From Officer Katie Finley's report:
"On Wednesday, February 5, 2020, at approximately 1901 hours, Patrolman Renken and I responded to the back parking lot of Number One Lounge located at 5555 Ridge Road for report of a motor vehicle accident. Dispatch advised that the caller stated the female driver was not being cooperative and seemed intoxicated.
Upon arrival I spoke with Amanda Myers and asked her what happened. She stated she was backing up out of a parking space when Stanley Mckee was pulling into the parking lot and that he struck her vehicle as she was backing up.
Ptl. Renken was speaking with Stanley and then came over to speak with Amanda. I then went and spoke with Stanley, who stated he had already backed out of the parking lot but came to a complete stop before entering onto Westlake Ave. due to yielding to oncoming traffic. He stated that Amanda backed out of a parking space and when continuing to back up she struck the front end of his vehicle with her rear end. Stanley stated he could hear someone outside yelling at her to stop her vehicle when she was backing up.
Stanley stated that Amanda exited her vehicle and told him she would just give him $50. Stanley mentioned to her that a new headlight would cost more and they could just exchange information and handle it that way.
When Amanda started to become uncooperative and telling him he was the one pulling into the parking lot and struck her vehicle he decided it was a good idea to call police. He stated he could tell she had been drinking Amanda was slurring her speech and had an odor of alcohol coming from her person."
Amanda Myers was arrested on charges of Operating a Vehicle While Intoxicated, BAC Test Refusal w/ Prior, and Physical Control. Under Ohio law, a 'Physical Control' charge is similar to an OVI charge in that it deals with vehicles and intoxication, with one major difference: Physical Control does not require that the vehicle have ever been driven or even started.
Myers pled not guilty to all three charges on February 12th, also filing a petition to be declared indigent and have an attorney appointed to defend her. The court granted Myers' petition, declaring her indigent and - kind of hilariously - appointing Attorney Joseph O'Malley to represent her. O'Malley is the prosecutor Myers was referring to with her name-dropping, only he is no longer working in that capacity...
You see, O'Malley is best known for his 2013 "indefinite disbarment" after he was charged with nine violations of the Rules of Professional Conduct arising from his improper influencing of a judge and his August 2011 convictions in an Ohio federal court for misprision of a felony (with Dewitte-level excuses) and making a materially false statement in a matter within the jurisdiction of the federal government. Although most people think of "indefinite disbarment" as, you know, indefinite... reality shows otherwise. A 2007 paper titled "Should Permanent Disbarment be Permanent?" published in The Georgetown Journal of Legal Ethics provides a good overview of the impermanence of permanent disbarment.
Its author found that "Five states mandate that all disbarments be treated as permanent. Eight states allow for disbarments to be permanent in some situations. In these states, when disbarment is not permanent, readmittance can either be applied for in seven years, five years, or at any time, depending on the jurisdiction. . . . The remaining 35 states and DC have no procedure for permanent disbarment."
O'Malley's 2013 disbarment generated a lot of press, but everyone on the planet seems to have missed the fact that he was reinstated in 2016. You heard it here first.
On 3/19/20 Myers case went to trial. Myers was found not guilty on the charges of OVI and 'BAC refusal w/ prior,' but was found guilty of reasonable control. It is not clear at this time what, if any, penalties she was subject to other than a $315 fee or fine. Clarifying records have been requested from the court and we inquired with Kelleys Island Police about whether this arrest impacted her job.

On Friday morning we received records indicating that on December 7, 2012 Amanda Myers was *arrested for shoplifting* from Walmart. The report states that an Asset Protection Associate observed Myers select Crest Whitestrips, conceal them under a baby car seat, and exit the store without paying. Myers was 22 years old and unemployed at the time. The Whitestrips were valued at $43.97. On Thursday morning I contacted Kelleys Island Chief of Police Shawn Craig inquiring about the status of Amanda Myers' employment. He has yet to respond. The records from Myers' shoplifting arrest are available now on Patreon, as are the records relating to her OVI arrest. A few pages with annotations are included in the post's image gallery. The post also presents messages we exchanged with Parma Police Department as part of our (unfortunately common) tug-of-war over access to records, many of which are still outstanding in relation to Ms. Myers' arrest. We will get them all. *Although I don't condone shoplifting from any store, if someone is going to steal, Walmart is a stupid target. You don't become the largest retailer in the world by having bad asset protection.

