To me, the problem with the Philando Castille verdict is the fact that juries are instructed to rule under law that permits an officer's actions 'if they feared for their life.' That wording is way too vague, and there needs to be more consideration as to whether the cop is justified in their fear. If the average citizen would not get away with a self-defence claim (unless they were rich/a celeb/there was bribery or threats/etc.), neither should a cop. There's a reason murder and manslaughter are separate terms but both face punishment. If nothing else, Yanez's conduct and acquittal are a damning indictment of a system that either doesn't train cops well enough in responding to situations or doesn't apply sufficient scrutiny and assessment in who they allow to wear a badge.

As a licensed gun owner this terrifies me. By law whenever we are pulled over we have to inform the police officer that we have a weapon on our person. From the video that's when the officer gets spooked and everything happens. Driver did nothing wrong. In my opinion the officer was clearly in the wrong and should have been convicted.
@JayPoel

If we were allowed to carry and I decided to (Canadian) - when pulled over I would open the driver's window, shut off my vehicle, put both hands on the steering wheel and when the officer got to my window inform him I had a firearm. I would not remove my hands from the steering wheel until HE told me what he wanted me to do next.

This cop was in the wrong, but cops aren't trained to "shoot to incapacitate". No one that carries a gun for a profession is trained to do that, they are trained to shoot to eliminate threats. However, ill say this again this cop should obviously not be in a job that requires him to carry a weapon and I'm surprised that manslaughter wasn't the end outcome.

Kinda hard to cite to my biology teacher. But I can try to look for it when I have the chance. Inhaling any type of smoke is dangerous. That's why for example when there's a fire, people die of CO poisoning. CO for example attatches itself to your red(?) bloodcells which makes it harder for the body to get oxygen. I might go ahead and message him to ask where he got that info, but knowing that my teacher is pretty young and pretty liberal, I doubt that he was just saying that as propaganda or whatever.

They are trained to neutralise or incapacitate, and in a lot of cases killing is the most effective way of doing so. On flat ground it is possible to use the "shoot them without killing, then disarm them" method, but it's more risky.

+Tbird1945 you are seriously not thinking. anyone who watches this video 20 times in 6 months like i have can see the cop did the right thing, philando tells the cop he has a gun, then INSTANTLY starts pulling something out of his back pocket. Even if the gun was in the front like Diamond..the woman in the car said, THE COP DOESN'T KNOW WHERE THE GUN IS, NO ONE TOLD HIM, he smelled WEED, he sees they are smoking it around a small child and EVEN DIAMOND the woman in the fucking care said... ''the cop didn't know where the gun is'' or some shit like that..she said in the interview. that makes this a clear cut case, the cop was like don't reach for it (WHOA WHOA STOP WHY IS HE REACHING INTO HIS BACK AREA...in the dark where i can't see shit. - If you look online you see alot of people getting shot because the driver is reaching for something, even people who are just getting their pockets searched ...while standing in a parking-lot grab guns and shoot police in close range. They could have been lying.... you also see several videos where a black male says IM NOT REACHING then shoots the cop in the chest 2 seconds later.
@GravDiga
@GravDiga 6 жыл бұрын
she said in the interview... after the shooting took place that the cop didn't know where the gun is, she knew..the cop was right... to shoot phil...because Phil SHOULD have told the cop where the gun was, the cop should have told Phil to step out of the car.. and let the cop take out the gun. Phil should have INSTANTLY told the cop where the gun is. In my opinion that is why the cop got free, the woman admitted the cop didn't know where the gun was and Phil went reaching for his wallet right after telling the cop he has a gun. I THINK< Phil did this himself... he was high..so his mind was working in overtime, i think Phil was doing suicide by cop. Cops need to pay attention to body language... if you tell a cop you got a gun, then start reaching for .. an UNKNOWN item at an angle the cop can not see. (which once again, Diamond said the cop didn't know where the gun was) However i do think the cop should have said ''WHOA WHOA WHOA< STOP MOVING, you are MOVING TOO FAST, i might just haff to pop one in you..if you make sudden movements with a gun in the car'' which i will admit is paraphrased and stolen from BadBoys2

I realize officers have a tough job. BUT, his testimony makes no sense to me. Why be concerned for the child and girlfriend with the marijuana smell (that could have been smoked prior, without the child around) but shoot this man SEVEN times? And he got acquitted. Makes no sense. From now on that little girl is going to be afraid of officers because of this incident. Because one of them shot her father when he was informing him of his firearm.

