In Australia we had a near identical case. Clive Palmer (a billionaire, failed politician, Trump wannabe) was ordered to pay 1.5 million dollars in damages for unauthorised use of Twisted Sister's song in his political campaign, pay legal cost and interest too. Ordered to remove all videos and destroy all copies and permanently restrained from reproducing or altering the song ever again. The funny thing he was claiming it wasn't a copyright issue, he didn't steal it... but he spoke to Universal Music to get the rights to the song, and walked away after being asked to pay 150k. The billionaire has a history of getting into trouble for refusing to pay for things, and also defending himself in court to the irritation of judges for being both a bad witness and a bad lawyer, so being fined 10 times the original amount was cause the Judge said "the need for punishment and deterrence is high"

I find the judge has already been too lenient to Trump for not demanding him to take down the infringing videos. As Hayes's son said, they don't want the song to be politicized or associated with Trump, and leaving those videos up very much does that, so that's cause for irreparable harm. Not to mention Trump already received C&D letters multiple times before this point and he still intentionally violated the copyright. I'm not sure why the judge allows him to keep those up. He certainly would just use that as precedent for infringing on many other people's copyrights. And when they manage to take him to court and he still gets to keep all those infringements up, he already benefits plenty and causes significant damages to people who don't want to be associated with him.

It’s kinda like that time my dad actually paid attention to the lyrics of “She’s Always a Woman” by Billy Joel. The melody is beautiful and very soothing to listen to, but the lyrics aren’t exactly complimentary in their literal interpretation. Apparently, the lyrics were supposed to be understood more metaphorically, as the song was written for his wife and manager at the time: a tough manager and good negotiator, at a time when women high up in the music industry were few and far between, and Billy implies with his song that thinking she’s hard-nosed and “unwomanly” says more about your shortcomings than hers. In case it’s not obvious, my dad and I are both autistic to some degree, and contextual/subtextual metaphors aren’t really our strong suit. 😅

Since 1976, there have been multiple public requests not to use musical works or lawsuits for using musical works without authorization. All but one of them were by Republican candidates. Bruce Springsteen had to speak up rather forcefully to prevent 3 of them from using "Born in the USA": Ronald Reagan, Bob Dole, and Pat Buchanan. And if there's anything that speaks to rank ignorance or Republican leaders wanting to exploit voter ignorance, it is these Republicans using Springsteen's iconic song that is heavily laced with lyrics critical of their support for big businesses. I am 90% confident that not only did Donald play musical works at his rallies without authorization, he hasn't paid royalties. Brian May was adamant that Donald not use "We Are the Champions", and he used it anyway. Every music label and artist can probably sue Donald and win, this is not a person who respects the law.

If you look at the last election, the majority of non-urban areas vote Republican and the majority of urban areas vote Democrat. Big cuts to farmer subsidies, no ACA which means less healthcare available in urban areas, tax breaks for extremely wealthy people at the cost of the average citizen, I can't really find a reason to choose him, even if you believe you don't have a say in politics anymore. To me, its freedom to enjoy the fruits of your labor, freedom from government interference, and freedom of choice as to how to live my life. That may mean I have to live with a more limited social safety net, limited government protections, and other "limitations" that government subsidies could provide -- I'm okay with that, and many others are as well. Welfare for me isn't a good thing -- it's something to be avoided. I think that might be the philosophical distinction. On a personal note, my grandfather also escaped from Southern Spain when the Communists/Socialists still controlled the region -- I can never support that.

In order to violate someone's copyright protection, you have to use the song publicly in a way where the owner of the license holder does not approve of its usage with the only exceptions being things that the person could not control. (Like walking down the sidewalk and someones blaring the music from their car as they pass you, for an example). In order to be able to get the necessary requirements in order to get their permission to use their songs, It varies from artist to artist and its up to that entity whether or not you are able to use their music for anything. It could be from artists like Kevin Macleod where all of their music is free to use in any setting to people like Michael Jackson where I'm pretty sure you needed explicit permission in order to use their music. And then other musicians would be in the middle. For this example. Donald Trump Used Issac Hayes Music without the permission of the current copyright holders and they had never even contacted them prior to this. And when THEY contacted HIM to stop using their music in a ceast and desist. Trump straight up ignored them and played the music anyways. Making Trump Liable for Copyright Infringement because this is one of the most textbook examples of copyright infringement. The only close second would be XqC’s entire streaming career. Because the fact hes allowed to even make a living off of what he is doing is borderline disgusting. In Comparison to Kamala Harris. She contacted the initial copyright holders to ask if they can use their music at one of their panels. And because the artists would want for her to play their music. They allowed it. Some even giving a donation to Harris. But even if we get rid of the Republican vs Democrat labels. Kamala Asked to use their music, while Donald Trump Used it without anyones consent. And they used it at a public event where they would get sponsored from. Making this situation a “respond to asap” for these musicians so their followers don’t get their involvement confused. And this applies to all sources but generally social media posts Are a little bit tricky. Especially for youtube Now for KZbin in general its a little bit complicated. But usually if you use their music in a creative way and to take a creative spin on it then you’re mostly good. (I wouldn’t risk with stuff from japan because their copyright system is aggressively stupid) For an example of Creativety. Using the music in the video to explain certain elements of what it going on in the video. One of the best examples of this is TheFireyJokers Videos. For Parody of the original source material. Just listen to one of Weird Al Yankovinch’s songs. His entire career is Parody. Then theres also for humor which is a bit of a grey area but usually I think it depends on the initial copyright holder. However in all cases, the copyright holder needs to make their policies detailed and obvious for everyone to tell where their stance is before they tried to sue someone, Example is Nintendo’s Embarrisingly stupid lawsuit against Pointcrow where they sued Pointcrow for someone that he was in his rights to do because they said that individuals can use their music in their videos Now I don’t know everything about the copyright protection law, theres definitely a lot more to this that im not personally aware of. But I know enough to say with certainty that what you said couldn’t be farther from the truth with decades worth of documents to prove this. And in this case Trump has 0 case against them, especially trying to use the straw man that the license holder isn’t the original person who used the theme. (like nah really, that should be obvious. But its also obvious that they have the power to make decisions based on that song). Then going further with saying he would have loved for Trump to use the song in his rally as he would have supported them. Despite him being dead ages ago so you would never really know

In radio (local broadcasting), you don't ask permission, you just get a general license beforehand. Then start playing music and then log and pay the licensing fees at the end of each month. If a group don't like what you're doing, you are giving a cease and desist, so you don't play music from that label or band again. What makes this all weird is the refusal to stop playing a specific label or artist. If we were all so litigious, it screws with the system and now you have to get licencing rights from everybody beforehand. Crazy. They don't see what harm they are doing, but they are.
