Dude, at any point Garp could have flattened Ace and brought him to "justice" himself. Could have stopped Luffy at any time. Garp made a choice and didn't "have" to do anything. Just like at Marineford Garp LET that happen.

@@rishabhanand4973 Yeah, it's pretty 'whatever you want' in the manga, but I do think the point was about someone getting what they want and that being their downfall. Oda loves foils and this would be a great foil to the crew at the start - pretty much everyone gets it (Usopp the pirates to come, Zoro the Mihawk meet, Nami the 100mil) and it goes horribly for them. Luffy - who knows to want 'good' things naratively - is what saves them.
