Wait one second. I may be wrong but anyone being sued has a right to see the evidence in advance regardless of whether you hired an attorney or not. The phase of it where you are IMO 100% obligated to show them ALL evidence that will be used or might be used in any way is known as discovery. It doesn't matter that you didn't hire an attorney. In fact one who did may have hired an attorney who is known for defending against such surprises. ALL people facing any litigation have a 100% right to ALL evidence very well in advance to see the evidence. This just allows due process and could help prevent abuse of legal processes and malicious prosecution of which are crimes. If it malicious prosecution already it should be one and made to be a felony that is only the second most heinous in comparison to other vile detestable crimes which provoke rage amongst all who hear of them. You can imagine what the first most heinous crimes are and so I am not mentioning them.

Furthermore it is a mistrial when the other party couldn't see the evidence in time to prepare a defense. I wonder what percentage of cases are thrown out, postponed or simply result in an acquittal. I also wonder how many judges are deeply angered by these surprises and give thar plaintiff a very long and harsh ear beating of a lecture and threatened to hold someone in contempt of court. I know of I ever went through all of the many years of work it takes to become a judge and had one of those plaintiffs he or she would tremble in fear of whatever draconian sentence they might get!!!!