Ignoring my personal opinions about gun ownership, I do not think the American police are given enough training. I don't think this cop really wanted to kill anyone, I think he didn't have the mental tools given to him through training to handle it and assess the risk correctly. And yeah, weed smokers are really not the ones to worry about. I note some of the defence was "he wasn't obeying requests because he was stoned" but in that video we can hear that he did respond and answer clearly. Sigh. Another person who should be alive isn't, and a cop has to live with that guilt forever because he wasn't trained.

As much as I hate people taking every death of a black person by police as permission to run out in the streets and disrupt order, the evidence and situation provided from multiple angles shows us that he was 100% cooperative with the officer and the officer acted out of pure unjustified fear. How that officer got away with abusing his power to fire at a man astounds me. There is no justice here and now we are left with a family and community forever scarred by a senseless death, may this case forever be an example of abuse of power.

Rainman Slim Every conceal carry course teaches you to keep your hands on the steering wheel until the cop asks you for your wallet and license. Cop who knows you are armed says "dont reach for it!" you dont move. Do what the cop says for his/her safety and your own. I rarely carry (even though I have a permit), and still I don't reach for things until instructed to do so. After watching the video, he said "don't pull it out!" three times. After the first time he asks, STOP. Put your hands up, and wait for instruction. Of course, its hard to think clearly when your smoking weed in a car, while driving, with a little girl in the car.

If you look at the officers right hand in the video, the moment that Castile informs him he was in possession of a weapon the officer reached for his side arm. While I do agree some could argue this was a cautionary move, I would argue why would a man with the intention of firing on an officer reveal he is armed before striking, it just doesn't make any sense to me. Ultimately I would say this comes down to a person lacking the correct discipline to handle a high stress environment on a daily basis. I feel as though while the officer should face punishment for manslaughter, I do believe the state is to be blamed for failing to provide sufficient training and testing for the officers in their employment. The state can never guarantee that the officers in their employment will never cave in to the stress, but when an officer fires 7 rounds into a man at almost point blank range in front of his partner and child during a minor traffic violation then the state need to reevaluate their training. Anyone else have any thoughts on the matter?

drivers intentions and his words are irrelevant, when you have a gun, thats first thing you say to officer with your hands on the wheel, and wait for his instructions, look for the videos of cops shot during routine controls like that, its just blink and cop fall on the road dead. those videos never made the news but cops are very aware of it and fear their lives. its very unfortunate tragic situation, but could very easily be avoided.

Catherine Penney I don't condone what the cop did in this particular example, but these are my 2 cents to your question. Under timed and potentially dangerous situations, the complexity of responses and fine motor skills becomes limited. There's usually no time for "where do I aim", when your "opponent" has the initiative- the question becomes "Do I shoot or not shoot". Consider also the fact that "non-lethal" shots (typically limbs) are much smaller areas to aim at.

Sigh...There isn't a fiber in my body that believes this officer work up that morning wanting to kill someone, and I believe this event will haunt him for the rest of his life - but from my perspective it is clear the officer was scared and made a mistake. A mistake which cost a man his life, and a family their father. In my mind part of becoming an officer involves coming to grips with the fact that you will be held to a higher standard, that you will be put in life threatening situations, and that you will be held accountable for your actions. I'm so sick of seeing police officers getting away with assault and murder. They signed up for the risks and the scrutiny that goes along with it, but are being held to a lower standard of conduct than any citizen would be in similar situations...just disgusting.

