On Friday morning we received records indicating that on December 7, 2012 Amanda Myers was *arrested for shoplifting* from Walmart. The report states that an Asset Protection Associate observed Myers select Crest Whitestrips, conceal them under a baby car seat, and exit the store without paying. Myers was 22 years old and unemployed at the time. The Whitestrips were valued at $43.97. On Thursday morning I contacted Kelleys Island Chief of Police Shawn Craig inquiring about the status of Amanda Myers' employment. He has yet to respond. The records from Myers' shoplifting arrest are available now on Patreon, as are the records relating to her OVI arrest. A few pages with annotations are included in the post's image gallery. The post also presents messages we exchanged with Parma Police Department as part of our (unfortunately common) tug-of-war over access to records, many of which are still outstanding in relation to Ms. Myers' arrest. We will get them all. *Although I don't condone shoplifting from any store, if someone is going to steal, Walmart is a stupid target. You don't become the largest retailer in the world by having bad asset protection.

This is why I'm a huge proponent of body cams. They keep everyone honest, and protect good cops from false accusations. I retired before my department had them, but we had dash cams with remote microphones clipped to our shirts. I made sure that every interaction on traffic stops was done in sight of my dash camera with my microphone on. And when I transported a suspect I always turned it around to cover the back seat of my patrol car. I had two cases where false charges were lodged against me (both where the female suspect claimed misconduct during the ride to jail) and immediately disproved by that camera. I guess they didn't notice me turning the camera around before we took off for the lockup. About the only time I'd ever turn a body camera off would be when getting a tip from a confidential informant, because if that footage got out their lives could be at risk. The woman arrested in this video seems very entitled, and apparently doesn't think the law applies to her. I'm quite surprised that she was found not guilty on the Sobriety Test Refusal charge. Maybe dropping that was part of some sort of plea deal. This may have allowed her to keep her job, because a cop who can't drive usually can't continue to work. Go figure.

"Why would you want to refuse?" - Uh, because as a police officer, she knows: 1) that she is drunk and 2) field sobriety/divided attention tests establish circumstantial proof of intoxication or impairment and are often considered during trial in most states 3) you have the right not to incriminate yourself and, especially if you're drunk, that's all these test will do. I can't condone anything else she did (allegedly), but at least she got that right.

It's almost always better to refuse, however in this case he was giving her the chance to let him *wink wink* judge her performance on the field sobriety and basically do her a solid by going easy on her when he does it. Thats why the kept checking in on her - something they never do for other citizens. Since it isn't pass/fail, he can just do whatever and leave it as a fender bender. Her refusal gives him no chance to do her a solid, he has to arrest her, and add all the additional charges.

True, but impairment shows different in different people, that's why all those things are called "clues" to show impairment. The majority of the OVI/DUI rests in the breath or blood sample. Since she refused everything, they entire case rests on the slurring of her speech, which is why she got off.

I’m not trying to play down his choice to do the right thing here, but if she’d have drunkenly stumbled through a field sobriety test, I have a feeling this would’ve played out much differently.

I might be wrong, it's hard to tell due to her slurring, but i think she said "this is exactly why Karma is going to shit." Earlier she told him she hoped Karma would come around and bite him in the ass. Doesn't matter what she said, she was wrong on so many levels every action and word that came out of her mouth. I like to think she said Karma, because Karma did come around. I hate when cops think they are above the law.

I've watched a few of these and most of the arresting officers acted like they were doing an injustice to the accused when they were clearly smashed, one registered a .2 ABT, but this officer was objective and really pointed out the aspects of her refusal to comply and also her failure to obey the law when she should know better since she was quick to criticize his knowledge in processing her. She doesn't even believe in the laws she's sworn to uphold!

@Cassandra Barrera She didn’t admit they were a trap. She said basically, she knows how they work. FST’s are not pass or fail. If the officer suspects you’ve been drinking and even if you do the FST’s with little trouble, you’ll be asked to take the breathalyzer. The breathalyzer they use in the field is not binding. It’s just a guide. If you blow a .02 and you did well in your FST’s, he’ll most likely cut you loose. But remember that DUI is not only for alcohol. So if you show signs of drug use, they can take you in and get a warrant for a blood draw, if you don’t agree to one. But just because they arrest you for DUI, doesn’t mean you’re charged. It just means that they suspect it. You’ll go,to the station and be given a chance to take the official tests.

All these years later and she’s still working as a police officer. I have no problems with a police officer getting a DUI and keeping their job as long as they complete the appropriate punishment. But to show the clear lack of integrity that she shows is a huge problem and a continued reason why there’s so much mistrust of the police nationwide.

Confirmed: Field Sobriety Tests are a trap. Doing a fst test, even if you're stone cold sober, could lead to an arrest if the cops decided that day. - A little off balance? Jail. - Step off the line? Jail. - Have natural slurred speech? (Like I do) Jail. The only clear way is a breath test. Even if you have to go to the station blow 0s and have all the charges dropped. @@sprice9964 they are not designed to pass them. They're even called field sobriety "exercises" now, not tests anymore. Because you can't pass them. If you're put through FSTs the cop already determinded you're too drunk to operate. The tests are performed so the officers can add more "evidence" to their claim. If you "pass" FSTs you didn't pass, the officer just couldn't get enough material for an arrest.

Just read the comments. It’s embarrassing. We know the other cop knows better, and are just as pissed at them as everyone else on here. We know what it can do to their careers, not to mention the hypocrisy and stupidity of their actions. No excuse.

I like how she said sobriety test is a trap. All citizens need to remember that, if you do the field sobriety test its more evidence against you that you are intoxicated.

I totally noticed that. Luckily I don’t drink and drive (I don’t even drink lol) so I don’t have to worry about that shit but still...seems pretty wrong that cops supposedly “know” something is a “trap” but they still administer them to the public. I know they have no choice but still...

It's an attempt to prove one way or another that the subject is indeed intoxicated. When they first speak to you while you're in the car, they stick their head in to see if they can smell alcohol. If they don't, they are less likely to think you're intoxicated and continue with testing. If they have reason to think you've been drinking, they'll ask you to do some tests. If you're not drunk, then you'll pass the tests. It's not a trap at all. Only those who've been drinking should consider it anything but vindication. In most areas, you can opt out of the field tests and simply elect for a breathalyzer or a blood draw, which will also prove your innocence, if you are indeed innocent. Trap.. lol

Yeah, well, if you're intoxicated and driving you should be arrested, no questions. Obviously the fsts are a trap....they are to trap drunk people into incriminating themselves

@@MarkBradfield the thing is now they have to wait for a nurse/medical person to draw her blood. If she is sober enough by then, she beats the case. If she does the field tests, fails, then passes the blood test when the nurse draws it, she’s still convicted. And then idk about the laws in that state, but in Texas, it’d be nothing cause it’s private property. You can sit in you car, drink, and peacefully drive and as long as you don’t hit a public road, you’re good. The crime in Texas is operating a car on public roads while intoxicated. In a parking lot a cop would wait for you to drive on the street and then hammer you.
