mess up and child is harmed or murdered, they need to be held accountable!

This is an idea, START make recording ALL ENCOUNTERS WITH ALL INVOLVED IN A CPS CASE OR POTENTIAL CASES...MANDITORY. LIKE THEY DO WITH COPS. THAT WILL HOLD PEOPLE ACCOUNTABLE. AND NONE OF THIS CRAP OF MY CAMERA WASN'T FUNCTIONING... ONLY I DIDN'T KNOW IT. (THESE THINGS DO HAPPEN, BUT DON'T ALLOW IT TO HAPPEN MORE THAN ONCE!). Make people accountable by making them keep up these cameras! But the children's lives that are affected... Isn't that worth the expense? Isn't these people involved, who are being held accountable... Their lives matter too! Make it mandatory at schools as well, if there's any suspicion of abuse, even if it turns out to be unfounded... Better that than to find out you were wrong all alone... And cameras would have made a difference.

I agree with James’ grandfather. Child “protection” agencies should be prioritized by state governments but considering even the best government run agencies are falling apart, I agree, burn it all down. James looked like such a sweet boy. These cases hurt more when you hear their little voices & see them still smiling even when they’re in pain. At least the police & one case worker genuinely seemed to care, they should be commended.

The boy asking the officer "are you OK?" Is an example of 'emotional guarding'. - The child feels the need to monitor the emotional states of adults with power over him, in order to keep himself safe. If he's doing it with complete strangers, he's been entrained into that behaviour beforehand.

Unfortunately every where is a hot bed for child abuse. I could give you 20 stories just like this from my state. It’s a sad reality that it happens everywhere & everywhere DFACS fails these kids again and again and again. I’ve been a foster mom and child advocate in the court system for nearly 13 years. There’s not enough being done for these poor children.

Wow I love this judge. Having worked in mental health until I retired I met hundreds of men and women severely abused as children. Very few became abusers many actually became overly protective of their children but not in an abusive manner. Sick and tired of judges who feed into the poor me and my mental illness excuse.

There are cases where the parent is accused of abuse when the truth was a simple mistake, not negligence. But there is also a fine line when trying to prove abuse early on. I know it's hard to believe but it's true. This case was obviously proof of neglect on part of everyone involved.

It's not just the monsters who hurt/kill the child, it's the dozen other people who ignore it, or just don't bother to do anything. Seeing video of James breaks my heart. Same. In a sense, choosing to listen to these stories despite the psychological effects they may have is a way of honoring the innocent victims. The suffering endured by the victims and those who loved and cared about them needs to be known, and if I look away out of self-interest, it feels kind of like a betrayal. However, I absolutely do not fault anyone who chooses not expose themselves to this type of content, especially those at risk of being triggered to relive past trauma which could derail their healing journey.

Does CPS EVER do anything with these cases? I am so sickened of hearing every single time that they just don’t do their job. I cannot fathom how such a collectively and lazy group of individuals are allowed to make these decisions.

Only way to stop this is for family to sue the CPS. Judges need to be held accountable when they had power to stop this.

I get that they can’t just take away kids without any evidence but here they had tons of injuries and he directly told the doctor and everyone what was happening to him. How could they not remove him? It makes no sense! They knew he was being abused!

That list of injuries sounded like someone was in a fatal car crash. As well as signs of surviving earlier accidents.. Officials had MORE than enough evidence to separate the child for his own safety, yet the professionals who's job it is to protect him did no such thing.. Wtf is going on?

Paperwork/ money, pleasure, the list goes on. Remember Gabriel Fernandez, literally night and day when he was with his uncle or his mom. Stupid people doing important jobs stupidly.

How does these Child Protection Agencies not held responsible for these children being abused or killed....We need to hold them responsible for not helping these children...

I often wonder why CPS agencies take kids out of good homes and put them in homes where they are at risk. Is there a financial compensation for this? And if so, why? It just doesn't make sense, and this happens all the time.

Yes. As a child, I was removed from the home of a poor mother who was seriously ill with asthma, because of substandard housing. My dad didn’t pay child support, or she could have paid for a better rental. My mom couldn’t get me to go to school, because I was bullied. An individual in the community took an interest in me, and went through the process to have me removed to state custody, so she could be my foster home. Knew I was Special Needs, but low needs (I’m Level 1 autistic). She received $3,500/month for my care, and didn’t provide any psychiatric care, or uncovered services with that money. She used it to pay for parties, used my clothing allowance for designer clothes, and got a call from school, asking if I had an eating disorder, because I didn’t eat lunch. She didn’t let me use my free lunch card! Probably sold it. She was abusive, and had a man living there who “used to” deal drugs, but there were people coming to the door, asking for drugs. She had a Substance Use Disorder. I heard her telling a neighbor how lucrative it was to do foster care, and this adult neighbor had a 17 year old living there, a street kid she was inappropriately involved with, who she was planning to apply for foster care funds for. I can’t say it was SA, because my state has 16 as the age of consent, but I think it was. This kid had nowhere to live, and this older neighbor, in her 30s, exploited him. I knew about the “relationship,” because he was introduced to me as her boyfriend. I know she was talking about foster care funds for this same kid, because they overtly discussed it with us kids both in the room. It’s a business for some people. My foster mother was a felon, who had made good, by running a human services NGO, which provided no tangible services…only referrals and emotional support, ostensibly. It’s sick! I think the neighbor’s legal record was probably too extensive for her to have received foster care funds, but you never know.

Also, their mission statement is focusing on the wrong thing. They focus on "keeping families together" 🙄, rather than "keeping vulnerable people safe".

Why even have a child protection agency most of the time they are worthless. How many children have died because of poor decisions on their part. It makes me so angry!!

So sick of hearing about how CPS continues to fail these children. When there are multiple calls about Abuse, then something is going on. Then we hear that the CPS employees need better trading. So many evil people in this world.

I live in Albuquerque. Its so hard to hear about the cases in New Mexico it hits too close to home and these workers are just as guilty for telling the woman to calm down. Sad this state needs more regulations

I don't understand how the system failed this boy so many times. That sweet boy asked the officer if he was okay yet they should have taken him away and he would've been here still today. I'll never understand why someone would want to hurt a child. People are monsters