In a lot of states there are laws known as "stand your ground" laws that allows any citizen to not be held accountable for "not choosing to walk away". Minnesota passed one of those not long ago. Unlike a regular citizen the police officer do not have the option of "just leaving the situation" as part of their duty. By that they are already held to a higher standard because they can not leave the situation. This is particularly important because there are other people in the car and on the road, if he feels threatened and decides to let him off without ensuring that he is not a danger to himself, his passengers, or other people on the road, he has not done his duty. His duty in that situation is very much an evaluation of Asimov's Zeroth Law. A person under a stand-your-ground situation is evaluated in such a way that if the person could reasonably (from the information the person "defending" know) be a threat to the defendant (person shooting or family/friends by proxy) there and then, the situation is judged self-defence. A police officer is evaluated on the threat to not just themselves, but also to other people (like hostages or bystanders) as is reasonable from the information available. I encourage people to read the transcripts court before forming opinions (I have done neither, by the way). Another thing to note is that a person who has just killed or shot a police officer is more likely to harm other people than someone who has "killed or shot someone". This statistic has many reasons, but what to take from it is that: "If the victim is know to be a police officer it is more likely that there are more victims than if you didn't know the victim were a police officer" (this is a bayesian significance for those who want to look it up, it's really cool)

Dear Phil, On your last video you shared an awesome link to an awesome video, of a guy cleaning a rusty knife. After watching that video, I was recommended to watch a Bob Kramer video on proper knife sharpening, which led me to another video of Anthony Bourdain featuring Bob Kramer, which introduced me to a wonderful series called "Raw Craft". I spent the next 2 hours watching amazing people do amazing things and it inspired me. All thanks to your 1 link recommendation. In the words of little Trae, that is amazing! :) Thank you

The cop smelled they were smoking weed around a little girl, the cop had every right to assume the unknown object he was reaching for was a gun, look at all the videos of black men who shoot cops.. they are found reaching when the cop says stop reaching. This is the exact moment that gets men cops and black men killed, Phil should have known better than to reach suddenly and not tell the cop where the gun was and..he should have asked the cop, what do you need me to do sir?

I know I might get a lot of flak for this, but what I heard in that Castille video was this... Castille: "Sir, I have to tell you I DO have a firearm on me." Officer: "Ok, don't reach for it then." Castille: "I, I'm, I was reaching for it." Officer: "Don't pull it out." Castille: "Ima hafta pull it out." Officer: "DON'T PULL IT OUT!!" I ran the video 10+ times just listening to the audio through my headphones with my eyes closed, and that is what I heard every time. After that, the officer reaches in to (presumably) stop Castille's hand from reaching for something while also drawing his own weapon with his other hand, it hits the side of the vehicle as he draws it, pulling it downward (which to a body hyper-focused on survival may have felt like it was being grabbed by someone.) and away from what he was sensing as a threat. IDK, the Jury were given all the different videos with no transcript, so they could only really go on what THEY heard and saw. If I were in the Jury, I don't know if I could have found him guilty beyond a reasonable doubt either. Not claiming he is innocent, just that the burden of proof is on the accuser, not the accused. A video where I hear something differently than someone else does, falls well within reasonable doubt.

On Gal Gadot v. Henry Cavill: Buzzfeed shouldn't even be called a "news outlet" for Christ's sake. The blunder on their part and on others' really ends up hurting the case that there may actually be a difference in salary between male and female actors, such as the one Phil mentioned with Jennifer Lawrence in American Hustle. On the SC ruling: I think the Redskins are a different situation because the owners don't give a shit about Native Americans nor their heritage. Legality aside, it should be up to the oppressed group to determine when and how to re-appropriate things previously classified as hatred. On the shooting: Often for people it's all or nothing. Every death of a black person by a police officer is justified or a hate crime. I'm with Phil in that I think there is some wiggle room. This one is an atrocity and that officer should be behind bars. That video should have been more than enough evidence to convict.
@DmGray
@DmGray 7 жыл бұрын
on the SC ruling: You're literally arguing in favour of racial discrimination. Only people in X category are protected under X law. Where do you draw the line? What does "oppressed group" even mean? Does that mean Obama doesn't get a say in issues pertaining to black people & "hate speech"? (can we really argue a POTUS is oppressed? What about all the multi millionaires claiming status as "oppressed minorities"?) Seems to me a small number of cynical people try to manipulate these issues for personal gain. Either free speech applied to everyone, or it aint free speech. Either the law applies to everyone equally, or it's discriminatory.