Right... They literally want that other cop to put their career on the line and the only way they have to feed their kids and put a roof over their families head all because the other cop wanted to drink and drive a d doesn't wanna take responsibility for their actions, yet wanna tell other people they need to man up and take responsibility for their actions. It's all a double edged sword. I like to think these cops that get arrested is karma for fkn over people and arresting people they knew were Innocent.

The thing is FSTs aren’t actually tests. They’re not pass or fail. If they ask you to do FSTs they’re already convinced you’re drunk and are just getting evidence for court.

Oh yeah. I'm not a cop, but from what I've been told, SFSTs are usually performed to gather more evidence after the decision to arrest has been made. That's just my anecdote though.

@@paulden3158 yes I got accused of that many times, because I'm hypoglycemic. which is why we use evidence and facts. fact is she slurred her words, fact is she refused to do any kind of testing that would clear her. fact in her vehicle is damaged and the other person's vehicle is damaged and they called the police ,because they have nothing to hide so they were cooperative and forthcoming. but right now we're not talking about other people we are talking about this females actions, and do you want this female on the road drunk? cop coming to your door if you call the police is that what you're trying to tell me?

Yeah they are, it helps the officer look good in proving his case. If your going to go tell him this and this only, let's go, and don't speak another word until court🤫🤐. Some places its 90days for the 1st offense. 2nd Offense is a year.

This is why I'm a huge proponent of body cams. They keep everyone honest, and protect good cops from false accusations. I retired before my department had them, but we had dash cams with remote microphones clipped to our shirts. I made sure that every interaction on traffic stops was done in sight of my dash camera with my microphone on. And when I transported a suspect I always turned it around to cover the back seat of my patrol car. I had two cases where false charges were lodged against me (both where the female suspect claimed misconduct during the ride to jail) and immediately disproved by that camera. I guess they didn't notice me turning the camera around before we took off for the lockup. About the only time I'd ever turn a body camera off would be when getting a tip from a confidential informant, because if that footage got out their lives could be at risk. The woman arrested in this video seems very entitled, and apparently doesn't think the law applies to her. I'm quite surprised that she was found not guilty on the Sobriety Test Refusal charge. Maybe dropping that was part of some sort of plea deal. This may have allowed her to keep her job, because a cop who can't drive usually can't continue to work. Go figure.

"Why would you want to refuse?" - Uh, because as a police officer, she knows: 1) that she is drunk and 2) field sobriety/divided attention tests establish circumstantial proof of intoxication or impairment and are often considered during trial in most states 3) you have the right not to incriminate yourself and, especially if you're drunk, that's all these test will do. I can't condone anything else she did (allegedly), but at least she got that right.

It's almost always better to refuse, however in this case he was giving her the chance to let him *wink wink* judge her performance on the field sobriety and basically do her a solid by going easy on her when he does it. Thats why the kept checking in on her - something they never do for other citizens. Since it isn't pass/fail, he can just do whatever and leave it as a fender bender. Her refusal gives him no chance to do her a solid, he has to arrest her, and add all the additional charges.

The world needs more of this cop! *but I’ll also say, I’m not so sure he wasn’t about to cut her some “you’re a cop I’m a cop” slack at the beginning, just before she refused FST’s. He seemed to be pretty heavily implying that taking the test would be in her best interests (😉). But she’s an idiot and let the offer drift.

@Glow in the dark : There's a big difference of being a mall security gaurd and a cop. In the description it said she was arrested for shoplifting at Wal-Mart previously before she got busted for the alleged DUI. No, she's not what I would call an upstanding citizen.

I've watched a few of these and most of the arresting officers acted like they were doing an injustice to the accused when they were clearly smashed, one registered a .2 ABT, but this officer was objective and really pointed out the aspects of her refusal to comply and also her failure to obey the law when she should know better since she was quick to criticize his knowledge in processing her. The way she talks about being in with the owner of the bar, whose brother is a prosecutor, and who is best friends with the Mayor, is just reprehensible. She thinks because she's acquainted with them that she should be let off. And the whole "I cannot believe you're doing this to another cop" is also disgusting. She's exactly the kind of cop we do not need. I hope she's gone from law enforcement forever. Let her work in the bar for the rest of her days, and attend A. A. in the afternoons before going into work, the dirty skank.

