The Fifth Estate

5 жыл бұрын

In July 2011, Richard Oland was found bludgeoned to death at his office. It was a killing that shook New Brunswick to the core, given the family’s stature in the province. His son Dennis was eventually convicted of murder, but he won on appeal based on an error in the trial judge’s instructions to the jury. Now he’s being retried and his fate is in the hands of a judge and no jury.
Watch our previous investigations into the murder of Richard Oland:

I wonder if they at least looked into the husband of the mistress. I mean... I hope they would have verified an alibi of him (and his wife) but then again, they seemed to narrow in on Denis right from the beginning. Don't get me wrong- Denis should be a suspect and coupled with his tenuous relationship with his father it could provide motive to such a rageful and personal killing. It's just basic for murder investigations to begin with people closest to the victim, like family members. But it does seem like they developed tunnel-vision fairly quickly after that interrogation. I can easily on the fence. It's funny since I recall being steadfast of his guilt up to and during his first trial. Now I'm not so sure. I'll will concede that his money and privilege (eh, mainly the MONEY) were beyond helpful in securing an appeal (i.e. good lawyers!) I guess we'll see just how helpful in July after the decision.

It seems he wasn’t a loved man, respected perhaps, not loved. If the family rally’s around the son, even with evidence and surveillance tapes proving he was there when he was killed & such, then maybe they all knew it would happen. Dennis wouldn’t be the only benefactor! The entire family would benefit. The mistress seems like a fruit loop, I’m surprised they didn’t look closer at her. He had a falling out with the moose head beer company, I believe they should look closer into that but considering there were over 40+ wounds that speaks to the victim knowing the person who killed them. I think In that red bag was a change of clothes, I believe he did kill him and was able to get rid of the evidence in different places

@tonyk501 5 жыл бұрын
Here is what this murder case boils down to: 1) Neither the murder weapon nor the victim's cell phone were ever found which could have provided vital evidence, including communications evidence and DNA evidence. 2) The police incompetently contaminated the crime scene which could have provided vital evidence, including DNA evidence. 3) The police did not have a chance to examine the defendant's brown blazer jacket before it was conveniently dry-cleaned the very next day after his questioning. Had the jacket been seized as evidence upon his interrogation, it may have perhaps yielded vital blood and DNA evidence at that time rather than examining it four months later. 4) Even though the victim was generally not well-liked as a person, at no time was there ever any other potential suspect identified or pursued that could have potentially had sufficient enough motive and severe enough hatred for the victim to viciously murder him in such a brutal fashion only to steal his cell phone. 5) The murder victim was known to be having a long-term extra-marital affair with another woman and a few of the family members knew about it, including the defendant who was also having major financial problems at the time and was heavily leveraged with the murder victim for financial support. Unresolved Questions: 1) No one can still adequately explain how the victim's blood somehow magically ended up on the defendant's brown blazer jacket, and storing it in the same closet alongside the victim's jacket during business hours is not an adequate enough explanation for the presence of blood. 2) The defendant initially told police he was wearing a navy blazer and not the brown one he actually wore that day. This seems like a very convenient detail to "forget", considering the brown jacket was handed off to dry-cleaning the day after he was interviewed by police. 3) The victim was murdered with what was likely a hammer or a crowbar and suggests that the perpetrator may not have been the type who could have had easy access to an unregistered/untraceable/illegal firearm. 4) The defendant's presence being seen at the wharf after the murder and the contents of the shopping bag he was seen carrying out of the building on video security camera footage have still not adequately been explained. 5) After the murder victim's death, the defendant's debt to the murder victim was erased. He also inherited $150,000, and became co-director of two of the murder victim's companies and president of another. He has hefty legal bills but is likely in a better spot financially now than he was under the potentially ruthless financial supervision of his father. Possible Scenarios: 1) The defendant is innocent and some random unknown thug chose the victim's business office to viciously murder him simply to steal his cell phone. Seems possible, but not probable. 2) Some non-family business associate or other individual or group of individuals who knew the murder victim and intensely disliked him colluded on a plan to have him killed. Possible, but there is no evidence that has been brought to light to suggest the murder victim was involved in organized crime or with shady business partners. 3) The murder victim's mistress killed him or paid someone to have him killed because she was jealous. Possible, but extremely unlikely. 4) The murder victim's mistress's 84 year old jilted husband killed him or paid someone to have him killed because he was jealous (despite his testimony he did not know about the affair until 15 months after the murder). Possible, but extremely unlikely. 5) The defendant either killed the victim all by himself or paid someone else to help him do so and also crucially dispose of the murder weapon and cell phone, which could explain the blood stains on the brown jacket and the graphic murder scene photos which suggest the victim was still in a seated position when he was attacked, and which further suggests he quite possibly knew or trusted his visitor(s) in the room well enough not to sense he was in any danger. That would have left only the brown jacket as "smoking gun" evidence that needed to be "sanitized" but not destroyed or discarded outright, as that would have cast heavy suspicion on the defendant. The jacket may also have been laundry washed that same night before being taken to the dry cleaner the day after the police interviewed the defendant. It is also possible other family members may have been aware and complicit in the plot to assassinate the murder victim for various reasons. Conclusions & Verdict: It appears more "likely" than "unlikely" that the defendant was, indeed, involved in the murder of his father in some capacity which may have included assisting the "hired assassin(s)" to gain entry to the building from the back door. The cell phone tower pings also suggest that the defendant (or an accomplice) were in possession of the murder victim's cell phone near the defendant's residential area shortly after the murder. In addition, anyone who planned this murder must have already known for a fact in advance that the murder victim did not have security video cameras in his office and only someone with previous access to the murder victim's office would have been able to know this information with 100% certainty. However, in the absence of 100% "beyond reasonable doubt" evidence which would point the finger unequivocally at Dennis Oland, and also the police department's horrendous mismanagement of the crime scene, it is more likely he will be found not guilty on those two grounds alone.

You do realize that no one is required to answer questions asked by the police, nor does anyone have to explain things to them. It seems you don't because the first half of your ridiculous commentary tries to cast the son in an unfavorable light because he didn't, or didn't do it enough to meet your standards. In our legal system it is up to the police to secure evidence to prove one guilty. No one is required to prove their innocence. Your second half (and after reading it I recommend you not attempt script writing) seems predicated on your belief that your stating something is unlikely establishes anything probative of value. However, it's just your opinion, which I find unlikely.