You ask for the insurance and wallet first. I allows you to see if they have the motor skills to do that. If the person fumbles and cant give the items you asked then it is another reason to ask them about drinking or drugs. Also it can give you a reason to ask them to exit the vehicle to run field tests. I have heard many stories of officers asking for a DL and the person hands them a credit card.

I think the scariest thing about "The Slants" story is really how it show cases the lack of consistency in the American justice system. Their case was viewed by multiple different people and somehow ended up getting two drastically different answers over the course of time, and that's not even factoring in how the Red Skins have been fighting this battle for a while now and have managed to get different rulings as well. It really goes to show you that you just because you take something to court doesn't mean you'll get the "right" or "fair ruling" which is really the terrifying thing.

It's situations such as with The Slants that really show how that manages to happen.

It seems to me that a person that society gives the privilege and responsibility of wielding a deadly weapon should be seriously accountable for what they do with that weapon. Society does not give police officers license to be executioners. I find the defense proffered by the officer to be wholly unacceptable. The man acted out of fear when no indicator of a frightful situation was present. That is a lapse of judgement with the most serious of consequences being the outcome. Thus the officer should be held responsible for that lapse and I believe his police department also bears blame for equipping a man who clearly was not ready for the responsibility he was given. Being a police officer is hard that is not in dispute but excusing poor or disastrous outcomes by simply stating the difficulty of a task is not a defense it is an excuse. The record in my opinion shows a man who was at the very least criminally negligent in executing his duties.

Two things bother me about these Philando comments: 1.) The cop says he stopped the car for a "robbery suspect." It turns out it was a "broken break light." Now flash back before this incident. Philando was repeatedly harassed by the cops. He was stopped 49 times in 13 years. These stops never resulted in a major infraction. When will people acknowledge that this cop, like presumably the 48 other cops before him, racially profiled this man? Is there any white person in the U.S that has been stopped by police more than 4 times a year for over a decade? 2.) What bothers me is that (10:24) he says to the cop "I wasn't.." and shortly after the both Philando and the girlfriend responds to make sure the cop heard him. So at the point the cop shot, the man was reaching for anything. This is sickening.

1.) Seems like a frivolous point. Seems in the video he said he was concerned as it looked liked like a robbery suspect not that he was stopped for that. 49 times in 13 years seems a lot until you realize that's 49 times in 4745-4759 days. Since when has being stopped a bunch and not receiving a major infraction a show of anything? Sounds so scary...every 3 months he gets stopped and a minor infraction or warning...scary. Also I'm going to point out that making that pathetic of a declaration is weak...you are talking 4 minor infractions a year which I wouldn't be surprised to see people at 100+ over a decade. Although it would depend on the infraction as they would probably lose their license before that if it was anything notable.

How did that cop walk on those charges? Manslaughter is the unintentional killing of someone. The victim is dead, and the cop said that he didn't want to kill him. His logic was bullshit, the victim was complying, and the dashcam should have been the nail in the coffin. I really hope that the family sues for wrongful death and bankrupts the city and the cop himself. While I'm at it, I want to know why is it that these cops have such itchy trigger fingers. Is it that they can get away with it? Because these charges rarely stick? It's a sad day that we were held to a higher standard in an active warzone (Iraq) than cops patrolling our own streets are.