Ok so this one cracked me up. Not only did she give herself "away" many times, but I love how when they actually found the damage done to her car, she exclaims: "That wasn't there before; how could I have done that to his car!?" 🤣🤣🤣🤣🤣 Also when she was mentioning how she was backing up and didn't see him, but "thought that she might have felt a little something"....This one was a realllllll winner! The one lie she did maintain was that she had 2 or 3 drinks, but nothing after 4:30!🤣🤣😂😂😂😂😂😂😂 EVERYONE knows that bartenders "sample" (actually we called it: "Quality Control") during most shifts, and ESPECIALLY if you work for a neighborhood bar, that your boyfriend owns, you're getting litty 3,000 EVERY SHIFT!

I feel like most people coming out of a barber shop would act "professional and cool"... particularly compared to most people coming out of a bar after last call. We're so conditioned to seeing irrational people interacting with law enforcement that when we see someone normal it's "professional and cool." True, but impairment shows different in different people, that's why all those things are called "clues" to show impairment. The majority of the OVI/DUI rests in the breath or blood sample. Since she refused everything, they entire case rests on the slurring of her speech, which is why she got off.

Major credit to the arresting officer for not letting her go just because she’s a cop. Anyone else in society, a doctor, a teacher, a construction worker would have been arrested. “Professional courtesy“ really shouldn’t exist as cops should know the law better than anyone else in society

She's already sent me to jail and refused to bail me out. And she told all of my friends not to bail me out. I f'ing love my mom.

I love how he was reluctant to arrest her and gave her every chance to do the right thing, and then when she basically tried to intimidate him by telling him how connected she thought she was, he just said "Oh, well since you put it that way..." and shut the door on her. Chances were over at that point.

special treatment per usual a local fire lieutenant in the capital city here that I know through a friend and from HS said that the local police let obviously drunk DUI firefighters go home all the time without arresting them

Sad to say she did get away with this... The attorney she name dropped ended up representing her and she was found not guilty somehow. Says other details in the description about how that attorney is no stranger to corruption in the first place

@Cassandra Barrera She didn’t admit they were a trap. She said basically, she knows how they work. FST’s are not pass or fail. If the officer suspects you’ve been drinking and even if you do the FST’s with little trouble, you’ll be asked to take the breathalyzer. The breathalyzer they use in the field is not binding. It’s just a guide. If you blow a .02 and you did well in your FST’s, he’ll most likely cut you loose. But remember that DUI is not only for alcohol. So if you show signs of drug use, they can take you in and get a warrant for a blood draw, if you don’t agree to one. But just because they arrest you for DUI, doesn’t mean you’re charged. It just means that they suspect it. You’ll go,to the station and be given a chance to take the official tests.

Confirmed: Field Sobriety Tests are a trap. Doing a fst test, even if you're stone cold sober, could lead to an arrest if the cops decided that day. - A little off balance? Jail. - Step off the line? Jail. - Have natural slurred speech? (Like I do) Jail. The only clear way is a breath test. Even if you have to go to the station blow 0s and have all the charges dropped. @@sprice9964 they are not designed to pass them. They're even called field sobriety "exercises" now, not tests anymore. Because you can't pass them. If you're put through FSTs the cop already determinded you're too drunk to operate. The tests are performed so the officers can add more "evidence" to their claim. If you "pass" FSTs you didn't pass, the officer just couldn't get enough material for an arrest.

I’ve always thought those tests were just a trap. Glad she confirmed it. Those tests are just to have an excuse to arrest someone. If the cop already made up his mind about you doing those tests is pointless. Like she said, it’s just for them to have more evidence for the arrest. That’s why lawyers tell you to refuse all tests.

All these years later and she’s still working as a police officer. I have no problems with a police officer getting a DUI and keeping their job as long as they complete the appropriate punishment. But to show the clear lack of integrity that she shows is a huge problem and a continued reason why there’s so much mistrust of the police nationwide.

Exactly, and considering her recent criminal history for theft I’m amazed that she got the job in the first place. Cops like her make our communities very dangerous. This is about the third arrest of a cop video that I’ve seen that they were able to lose the case and keep their job and I find that truly disturbing, they must get away with it all the time.

@@SHurd-rc2go lol right? genuine drunkards sound and behave mostly normal when drunk. they're so dependent on alcohol they start talking and acting stupid when they sober. like bender from futurama. these types will blow 0.2 and you just had a perfectly normal, sober-seeming interaction with them for 15 minutes prior. some even claim that they haven't had a drink in 10 hours and tbh that is completely possible.