I disagree. It may be true that the officer intentionally killed someone, but he didn't have much time to make a choice. Philando literally told the officer that he had a firearm, which alone should have alerted Yanez into putting his finger on the trigger. He reached down to his waist, and that could've been his gun he was reaching for. If he didn't pull the trigger, then it could've been Philando that fired. The dashcam only helps a little, because it doesn't show what happens in the car.

Arthritic Penguin, although I, like most people, don't think he was, you really can't say for sure that philando WASNT reaching for the gun. It was fully loaded and in his one of his pockets. There are plenty of crazy people who would tell a cop that they have a gun on them right before reaching for it. (Especially if the person is intoxicated). Remember the officer didn't have the luxury of knowing all the facts or the time to think about the decision. That's just reality. I think it's callous to say he belongs in prison. But he definitely doesn't belong on the force.

Ryan Cowan I think this is a very reasonable statement. It's very tough for both sides of the argument because I can see how easily a cop could get injured in a situation like this (and a gun can be pulled and shot in a very short amount of time) but also how the cop seemed hasty and a bit jumpy (things that can hurt you as a police officer or save you depending on the situation)

I'm sorry, but that is complete apologist bullshit. You clearly are misinformed about CCW stipulations, but if you cannot react sensible and not blasting away with you're own gun when you stop someone who LEGALLY has the paperwork in place to carry their own firearm, then you should not be a police officer or in any high stress position, period. The police officer is legally and morally wrong, and the legal system failed Philando and his family.

About the Gal Gadot - Henry Cavil issue, I really think fake news are fond of putting a narrative first before facts. This is their way of getting attention and more traffic, which I think is so lame, misleading and misinforming the public. And I hate their bad habit of indirect retracting of their intentionally erroneous headlines with statements like "despite what you've heard..." instead of "despite what you initially heard from us..."

I don't think that is completely true. I did care when Jennifer Lawrence wasn't paid equally to her male co-stars in American Hustle. As Phil pointed out that it was bullshit because she was basically the biggest star in that movie at the time and her performance was equal to the other costars of the movie. She deserved equal pay for that role and eventually got it. That should have been done from the beginning.

I am a conceal/carry holder in MN. In order to qualify for this, all persons are required to take a lengthy instruction class which includes safety, laws, and handling of firearms. One of the most emphasized instructions in the class is, if you are pulled over and are in possession of your concealed firearm, you are to keep your hands on the steering wheel in full view of the officer, and inform him/her that you have a conceal/carry license, that you are in possession of your weapon, and inform the officer of the location of that weapon. You are NEVER to move for your wallet, weapon, ANYTHING, until the officer has cleared you to do so.

As it applies to Castille, we should put all the other stuff aside (blue lives or blm). Facts are, Castille informed the officer he had a firearm and did his duty as a responsible gun owner. The cop freaked out and shot him, in cold blood. The recordings show this. The fact that he wont be held accountable undermines the notions that cops protect and serve, as well as the notuin that the justice system will work for the people. Everyone loses in this situation, the family, the force, the community....only the cop maybe benefits from this (who will get a glorified severance package and he will likely find another job in another city or county).

Also, the cop appeared to be hostile and frightened, reacting and not acting. If your point is we should follow cops orders, then thats what he did. If your point is that he did not, it is impossible to say one way or another. However, events dont happen in a capsule, we see Castille do what a responsible gun owner does, inform the officer. The question we should be asking is in a world where gun owners carry on their personal vehicle does this even complicate the notion that one should say anything, at all? Does informing the police create a hostile environment and engender violent outcomes in the first place. Cause ithats what happended in the moment the officer freaked out.

The difference between the Redskins and The Slants branding issue, is that the group that would stand to be disparaged in the case of The Slants, is the same force that's attempting to change the narrative with their branding. In the case of the Redskins, there are not Native Americans in charge that are calling the shots on how their culture or identity is being portrayed. Overall, these things may seem like a similar issue, but narrative and context matters. Being talked about and misrepresented is wildly different from being the one speaking and controlling the perception.

Being the only actress/actor in the movie with an Oscar, she was automatically the "biggest" star as far as credits go. That little statue will earn you a nice raise in future movies, as well as first or special billing in the credits. Sure the others are big stars, maybe even more popular stars, but opinions doesn't sell, proof on paper does :p It also helps that she won that Oscar the year before Hustle premiered, and before production started. Had she been signed on to Hustle before her Oscar, they would've made a much bigger deal about earning an Oscar awarded actress in their movie.

Definitely agree on that they get off on things way more often than the should. It's a tough situation though. As a police officer or anyone that does a job long enough, you start seeing things in a very focused way outside of what a mainstream person would do in that same situation. Like I'm a straight guy that dates women. So I know the problems in dating women more than I know the problems of a woman that dates men. I only know me and my guy friends which are going to be somewhat similar to myself. It's hard to know just what police see that a regular person wouldn't get as twitchy about. They likely see way more messed up things than a regular person would assume they would see. Not saying the officer was correct or not, just that it is hard from an outsider point of view to know what's going on in their minds. EDIT: From that video and audio though, it looks like the officer totally bungled that and that guy died for that officers massive failure in reasoning and self control. :/

The video contradicts the officers testimony. The officer said that he pulled him over because Castile and Diamond matched a description but the other officer made no effort to identify Diamond. To me, I believe the officer lied to make sure he would have been acquitted. But this new video just further upsets me because a legal gun owner has done everything right and he was supposed to do but ends up getting killed for it. And the usually advocates for gun rights (The NRA) are no where to be found. This is something you'd expect them to campaign and fight for the death for. It truly saddens me that an innocent Black man was a victim of an officer who was poorly trained and it cost him his life.

allycookie2009 at 8:30, he stated that he thought Castile fit the description of a robbery suspect. If you pull someone over and then tell him why you are pulling him over, wouldn't you want to say you're also a suspect for a robbery as well and ask him to step out the vehicle? I'm not a lawyer nor a police officer but that seems a logical thought process.

Not sure it would be wise to tell him he is a suspect to a robbery, because lets say he actually was the robber, wouldn't he be more inclined to shoot? I think he figured he would just run his license. I don't know, not sure what police protocol for that would be.

Kari Cummings that is inciting panic. You won't be charged with shouting the word, you will be charged with the aftermath of shouting it (more or less). It is the intention that gets you in trouble. The words simply convey your intentions. Like if some one said the word "fire" in a different context in the movie theater when referring to the movie they just watched to a friend. The word fire isn't illegal, it's the danger of mass panic and intent that is illegal.

1. In the medical field the first thing you are taught to say when you see a patient begin to act in an unsafe manner is "stop". I think you're spot on with the analysis that this cop was "spooked" and it quickly devolved into an unfortunate tragedy. He doesn't say "stop," he says don't reach for the gun. My guess is because of this Castile continued to reach for his identification while saying he was not reaching for his gun. Had the officer said "stop" or "stop reaching" he could have maintained control of the situation and they could have had the chance to converse about the gun in the vehicle and an acceptable way to reach for his identification that allowed the officer to be at ease. I don't believe the officer had any ill intentions going into the stop but this spotlights poor training in de-escalation and maintaining calm control of POTENTIALLY hazardous situations. Intentions aside, I'm not particularly thrilled with acquittal, but am glad to see he will no longer be a part of that department. 2. With the slants vs the redskins. The slants represent a small group of people who have settled on a name to represent themselves while the redskins are a team that represents their city/state (even if its not publicly owned). To some extent the redskins are beholden to their fans, I don't feel like they should be forced legally into changing anything but they need to be aware of and consider the message the public says they receive from a racially charged name. In the end it's up to them to decide how much backlash is required for a name change but until then the fans and people need to vote with their monetary (or lack thereof) support.
